Justice P.N.RAVINDRAN\n\n Dated :12\/10\/2009\n\n O R D E R\n                       P.N.RAVINDRAN, J.\n               ------------------------------------------\n                   W.P.(C)No.28648 of 2009\n                -----------------------------------------\n              Dated this the 12th October, 2009\n\n                            JUDGMENT\n<\/pre>\n<p id=\"p_1\">      Heard Sri.P.Fazil, the learned counsel appearing for the<\/p>\n<p>petitioner and Sri.T.A.Shaji, the learned standing counsel<\/p>\n<p>appearing for the Mahatma Gandhi University.<\/p>\n<p id=\"p_1\">      2.  The petitioner appeared for the fifth semester B.Tech<\/p>\n<p>Degree Examination in Civil Engineering conducted by the<\/p>\n<p>Mahatma Gandhi University in May, 2009. The results were<\/p>\n<p>published in August, 2009. The petitioner again failed in the<\/p>\n<p>paper &#8216;Structural Analysis II&#8217;.       The petitioner has therefore<\/p>\n<p>applied for revaluation and scrutiny of his answer script in the<\/p>\n<p>said paper by submitting Exts.P1 and P3 applications.          It is<\/p>\n<p>stated that the requisite fee has also been paid. The petitioner<\/p>\n<p>submits that he had done well in the examination and that he is<\/p>\n<p>sure to secure a pass if his answer script is revalued. It is stated<\/p>\n<p>that he has been appointed as an Engineer in a private concern<\/p>\n<p>subject to his producing proof of having passed the B.Tech<\/p>\n<p>Degree examination and that unless his answer script is<\/p>\n<p>expeditiously revalued he will be put to serious prejudice. In<\/p>\n<p>W.P.(C)No.28648 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  2<\/span><\/p>\n<p>this writ petition, the petitioner seeks a writ in the nature of<\/p>\n<p>mandamus commanding the respondents to revalue his answer<\/p>\n<p>script and to communicate the result to him expeditiously.<\/p>\n<p id=\"p_2\">      3. Sri.T.A.Shaji, the learned Standing Counsel appearing<\/p>\n<p>for the Mahatma Gandhi University submits that petitioner&#8217;s<\/p>\n<p>answer script cannot be singled out and revalued as it will lead<\/p>\n<p>to loss of confidentiality.    He also submits that as per the<\/p>\n<p>Examination Manual, the University requires 81 clear days from<\/p>\n<p>the date of publication of the results to complete the revaluation<\/p>\n<p>process. He further submits that the petitioner&#8217;s application for<\/p>\n<p>revaluation will be considered and the answer script revalued, if<\/p>\n<p>the application is in order, within the aforesaid period.<\/p>\n<p id=\"p_3\">      4.   The Examination Manual is not a statutory regulation.<\/p>\n<p>It is a Manual prepared by the University for its guidance. The<\/p>\n<p>stipulations in the Examination Manual cannot, in my opinion,<\/p>\n<p>operate to the detriment of students.     A Division Bench of this<\/p>\n<p>Court has in <a href=\"\/doc\/1085668\/\" id=\"a_1\">University of Kerala v. Sandhya P. Pai<\/a> (1991 (1)<\/p>\n<p>KLT 812) held that the University should hurry with application<\/p>\n<p>for revaluation without wasting any time and that unless<\/p>\n<p>applications for revaluation are expeditiously disposed of, it will<\/p>\n<p>W.P.(C)No.28648 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                3<\/span><\/p>\n<p>cause serious prejudice to the student.    I am therefore of the<\/p>\n<p>considered opinion that the University should not wait for the<\/p>\n<p>expiry of 81 clear days from the date of publication of the results<\/p>\n<p>to complete the revaluation process.\n<\/p>\n<p id=\"p_4\">      5.   I accordingly dispose of this writ petition with a<\/p>\n<p>direction to the respondents to complete the revaluation of the<\/p>\n<p>answer script     described   in  Exts.P1 application     and to<\/p>\n<p>communicate the results to the petitioner within six weeks from<\/p>\n<p>the date on which the petitioner produces a certified copy of this<\/p>\n<p>judgment before the Controller of Examinations, Mahatma<\/p>\n<p>Gandhi University.
