JAGANNADHA RAO\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\tTHE 1ST DAY OF AUGUST, 1997<br \/>\nPresent:\n<\/p>\n<p id=\"p_1\">\t    Hon&#8217;ble Mrs.Justice Sujata V.Manohar<br \/>\n\t    Hon&#8217;ble mr.Justice M.Jagannadha Rao<br \/>\nK.S.Bhati, M.K.Singh, Advs. for the appellant<br \/>\nRajendra Singhvi and A.K.Singh, Advs for the Respondent<br \/>\n\t\t\t O R D E R<br \/>\n     The following Order of the Court was delivered:<br \/>\n\t\t\t O R D E R<br \/>\nLeave granted.\n<\/p>\n<p id=\"p_2\">     Heard both\t sides.\t  In the  Advertisement No.1 of 1992<br \/>\nwhich  was   issued  on\t  9.6.92  it  was  stated  that\t the<br \/>\napplication form must reach the office of the Zila Parishad,<br \/>\nDungarpur latest  by 5.00  p.m. on  29.6.92.  The prescribed<br \/>\nqualifications of  B.S.T.C. or its equivalent, recognised by<br \/>\nthe State  Government.\t The last paragraph of advertisement<br \/>\nstated that  no certificates\/marks-sheet  will\tbe  accepted<br \/>\nafter the receipt of application forms in the office.\n<\/p>\n<p id=\"p_3\">     The respondent  did not possess the requisite technical<br \/>\nqualification  on  29.6.92  which  was\tthe  last  date\t for<br \/>\nsubmitting application.\t  He  had  appeared  for  the  B.Ed.<br \/>\nexamination but\t the results  were not\tdeclared on 29.6.97.<br \/>\nThe results  were declared  only on  6.8.92.  The interviews<br \/>\nfor the\t advertised posts  were held  from 1st of September,<br \/>\n1992 onwards.\n<\/p>\n<p id=\"p_4\">     The respondent was not called for an interview since on<br \/>\nthe date  of the  receipt of  his application,\the  did\t not<br \/>\npossess any  technical qualification.\tOn 1.9.92 he filed a<br \/>\nwrit petition in the High Court of Rajasthan and obtained an<br \/>\ninterim order  requiring the  appellant to  call him  for an<br \/>\ninterview.  Pursuant   to  this\t  interim  order,   he\t was<br \/>\ninterviewed and\t thereafter, on\t the basis of the directions<br \/>\nwhich the  respondent obtained\tfrom the  High Court, he was<br \/>\nincluded in  the  list\tof  selected  candidates.    He\t was<br \/>\nappointed thereafter  on a  provisional basis subject to the<br \/>\noutcome\t       of\t  this\t      writ\t   petition.\n<\/p>\n<p id=\"p_5\">According tot he respondent he has now been confirmed.\n<\/p>\n<p id=\"p_6\">     The writ  petition was  dismissed by  a Single Judge of<br \/>\nthe High Court by this order dated 17.7.95, holding that the<br \/>\ncut-off\t date\tfor  ascertaining  the\teligibility  of\t the<br \/>\nrespondent under  the said  advertisement was  the last date<br \/>\nprescribed for\tsubmission of  the application i.e. 29.6.92.<br \/>\nOn 5.2.96  the services of the respondent were discontinued.<br \/>\nThe respondent\tfiled an appeal before the Division Bench of<br \/>\nthe High  Court which  has been allowed.  The present appeal<br \/>\nis from the decision of the Division Bench.\n<\/p>\n<p id=\"p_7\">     Looking to\t the clear  terms of the advertisement which<br \/>\nwe have\t referred to  above, the respondent was not eligible<br \/>\nfor consideration.  It is submitted by the respondent before<br \/>\nus that\t since he  has\tbeen  continued\t and  has  now\tbeen<br \/>\nconfirmed we  should not  disturb his  appointment.   He has<br \/>\nrequested   that    his\t  case\t  should    be\t  considered<br \/>\nsympathetically.    The\t fact,\thowever,  remains  that\t the<br \/>\nappellants have\t taken the  correct  stand  right  from\t the<br \/>\nbeginning.   The respondent&#8217;s application was not considered<br \/>\nand he\twas not\t called for an interview.  It was on account<br \/>\nof interim orders which were obtained by the respondent that<br \/>\nhe was\tgiven appointment  and continued.  He was aware that<br \/>\nhis appointment\t was subject to the outcome of his petition.<br \/>\nOne cannot,  therefore, take  too sympathetic  a view of the<br \/>\nsituation in  which the\t respondent find himself.  A cut-off<br \/>\ndate   by   which   all\t  the\trequirements   relating\t  to<br \/>\nqualifications have  to be  met, cannot\t be  ignored  in  an<br \/>\nindividual case.   There may be other persons who would have<br \/>\napplied\t had   they  known   that  the\t date  of  acquiring<br \/>\nqualifications was  flexible.\tThey may  not  have  applied<br \/>\nbecause they did not possesss the requisite qualification on<br \/>\nthe prescribed date.  Relaxing he prescribed requirements in<br \/>\nthe case  of one  individual may, therefore, cause injustice<br \/>\nto others.\n<\/p>\n<p id=\"p_8\">     In the  premises, the  respondent was  not eligible for<br \/>\nconsideration.\t We, therefore, allows the appeal, set aside<br \/>\nthe impugned  order of\tthe High  Court and dismiss the writ<br \/>\npetition filed\tby the\trespondent.
