The alleged offence is under Section 420 of I.P.C.<\/p>\n<p>According to prosecution, defacto complainant owns a car and<\/p>\n<p>this was given to petitioner on rental basis for a period of 3<\/p>\n<p>months for his personal use. Though the period is over, he did<\/p>\n<p>not return the car and hence, the complaint.<\/p>\n<p>      3. Learned counsel for petitioner submitted that even as<\/p>\n<p>per the allegations in the complaint, petitioner is entitled to<\/p>\n<p>use the car until 10.09.2008. Even though the said period was<\/p>\n<p>over, the defacto complainant did not make any complaint for<\/p>\n<p>more than 3 months. He filed a complaint only on 30.12.2008<\/p>\n<p>and there is no explanation for the long delay. Actually the<\/p>\n<p>defacto complainant owes money to petitioner by virtue of<\/p>\n<p>Annexure B agreement and Rs.1Lakh is to be returned to<\/p>\n<p>petitioner within 27.12.2008. Petitioner demanded the money<\/p>\n<p>back and hence, after 3 days, on 30.12.2008, the complaint is<\/p>\n<p>filed.   It is also submitted that this court had directed<\/p>\n<p>B.A.No.151 of 2009<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>petitioner to make himself available for interrogation by the<\/p>\n<p>investigating officer to explain petitioner&#8217;s innocence and he<\/p>\n<p>had reported before the investigating officer on 21.01.2009<\/p>\n<p>but, he was not questioned by the investigating officer and he<\/p>\n<p>was let off. Though the case was posted from 27.01.2009<\/p>\n<p>onwards, there is no instruction from the police to the learned<\/p>\n<p>Public Prosecutor. Hence, anticipatory bail may be granted, it<\/p>\n<p>is submitted.\n<\/p>\n<p>       4. Learned Public Prosecutor submitted that so far, no<\/p>\n<p>instruction is received and he prays for time.<\/p>\n<p>       On hearing both sides, I do not find that any further time<\/p>\n<p>need to be granted for getting instructions. I am satisfied that<\/p>\n<p>it is a fit case to grant anticipatory bail.<\/p>\n<p>       Hence, the following order is passed :<\/p>\n<blockquote><p>            Petitioner shall surrender before the Magistrate<\/p>\n<p>            court concerned within seven days from today<\/p>\n<p>            and he shall be released on bail on his executing<\/p>\n<p>            bond for Rs.25,000\/- with two solvent sureties<\/p>\n<p>            each for like sum to the satisfaction of the<\/p>\n<p>            learned Magistrate on the following conditions :<\/p>\n<\/blockquote>\n<p>B.A.No.151 of 2009<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>             i) Petitioner    shall    report   before   the<\/p>\n<p>                 Investigating Officer as and when directed.<\/p>\n<p>             ii) Petitioner shall not influence or intimidate<\/p>\n<p>                 any witness or commit any offence while<\/p>\n<p>                 on bail.\n<\/p>\n<p>       The petition is allowed.\n<\/p>\n<\/p>\n<p>                                    K.HEMA, JUDGE<\/p>\n<p>pac<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sajeev @ Thampan vs State Of Kerala on 10 February, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 151 of 2009() 1.
