Hemani, learned advocate for the applicant has submitted that<br \/>\n\tthis Court has, vide order dated 21.12.2009 passed in Special Civil<br \/>\n\tApplication No.8828 of 2009, permitted the assessment proceedings to<br \/>\n\tbe continued but has directed that the final order will not be<br \/>\n\tcommunicated to the petitioner till the final disposal of the<br \/>\n\tpetition.  It is submitted that in the circumstances, it was not<br \/>\n\tpermissible for the respondent to initiate proceedings under <a href=\"\/doc\/789969\/\" id=\"a_1\">section<br \/>\n\t271(1)(c)<\/a> of the Act.\n<\/p>\n<p id=\"p_2\">This<br \/>\n\tCourt has also heard Mr.M.R.Bhatt, learned Senior Advocate appearing<br \/>\n\ton behalf of the respondent.\n<\/p>\n<p id=\"p_3\">The<br \/>\n\trecord of the case indicates that vide order dated 30.9.2009, this<br \/>\n\tCourt had adjourned the matter to 02.11.2009 and had granted interim<br \/>\n\trelief to the effect that in the meantime, the assessment<br \/>\n\tproceedings may be continued, but the final order will not be<br \/>\n\tcommunicated to the petitioner till the next date.  The said interim<br \/>\n\trelief was continued from time to time and came to be confirmed vide<br \/>\n\torder dated 21.12.2009.\n<\/p>\n<p id=\"p_4\">\tDespite<br \/>\n\tthe aforesaid position, the respondent has vide notice dated<br \/>\n\t02.02.2011 initiated proceedings under <a href=\"\/doc\/1553945\/\" id=\"a_2\">section 274<\/a> read with <a href=\"\/doc\/789969\/\" id=\"a_3\">section<br \/>\n\t271(1)(c)<\/a> of the Act.  On a plain reading of the said notice, it is<br \/>\n\tapparent that the respondent is well aware of the order passed by<br \/>\n\tthis Court directing the Department not to serve the final order of<br \/>\n\treopened assessment for assessment year 2003-04.  However, on the<br \/>\n\tspecious plea that as per the information available with the said<br \/>\n\toffice, no condition has been laid down by this Court in respect of<br \/>\n\tinitiation and completion of penalty proceedings, the respondent has<br \/>\n\tinitiated the said proceedings.\n<\/p>\n<p id=\"p_5\">Once,<br \/>\n\tthe Court had restrained the respondent from communicating the final<br \/>\n\tassessment order to the petitioner, it was not permissible for the<br \/>\n\trespondent to initiate proceedings under <a href=\"\/doc\/1553945\/\" id=\"a_4\">section 274<\/a> read with<br \/>\n\t<a href=\"\/doc\/789969\/\" id=\"a_5\">section 271(1)(c)<\/a> of the Act in connection with the said assessment<br \/>\n\torder.  In the circumstances, the proceedings initiated by issuance<br \/>\n\tof notice dated 02.02.2011 are required to be stayed.\n<\/p>\n<p id=\"p_6\">It<br \/>\n\tappears that the penalty proceedings may have been initiated by the<br \/>\n\trespondent on the apprehension that the proceedings may become<br \/>\n\tbarred by limitation.  However, since the respondent has been<br \/>\n\trestrained from communicating the final assessment order to the<br \/>\n\tpetitioner, the bar of limitation would not come in the way of the<br \/>\n\trespondent in case the petitioner does not succeed in the petition.\n<\/p>\n<p id=\"p_7\">In<br \/>\n\tthe light of the aforesaid discussion, the application is allowed.<br \/>\n\tPending the final hearing of Special Civil Application No.8828 of<br \/>\n\t2009, the operation and implementation of the impugned notice dated<br \/>\n\t02.02.2011 issued under <a href=\"\/doc\/1553945\/\" id=\"a_6\">section 274<\/a> read with <a href=\"\/doc\/789969\/\" id=\"a_7\">section 271(1)(c)<\/a> of<br \/>\n\tthe Act by the respondent at Annexure &#8220;C&#8221;
