Ramachandran, J.\n<\/p>\n<p id=\"p_1\">1. In response to a paper notification inviting tenders<br \/>\nfor purchase of a vehicle, issued by the 4th<br \/>\nrespondent-M\/s. Tata Finance Limited&#8211;the petitioner had<br \/>\nsubmitted his tender for purchase of a Tata Sumo vehicle<br \/>\nfor a sum of Rs. 1,61,000\/-. It had been accepted and the<br \/>\nvehicle had been allotted to the petitioner. But<br \/>\ndelivery was not given to him, since the registration<br \/>\nnumber allotted to the vehicle as KL-11\/G.3767 had been<br \/>\ndeclared as obtained by forgery, by the Chief Judicial<br \/>\nMagistrate Court, Kozhikode. The application filed by<br \/>\nthe petitioner for registration of the vehicle in his<br \/>\nfavour, cancelling the original registration, was refused<br \/>\nby the Motor Vehicles Inspector, Ottappalam for<br \/>\nnon-compliance of Rule 47 of the Central Motor Vehicles<br \/>\nRules, 1989. The application should have accompanied by<br \/>\nan application for registration in Form No. 20, sale<br \/>\ncertificate in Form No. 21, valid insurance certificate,<br \/>\nroad worthiness certificate in Form No. 22 and a number of<br \/>\ndocuments. The Sale Certificate produced by the<br \/>\npetitioner showed the sale in favour of Sri. V.P. Abdul<br \/>\nAzeez, S\/o. Imbichi Mohammed, Kunnoth House, Villiappally.P.O., Vadakara. The Chassis number of the<br \/>\nvehicle is 385 013 KSQ 945671 and Engine number of 483 DL<br \/>\n41 KSQ 8120137. The application was rejected by the<br \/>\nMotor Vehicle Inspector, Ottappalam on the following<br \/>\nreasons:\n<\/p>\n<p id=\"p_2\">  &#8220;The prime important document necessary for<br \/>\nregistration of a vehicle is sale letter<br \/>\nreceived from the dealer who delivered this<br \/>\nvehicle (under Rule 47 of CMV Rules, 1989).<br \/>\nProduced sale letter is the copy of the sale<br \/>\nletter issued to Sri. V.P. Abdul Azeez on 4-12-97<br \/>\nwith finance by M\/s. Tata Finance Ltd.,<br \/>\nCherootty Road, Calicut. With this sale letter<br \/>\nthis vehicle cannot register in your name as<br \/>\nyou applied in Form 20.\n<\/p>\n<p id=\"p_3\"> As per the order of the Chief Judicial<br \/>\nMagistrate, Kozhikode, vide No. CMP 212\/2001,<br \/>\nM\/s. Tata Finance permitted to sell the vehicle<br \/>\nin question for maximum attractive price. But<br \/>\nthere is no evidence for sale of this vehicle<br \/>\nto this applicant by M\/s. Tata Finance Ltd. to<br \/>\neffect a registration under Rule 47 of CMV Rules or<br \/>\nprovisions of Rule 57 of CMV Rules.\n<\/p>\n<p id=\"p_4\"> Hence your application is refused for<br \/>\nnon-compliance of Rule 47 of CMV Rules 1989,<br \/>\nand directed to resubmit the application<br \/>\ncomplying requirements contemplated by the<br \/>\nabove Rule.&#8221;\n<\/p>\n<p id=\"p_5\"> Though it might have been possible for the petitioner to<br \/>\ntake up the matter in appeal, in view of the intrinsic<br \/>\ndifficult circumstances involved he has opted to file<br \/>\nthis Original Petition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the<br \/>\nConstitution of India. From the averments in the<br \/>\nOriginal Petition as also the counter affidavit filed by<br \/>\nthe 4th respondent the following facts have come to<br \/>\nlight.\n<\/p>\n<p id=\"p_6\"> 2. Sri. V.P. Abdul Azeez, showing his address<br \/>\nas Vattamparakkal House, Chooramvayal.P.O., Kunnamangalam<br \/>\nhad approached the 4th respondent for getting hire<br \/>\npurchase facility for purchase of one Tata Sum Delux<br \/>\nvehicle and he had remitted the initial amount. The<br \/>\ndealer of the vehicle is M\/s. Sakthi Automobiles. A<br \/>\nproforma invoice had been issued by the dealer in favour<br \/>\nof M\/s. Tata Finance on 26-11-1997. The dealer delivered<br \/>\nthe vehicle to Mr. Abdul Azeez. The invoice showed Tata<br \/>\nFinance as the purchaser and Sr. Azeez as the hirer. A<br \/>\ntemporary registration certificate was given to Mr. Azeez<br \/>\nby the registering authority. Thereafter, evidently<br \/>\nSri. Azeez had played foul and apparently using forged<br \/>\nprinted invoice he had got the vehicle registered in his<br \/>\naddress shown as Kunnoth House, Villiappally, Vadagara<br \/>\nwithout entering the name of the hire purchaser. He<br \/>\nobtained a registration for the vehicle from the Regional<br \/>\nTransport Authority, Vadakara and got the vehicle<br \/>\nregistered as KL-11\/G.3767.\n<\/p>\n<p id=\"p_7\"> 3. One Mohammed Sadath, S\/o. Mammoo Haji had<br \/>\nthereafter purchased the vehicle from Sri. Azeez and such<br \/>\ntransfer had been got endorsed in the Registration<br \/>\nCertificate. He had entered not a hire purchase<br \/>\nagreement with another financier. For servicing the<br \/>\nvehicle, it had been entrusted with M\/s. Sakthi<br \/>\nAutomobiles. By that time all were alerted about the<br \/>\nnefarious transactions at the hands of Sri. Azeez.<br \/>\nFinding that the vehicle had come to them Sakthi<br \/>\nAutomobiles refused to part with it. Mr. Mohammed Sadath<br \/>\nhad therefore approached the criminal court for release<br \/>\nof the vehicle and the 4th respondent also had filed an<br \/>\napplication for similar relief. By a common order<br \/>\n(Ext. P1) by the Chief Judicial Magistrate, Kozhikode<br \/>\nfinding that there was fraud played by Azeez, including<br \/>\nforgery, the vehicle was directed to be handed over to<br \/>\nthe owner as per the original records viz., M\/s. Tata<br \/>\nFinance.\n<\/p>\n<p id=\"p_8\"> 4. It appears that the crime registered<br \/>\nultimately was referred on the ground of mistake of facts<br \/>\nand the proceedings had come to a close before the Chief<br \/>\nJudicial Magistrate. We are not expected to go to such<br \/>\ndetails, though a day light robbery has gone unnoticed.<br \/>\nThereafter, on 27-09-2001, on an application filed by<br \/>\nM\/s. Tata Finance, the Chief Judicial Magistrate had<br \/>\npermitted the Tata Finance to sell the vehicle in<br \/>\nquestion. It was on the above basis that the paper<br \/>\nnotification had come and the petitioner became remitted<br \/>\nthe money towards purchase price.\n<\/p>\n<p id=\"p_9\"> 5. As pointed out earlier, his efforts to<br \/>\nget the vehicle registered in his name has not met with<br \/>\nany success, since the rules prescribes that an<br \/>\napplication for registration has to be filed by the<br \/>\npurchaser. Since as per the original records Sri. Azeez<br \/>\nis recorded as the purchaser and no application has come<br \/>\nfrom him for registration of the vehicle, the petitioner<br \/>\nhas come to face with difficulties as come out from<br \/>\nExt.P7.\n<\/p>\n<p id=\"p_10\"> 6. Of course, the respondents might be<br \/>\njustified in insisting that under Rule 47 of the Central<br \/>\nMotor Vehicles Rules sale certificate has to come from<br \/>\nthe purchaser. But it is highly improbable that after<br \/>\nthe nefarious transactions Mr. Azeez may come up owning<br \/>\nthe transaction. He stands to lose nothing. The impasse<br \/>\nhas to be solved at some point of time.\n<\/p>\n<p id=\"p_11\"> 7. Even though Mr. Azeez had been described<br \/>\nas the purchaser, Ext.R4 series indicate that legally<br \/>\nTata Finance was always the owner of the vehicle that had<br \/>\nbeen delivered in the name of Azeez. The existence of<br \/>\nthe hire purchase agreement as between Abdul Azeez and<br \/>\nTata Finance is undisputed and in the light of Exts.P1<br \/>\nand P2 orders of the Chief Judicial Magistrate, this<br \/>\nposition stands confirmed. Therefore, it has to be<br \/>\npresumed that Sakthi Automobiles although had delivered<br \/>\nthe vehicle in the name of Sri. V.P. Abdul Azeez, it was in<br \/>\nfact sold to Tata Finance Limited alone (see Ext.R4 (c)<br \/>\ninvoice-cum-delivery receipt. Tata Finance Limited is<br \/>\ndeemed as the owner of the vehicle and permission alone<br \/>\nis there given to Azeez to hire the vehicle. That he<br \/>\nmade certain transactions, will not in any way militate<br \/>\nagainst the possession and ownership of Tata Finance<br \/>\nabout the vehicle in question. They had expended the<br \/>\nmoney. When there is a definite finding that the<br \/>\nregistration had been obtained showing a fake address and<br \/>\nshowing fake sale letter and it has been declared as a<br \/>\nresult of fraud, it necessarily follows that the<br \/>\nconnected proceedings were null and void. It should<br \/>\ntherefore be presumed that the vehicle had never been<br \/>\nregistered validly, as already held by the Chief Judicial<br \/>\nMagistrate.\n<\/p>\n<p id=\"p_12\"> 8. If we go on technicalities, the result<br \/>\nwill be that even the order of the Chief Judicial<br \/>\nMagistrate, in valid proceedings, are rendered<br \/>\nineffective. This cannot also be permitted. Therefore<br \/>\nit has to be adjudged that the Tata Finance were always<br \/>\nthe owner of the vehicle concerned and since they have<br \/>\nsold it in favour of the petitioner, on the authorization<br \/>\nof Ext.P2 order, this has to be treated as a valid sale<br \/>\nof a movable article. If the petitioner produces the<br \/>\nsale letter issued by the Tata Finance in his favour and<br \/>\nproduces Ext.R4(c) and other certificates required under<br \/>\nRule 47 of the Central Motor Vehicles Rules, I direct<br \/>\nthat the vehicle is to be registered in his name.<br \/>\nUnfortunately the notice issued to Sakthi Automobiles had<br \/>\nbeen returned unserved, but since I am relying on Ext.R4\n<\/p>\n<p id=\"p_13\">(c), which shows the sale in favour of the Tata Finance<br \/>\nLimited, they have to be treated as purchasers and their<br \/>\nsale to the petitioner as per the directions of the Chief<br \/>\nJudicial Magistrate has to be held as valid and<br \/>\nsufficient for the purchase of registration as required by<br \/>\nRule 47 (a) and (d) of the Rules.\n<\/p>\n<p id=\"p_14\"> 9.
