Justice HARUN-UL-RASHID\n\n Dated :11\/12\/2009\n\n O R D E R\n                      HARUN-UL-RASHID,J.\n                 --------------------------\n                      A.S.NO.505 OF 1997\n                 --------------------------\n            DATED THIS THE 11TH DAY OF DECEMBER, 2009\n\n                             JUDGMENT\n<\/pre>\n<p id=\"p_1\">            Plaintiff in O.S.No.27\/990 on the file of the Sub<\/p>\n<p>Court, Palakkad is the appellant. The suit was filed for partition.<\/p>\n<p>The court below passed a preliminary decree directing partition<\/p>\n<p>of the plaint schedule properties into 10 equal shares and to allot<\/p>\n<p>one out of such shares to the plaintiff and consequential reliefs<\/p>\n<p>are also granted.     The plaintiff claimed     for partition and<\/p>\n<p>separation of his share over the plaint schedule property after<\/p>\n<p>adjusting 3.01 acres of land surrendered as excess land pursuant<\/p>\n<p>to the ceiling proceedings. The trial court declined the prayer of<\/p>\n<p>the plaintiff for consideration of 3.01 acres of excess land while<\/p>\n<p>making division and passed a decree for partition and separate<\/p>\n<p>possession of his share over the plaint schedule properties.<\/p>\n<p>Aggrieved by the findings declining adjustment over 3.01 acres,<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                -2-<\/span><br \/>\nA.S.No.505\/97<\/p>\n<p>this appeal is filed. The parties hereinafter referred to as plaintiff<\/p>\n<p>and defendants as arrayed in the suit.\n<\/p>\n<p id=\"p_1\">            2. The plaint schedule properties originally belonged<\/p>\n<p>to late Chammuni, who is the father           of the plaintiff and<\/p>\n<p>defendants 2 to 9. The lst defendant is the mother of the plaintiff<\/p>\n<p>and other defendants. The property sought to be partitioned is<\/p>\n<p>the property obtained by late Chamunni, as per Ext.A1 partition<\/p>\n<p>deed of the year 1971.       Plaint schedule properties are the A<\/p>\n<p>schedule properties to Ext.A1 partition deed. Chamunni died<\/p>\n<p>intestate on 3\/7\/1988.\n<\/p>\n<p id=\"p_2\">            3.   The contesting defendants did not dispute the<\/p>\n<p>partibility of the plaint schedule properties. They contended inter<\/p>\n<p>alia that there was no joint decision or arrangement for surrender<\/p>\n<p>of excess land out of the properties set apart to the share of the<\/p>\n<p>plaintiff, or to compensate the plaintiff such extent surrendered<\/p>\n<p>and that the entire extent of 3.01 acres of excess land was<\/p>\n<p>surrendered consequent on the order passed by the Taluk Land<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                -3-<\/span><br \/>\nA.S.No.505\/97<\/p>\n<p>Board.\n<\/p>\n<p id=\"p_3\">           4. It is not disputed that during the life time of father,<\/p>\n<p>ceiling proceedings were initiated against the father and the<\/p>\n<p>Taluk Land Board held that late Chamunni is liable to surrender<\/p>\n<p>3.01 acres of land as excess land. The trial court rejected the<\/p>\n<p>contention of the plaintiff that there was an agreement between<\/p>\n<p>the sharers to compensate the area surrendered at the time of<\/p>\n<p>actual division of the father&#8217;s share. The trial court rightly held<\/p>\n<p>that excepting the interested testimony of the plaintiff, there was<\/p>\n<p>no material placed before the court below to accept the said<\/p>\n<p>contention. It is a fact that a portion of the property obtained by<\/p>\n<p>the plaintiff under the partition deed was taken over by the<\/p>\n<p>Government in the ceiling proceedings. The order was passed by<\/p>\n<p>the Taluk Land Board directing surrender of 3.01 acres of land,<\/p>\n<p>since the properties belonged to the father. For the aforesaid<\/p>\n<p>reasons, the prayer of the plaintiff for pro-rata adjustment of 3.01<\/p>\n<p>acres of land for division is declined.\n<\/p>\n<p id=\"p_4\"><span class=\"hidden_text\" id=\"span_2\">                                 -4-<\/span><br \/>\nA.S.No.505\/97<\/p>\n<p id=\"p_5\">            5. The trial court further held that the plaint schedule<\/p>\n<p>properties belonged to the father and the parties to the suit are<\/p>\n<p>entitled to inherit the properties. There is no serious dispute<\/p>\n<p>regarding the quantum of shares. Therefore, a preliminary decree<\/p>\n<p>has been passed for division of the properties into 10 equal shares<\/p>\n<p>and to allot one of such share to the plaintiff.        Admittedly,<\/p>\n<p>defendants 1 to 9, who are also the legal heirs of the deceased<\/p>\n<p>father, are also entitled to inherit and share the property equally.<\/p>\n<p>In the circumstances, I do not find any reason to interfere with<\/p>\n<p>the judgment and decree passed by the court below.              The<\/p>\n<p>contentions raised by the appellant in the said circumstances<\/p>\n<p>cannot stand.\n<\/p>\n<p id=\"p_6\">            In the result, the appeal fails and accordingly<\/p>\n<p>dismissed.
