Respondents in both WPs<\/pre>\n<p id=\"p_1\">Prayer in both WPs<\/p>\n<p>Writ Petition filed under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the<br \/>\nConstitution of India for issuance of a Writ of Mandamus, to direct the<br \/>\nrespondents to deliver the registered sale deed in Document Nos.1341 and 1342 of<br \/>\n2006 dated 29.03.2006 on the file of the first respondent to the petitioner and<br \/>\ngranting such other and further relief.\n<\/p>\n<p id=\"p_1\">!For Petitioner  &#8230; Mr.Jeyaram<br \/>\n^For Respondents &#8230; Mr.D.Sasikumar<br \/>\n\t\t     Government Advocate<\/p>\n<p>:COMMON ORDER\t<\/p>\n<p>\tHeard the learned counsel appearing for the petitioner and also<br \/>\nMr.D.Sasikumar, learned Government Advocate, who took notice on behalf of the<br \/>\nrespondents.\n<\/p>\n<p id=\"p_2\">\t2. The grievance of the petitioner as found set out in the affidavit<br \/>\naccompanying the petition would run thus:\n<\/p>\n<p id=\"p_3\">\tThe petitioner got the sale deed registered as Document Nos.1341 and 1342<br \/>\nof 2006.  However the registering authority withheld the documents on the ground<br \/>\nthat it was not properly stamped.\n<\/p>\n<p id=\"p_4\">\t3. The learned counsel appearing for the petitioner placing reliance on<br \/>\nthe decision of this Court in <a href=\"\/doc\/1259162\/\" id=\"a_1\">B.Rajappa and another v. The Special Deputy<br \/>\nCollector (Stamps), Madras and others<\/a> reported in 2002(3) CTC 544, would develop<br \/>\nhis arguments that irrespective of the action that would be taken by the<br \/>\nauthorities concerned for collection of the deficit stamp duty, they have to<br \/>\nreturn the document.  An excerpt from the said precedent would run thus:\n<\/p>\n<p id=\"p_5\">\t&#8220;While appreciating the anxiety expressed on behalf of the State by the<br \/>\nlearned Advocate General, this Court directs that:-\n<\/p>\n<p id=\"p_6\">\ti) It is open to the Registering Authority to affix a seal, while<br \/>\nreleasing the original deed or conveyance or any other document indicating that<br \/>\na reference is pending under Section 47-A with respect to under-valuation and<br \/>\nassessment of Stamp Duty payable, as and when the proceedings reach finality,<br \/>\nthe same shall be intimated to the person who is liable to pay stamp duty<br \/>\ndemanding payment of deficit Stamp Duty payable on the instrument.\n<\/p>\n<p id=\"p_7\">\tii) The Registrar to make corresponding entries under <a href=\"\/doc\/1725968\/\" id=\"a_2\">Sections 54<\/a>, <a href=\"\/doc\/1387145\/\" id=\"a_3\">55<\/a> of<br \/>\nthe Registration Act, 1908, in the Register of indexes as to pendency of<br \/>\nproceedings under <a href=\"\/doc\/1489134\/\" id=\"a_4\">Section 47-a<\/a>.\n<\/p>\n<p id=\"p_8\">\tiii) On completion of adjudication as to the under-valuation by the<br \/>\ncompetent authority as well as appeal or revision, if any, thereof, and<br \/>\ndepending upon the ultimate decision, the said authorities to recover deficit<br \/>\nstamp duty according to law.\n<\/p>\n<p id=\"p_9\">\tiv) Till such proceeding reaches finality and deficit is paid, there will<br \/>\nbe a charge for the deficit stamp duty, which is the subject matter of transfer<br \/>\nor conveyance.\n<\/p>\n<p id=\"p_10\">\tv) On payment of deficit stamp duty, if any payable, the Registrar may<br \/>\nonce again, on production of the original deed of transfer, make appropriate<br \/>\nentry and recording the additional stamp duty paid and release of charge and<br \/>\nalso make consequential entries in the registers\/indexes maintained under<br \/>\n<a href=\"\/doc\/1725968\/\" id=\"a_5\">Sections 54<\/a>, <a href=\"\/doc\/1387145\/\" id=\"a_6\">55<\/a>, etc., of the <a href=\"\/doc\/1489134\/\" id=\"a_7\">Registration Act<\/a>&#8220;.\n<\/p>\n<p id=\"p_11\">\t4.
