Petitioner is a private<\/p>\n<p>limited   company   engaged   in   the   business   of   maintaining   cold<\/p>\n<p>storage   for   keeping   frozen   seafood   items   for   export.     The<\/p>\n<p>headload   workers   under   the   1st  respondent   were   doing   the<\/p>\n<p>loading   and   unloading   activities   in   the   cold   storage   of   the<\/p>\n<p>company.   Apart from the above cold storage, in view of the new<\/p>\n<p>regulations   regarding     export   and   the   directions   of   the   Marine<\/p>\n<p>Product   Export   Development   Authority   and   Export   Inspection<\/p>\n<p>Agency, they have constructed a &#8216;Palletized Store&#8217; which has to be<\/p>\n<p>run   as   per   directions   of   Export   Inspection   Agency   and   HACCP<\/p>\n<p>manual.  The importers are very much careful about the hygienic<\/p>\n<p>conditions.   Therefore   four   permanent   employees   who   were<\/p>\n<p>subjected to medical check up are doing the necessary handling<\/p>\n<p>work in the palletized store even though most of the work is done<\/p>\n<p>mechanically   by   sophisticated   machines.     The   four   permanent<\/p>\n<p>workers are Babychan, Sabu, Antony Fernadas and Fernadez B.J.<\/p>\n<p id=\"p_3\">      2.     It   is   the   case   of   the   petitioner   that   merely   because<\/p>\n<p>WPC  3942\/2007<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                       : 2 :<\/span><\/p>\n<p>there   are   registered   workers   doing   work   in   the   old   cold   storage<\/p>\n<p>and they are doing the work in the cold storage by rotation, they<\/p>\n<p>cannot claim work in the new palletized store as it will violate the<\/p>\n<p>norms   stipulated   in   the   manual.     If   the   work   is   done   by<\/p>\n<p>mechanical  process,  also   workers  cannot  be   given  nokku   coolie.<\/p>\n<p>In these circumstances,  in the old cold storage whenever  loading<\/p>\n<p>and unloading work is there, petitioner should allow the same to<\/p>\n<p>be done by existing registered workers.   With regard to the four<\/p>\n<p>workers who are working in the palletized store, which is running<\/p>\n<p>as per the exporting agencies control, should be allowed to work<\/p>\n<p>there   without   interference   provided   they   also   apply   for<\/p>\n<p>registration   under   the   act   and   scheme.
