(J)\n\nCITATION:\n 1995 AIR   63\t\t  1994 SCC  (6) 259\n JT 1994 (6)   267\t  1994 SCALE  (4)268\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t   ORDER\n<\/p>\n<p>1.Having heard the learned counsel for the petitioner and<br \/>\nthe   learned\tAdditional   Solicitor\t General   for\t the<br \/>\nrespondents,  we  are of the opinion that  the\tquestion  of<br \/>\napplicability  of the scheme in Unni Krishnan, J.P v.  State<br \/>\nof   A.P1   to\tthe  petitioner-College\t  requires   further<br \/>\nconsideration  for which purpose we are posting the  special<br \/>\nleave  petitions  for final hearing in\tNovember  1994.\t  We<br \/>\ndirect that pending further orders status quo shall continue<br \/>\nfor the current year, i.e., 1994-95.\n<\/p>\n<p>2.It  is, however, directed that the College shall  admit<br \/>\nstudents  strictly  in the order of merit from\tamong  those<br \/>\napplying to it for admission.  The merit shall be determined<br \/>\nonly  and exclusively on the basis of marks obtained in\t the<br \/>\nqualifying examination.\t This obligation, in our opinion, is<br \/>\ninherent in the permission for establishment granted by\t the<br \/>\nBar  Council  of India and the affiliation  granted  by\t the<br \/>\nuniversity.  The very fact that the university is  admitting<br \/>\nthis  College, a private body, to its privileges means\tthat<br \/>\nthe  private  body  must subject itself\t to  the  discipline<br \/>\ninherent in such affiliation.  It is unreasonable to presume<br \/>\nthat fairness is not inherent in the grant of permission  to<br \/>\nestablish  and more so in the grant of affiliation.   Hence,<br \/>\nthe above direction .\n<\/p>\n<p>3.The petitioner-College shall prepare a list of  candidates<br \/>\napplying  to it for admission along with the marks  obtained<br \/>\nby them in the qualifying<br \/>\n+  From the Judgment and Order dated 3-8-1994 of the  Madras<br \/>\nHigh Court in W.P. Nos. 10670, 10707 and 10714 of 1994<br \/>\n1 (1993) 1 SCC 645<br \/>\n<span class=\"hidden_text\">260<\/span><br \/>\nexamination as well as a list of the candidates selected  by<br \/>\nit  for admission along with the marks obtained by  them  in<br \/>\nthe  qualifying examination.  Both the said lists  shall  be<br \/>\nsubmitted  within  ten\tdays  of  the  finalisation  of\t the<br \/>\nadmissions  to\tthe  Bar Council of  India,  to\t the  Madras<br \/>\nUniversity  and\t to the Government of Madras.  It  shall  be<br \/>\nopen  to these authorities to verify the correctness of\t the<br \/>\nsaid list and if they find that there has been any departure<br \/>\nfrom the direction imposed hereinabove, it shall be open  to<br \/>\nany of them to bring the same to the notice of this Court.\n<\/p>\n<p>4.   Liberty to mention.\n<\/p>\n<p>5.
