Justice M.SASIDHARAN NAMBIAR\n\n Dated :16\/11\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n               CRL.M.C.NO.3436 OF 2009\n              ------------------------------------------\n\n             Dated      16th      November 2009\n\n\n                           O R D E R\n<\/pre>\n<p id=\"p_1\">            Petitioner         is      the      third     accused   in<\/p>\n<p>C.C.92\/2007 on the file of Chief Judicial Magistrate,<\/p>\n<p>Kasargod now pending as L.P.266\/2007. This petition is<\/p>\n<p>filed under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of Code of Criminal Procedure<\/p>\n<p>to quash the proceedings            as against the petitioner<\/p>\n<p>contending that entire disputes were settled with the<\/p>\n<p>second respondent. Second respondent appeared through<\/p>\n<p>a counsel and filed Annexure-2             affidavit stating that<\/p>\n<p>loss caused to the school was compensated and school<\/p>\n<p>authorities have received all the stolen articles and<\/p>\n<p>there  is  no  subsisting          grievance         as   against the<\/p>\n<p>petitioner and in such circumstances, there is no<\/p>\n<p>objection for quashing the              proceedings. Manager of<\/p>\n<p>the school has filed Annexure-3 affidavit stating that<\/p>\n<p>as loss sustained to the school was compensated, there<\/p>\n<p>is no objection for quashing the proceedings.<\/p>\n<p id=\"p_1\">         2.   Learned         counsel         appearing      for   the<\/p>\n<p>petitioner,  second      respondent           and      learned  Public<\/p>\n<p>Crmc 3436\/09<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              2<\/span><\/p>\n<p>Prosecutor were heard.\n<\/p>\n<p id=\"p_2\">            3.  Annexure-1  final   report  shows   that<\/p>\n<p>prosecution case is that on 5\/11\/2006 at about 9.45<\/p>\n<p>p.m, accused 1 and 2 who are juveniles obtained a motor<\/p>\n<p>bike   from   the  petitioner  on  hire  and  thereafter<\/p>\n<p>proceeded to Sree Bhagavathy Engligh Medium School at<\/p>\n<p>Kanila of Bankara Manjeshwar village and broke opened<\/p>\n<p>the office room and took away the personal computer,<\/p>\n<p>CPU,UPS    and  other    accessories to   the house   of<\/p>\n<p>petitioner    for   hiding  and  also  for  selling  and<\/p>\n<p>petitioner kept the stolen articles for sale with the<\/p>\n<p>knowledge that    they are stolen articles and all the<\/p>\n<p>accused thereby committed   offences under <a href=\"\/doc\/239420\/\" id=\"a_1\">Sections 457<\/a>,<\/p>\n<p><a href=\"\/doc\/1270615\/\" id=\"a_2\">380<\/a>, <a href=\"\/doc\/969817\/\" id=\"a_3\">411<\/a>, <a href=\"\/doc\/1547453\/\" id=\"a_4\">414<\/a> read with <a href=\"\/doc\/37788\/\" id=\"a_5\">Section 34<\/a> of Indian Penal<\/p>\n<p>Code. Juvenile accused 1 and 2 pleaded guilty before<\/p>\n<p>the   Chief   Judicial  Magistrate, Kasargod  and   were<\/p>\n<p>sentenced to fine as provided under Section 15(1)(d) of<\/p>\n<p>Juvenile Justice Act.\n<\/p>\n<p id=\"p_3\">            4.  As is clear from Annexure-1, case as<\/p>\n<p>against the petitioner is that he had given     on hire<\/p>\n<p>his motor bike to accused 1 and 2, who committed   theft<\/p>\n<p>after    breaking open the   office room  of the school<\/p>\n<p>and the stolen articles were taken to the house of the<\/p>\n<p>Crmc 3436\/09<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              3<\/span><\/p>\n<p>petitioner, where he allowed them to be kept    for the<\/p>\n<p>purpose of sale. The affidavit filed by the Headmaster<\/p>\n<p>of the school as well as the Manager of the school<\/p>\n<p>establish that entire   loss sustained by the school was<\/p>\n<p>recouped by the petitioner and the school has received<\/p>\n<p>the stolen articles. It is in such circumstances,<\/p>\n<p>second respondent and Manager of the      school stated<\/p>\n<p>that    there   is  no   objection  for   quashing   the<\/p>\n<p>proceedings.    As  the offences  are  already   settled<\/p>\n<p>between the parties, it is not in the interest of<\/p>\n<p>justice to continue the prosecution, as held by the<\/p>\n<p>Apex court in <a href=\"\/doc\/1442974\/\" id=\"a_6\">Madan Mohan Abbot v. State of Punjab<\/a><\/p>\n<p>(2008 (3) KLT 19 (SC).\n<\/p>\n<pre id=\"pre_1\">            Petition    is     allowed.      C.C.92\/2007\n\n(L.P.266\/2007)    on  the  file  of     Chief   Judicial\n\n<\/pre>\n<p id=\"p_4\">Magistrate, Kasargod   is quashed.
