M. SAHAI)<\/a><\/p>\n<p>1.\t\tWe<br \/>\nhave heard Ms. Mamta R Vyas, learned counsel appearing for the<br \/>\nappellant.  This Letters Patent Appeal has been filed<br \/>\nby the appellant challenging the judgment dated 29.7.2010 passed by<br \/>\nthe learned  Single Judge in Special Civil Application No.8251 of<br \/>\n2001 by which the learned Single Judge has partly allowed the writ<br \/>\npetition and set aside the award passed by the Labour Court, Junagadh<br \/>\nin Reference (LCJ) No.15\/1996 dated 19.8.2000 so far as the back<br \/>\nwages are concerned and reinstatement with continuity of service has<br \/>\nbeen confirmed.\n<\/p>\n<p>2.\t\tThe<br \/>\nfacts in brief are that the appellant was appointed as Rojamdar<br \/>\nWatchman by the respondent department on a particular project.  He<br \/>\nhad worked for the period from 1985 to 1993 and thereafter, his<br \/>\nservices were terminated. The appellant raised industrial dispute and<br \/>\nthe Labour Court allowed the claim of the appellant and directed<br \/>\nreinstatement with full back wages.  Against the said award, the<br \/>\nrespondents filed writ petition before the learned Single Judge which<br \/>\nwas partly allowed and the award of the Labour Court was modified to<br \/>\nthe extent that grant of full back wages was quashed and rest of the<br \/>\naward was confirmed.  The appellant has filed this appeal on the<br \/>\nground that the appellant was entitled to back wages as evidence was<br \/>\nled before the Labour Court that the appellant was not gainfully<br \/>\nemployed during the period.\n<\/p>\n<p>3.\t\tWe<br \/>\nare at a loss to understand how the workman or  his family could<br \/>\nsurvive without any employment or income.  However, the Apex Court in<br \/>\nseries of decisions has held that on reinstatement, back wages cannot<br \/>\nbe automatically granted and it is the discretion of the Court to<br \/>\ngrant back wages.  The Apex Court in a decision<br \/>\nin <a href=\"\/doc\/1415650\/\">Chairman-cum-Managing Director, Coal<br \/>\nIndia Ltd and Others  v. Ananta Saha &amp;  Others<\/a> 2011 (4) SCALE 398<br \/>\nheld in<br \/>\npara 47 as under:\n<\/p>\n<p>&#8220;The<br \/>\nissue of entitlement of back wages has been considered by this court<br \/>\ntime and again and consistently held that even after punishment<br \/>\nimposed upon the employee is quashed by the court or tribunal, the<br \/>\npayment of back wages still remains discretionary.  Power to grant<br \/>\nback wages is to be exercised by the court\/tribunal keeping in view<br \/>\nthe facts in their entirety as no strait-jacket formula can be<br \/>\nevolved, nor a rule of universal application can be laid for such<br \/>\ncases. Even if the delinquent is reinstated, it would not<br \/>\nautomatically make him entitled for back wages as entitlement to get<br \/>\nback wages is independent of reinstatement&#8230;.&#8221;\n<\/p>\n<p>4.\t\tThe<br \/>\nlearned Single Judge, in his judgment held in  paragraphs 4 and 5 as<br \/>\nunder:\n<\/p>\n<p>&#8220;However,<br \/>\nso far as the question of back wages is concerned, the Court below<br \/>\nhas not given any cogent reasons for awarding back wages to the<br \/>\nworkman. In view of the principle laid down by the Apex Court in the<br \/>\ncase of <a href=\"\/doc\/800069\/\">Ram Ashrey Singh v. Ram Bux Singh,<\/a> (2003) II L.L.J.<br \/>\nPg.176, a workman has no automatic entitlement to back wages<br \/>\nsince it is discretionary and has to be dealt with in accordance with<br \/>\nthe facts and circumstances of each case. Similar principle has been<br \/>\nlaid down by the Apex Court in the case of <a href=\"\/doc\/1628125\/\">General Manager,<br \/>\nHaryana Roadways v. Rudhan Singh,<br \/>\nJ.T.<\/a> 2005 (6) S.C.,pg. 137, [2005 (5) S.C.C., pg.591],<br \/>\nwherein, it has been held that an order for payment of back wages<br \/>\nshould not be passed in a mechanical manner but, a host of factors<br \/>\nare to be taken into consideration before passing any such order.\n<\/p>\n<p>5.<br \/>\nIt would also be relevant to refer to a decision of the Apex Court in<br \/>\nthe case of <a href=\"\/doc\/309814\/\">A.P. State Road Transport &amp; Ors., v. Abdul Kareem,<\/a><br \/>\n(2005) 6 S.C.C. pg.36, wherein it has been held that a workman is<br \/>\nnot entitled to any consequential relief on reinstatement as a matter<br \/>\nof course unless specifically directed by forum granting<br \/>\nreinstatement. Looking to the facts of the case and the principle<br \/>\nlaid down by the Apex Court in the above decisions, I am of the<br \/>\nopinion that the respondent-workman cannot be said to be entitled for<br \/>\nany back wages. Hence, the impugned award grating back wages deserves<br \/>\nto be quashed and set aside. in <a href=\"\/doc\/800069\/\">Ram Ashrey Singh v. Ram Bux Singh,<\/a><br \/>\n2003 II L.L.J. 176, in <a href=\"\/doc\/1628125\/\">General Manager, Haryana Roadways v. Rudhan<br \/>\nSingh J.T.<\/a> 2005 (6) SC 137 [2005 (5) SCC 591] and in <a href=\"\/doc\/309814\/\">A.P.<br \/>\nState Road Transport &amp; Ors. v. Abdul Kareem,<\/a> (2005) 6  SCC 36<br \/>\nwherein  it has been held that a workman is not entitled to any<br \/>\nconsequential relief on reinstatement as a matter of course unless<br \/>\nspecifically directed by forum granting reinstatement. Looking to the<br \/>\nfacts of the case and the principle laid down by the Apex Court in<br \/>\nthe above decisions, I am of the opinion that the respondent-workman<br \/>\ncannot be said to be entitled for any back wages.  Hence, the<br \/>\nimpugned award granting back wages deserves to be quashed and set<br \/>\naside.&#8221;\n<\/p>\n<p><a href=\"\/doc\/20530\/\">In<br \/>\nSenior Superintendent Telegraph (Traffic), Bhopal v. Santosh Kumar<br \/>\nSeal and Others<\/a> (2010 6 SCC 773, the Apex Court in para 9 to 11<br \/>\nheld as under:\n<\/p>\n<p>&#8220;9.\n<\/p>\n<p> In the last few years it has been consistently held by this court<br \/>\nthat relief by way of reinstatement with back ages is not automatic<br \/>\neven if termination of an employee is found to be illegal or is in<br \/>\ncontravention of the prescribed procedure and that monetary<br \/>\ncompensation in lieu of reinstatement and back wages in cases of such<br \/>\nnature may be appropriate (see <a href=\"\/doc\/1102187\/\">U.P.State Brassware Corpn. Ltd. v.<br \/>\nUday Narain Pandey, Uttaranchal Forest Development Corporation<\/a> v.<br \/>\n<a href=\"\/doc\/432037\/\">M.C. Joshi, Statet of M.P. v. Lalit Kumar Verma, M.P.Admn.<\/a> v.<br \/>\n<a href=\"\/doc\/1708604\/\">Tribhuvan, Sita Ram v. Moti Lal Nehru Farmers Training Institute,<br \/>\nJaipur Development<\/a> authority v. Ramsahai, GDA  v <a href=\"\/doc\/932266\/\">Ashok Kumar and<br \/>\nMahboob Depak v.  Nagar Panchayat, Gajraula).<\/a>\n<\/p>\n<p>10.<br \/>\n In a recent judgment authored by one of us (R.M. Lodha, J.) in<br \/>\n<a href=\"\/doc\/829834\/\">Jagbir Singh v. Haryana State Agriculture Mktg.Board, the<\/a> aforesaid<br \/>\ndecisions were noticed and it was stated: (SCC pp.330 &amp; 335,<br \/>\nparas 7 &amp; 14)<\/p>\n<p>&#8220;7.\n<\/p>\n<p>\tIt is true that the earlier view of this Court articulated in many<br \/>\ndecisions reflected the legal position that if the termination of an<br \/>\nemployee was found to be illegal, the relief of reinstatement with<br \/>\nfull back wages would ordinarily follow. However, in recent past,<br \/>\nthere has been a shift in the legal position and in a long line of<br \/>\ncases, this Court has consistently taken the view that relief by way<br \/>\nof reinstatement with back wages is not automatic and may be wholly<br \/>\ninappropriate in a given fact situation even though the termination<br \/>\nof an employee is in contravention of the prescribed  procedure.<br \/>\nCompensation instead of reinstatement has been held to meet the ends<br \/>\nof justice.\n<\/p>\n<p>14.<br \/>\n\t It would be, thus, seen that by a catena of decisions in recent<br \/>\ntime, this court has clearly laid down that an order of retrenchment<br \/>\npassed in violation of section 25-F although may be set aside but an<br \/>\naward of reinstatement should not, however, be automatically passed.<br \/>\nThe award of reinstatement with full back wages in a case where the<br \/>\nworkman has completed 240 days of work in a year preceding the date<br \/>\nof termination, particularly, daily wagers has not been found to be<br \/>\nproper by this court and instead compensation has been awarded. This<br \/>\ncourt has distinguished between a daily wager who does not hold a<br \/>\npost and a permanent employee.&#8221;\n<\/p>\n<p>11.<br \/>\n In view of the aforesaid legal position and the fact that the<br \/>\nworkmen were engaged as daily wagers about 25 years back and they<br \/>\nworked hardly for 2 or 3 years, relief of reinstatement and back<br \/>\nwages to them cannot be said to be justified and instead monetary<br \/>\ncompensation would subserve the ends of justice. In our considered<br \/>\nview, the compensation of Rs.40,000 to each of the workmen<br \/>\n(respondents 1 to 14) shall meet the ends of justice.  We order<br \/>\naccordingly. Such payment shall be made with 6 weeks from today,<br \/>\nfailing which the same shall carry interest at the rate of 9% per<br \/>\nannum.&#8221;\n<\/p>\n<p>5.\t\tFrom<br \/>\nthe aforesaid decisions it is clear that the appellant was not<br \/>\nentitled to back wages even though relief of reinstatement has been<br \/>\ngranted to him.  At the most, the appellant could have claimed for<br \/>\ncompensation but such claim was not raised by the<br \/>\nrespondent\/appellant before the learned Single Judge. Therefore, in<br \/>\nappeal we cannot grant a relief which was not claimed  before the<br \/>\nlearned Single Judge by the respondent to the writ petition.\n<\/p>\n<p>6.\t\tFor the<br \/>\naforesaid reasons, this appeal is devoid of merit and fails and is<br \/>\naccordingly dismissed.\n<\/p>\n<p>\t\t\t\t\t\t\t\t[V<br \/>\n M SAHAI, J.]<\/p>\n<p>\t\t\t\t\t\t\t\t[G<br \/>\nB  SHAH, J.]<\/p>\n<p>msp<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Bhojabhai vs State on 2 May, 2011 Author: V.
