2. For thesake of”eonVe,riience parties are referred to<\/p>\n

3.  facts _ of .the.ll-ease are:\n<\/p>\n

dr.i\\{ing*  sumo car bearing registration No.<\/p>\n
‘C AKEi\u00a505\u00a5.liil:\u00a7'”)!9418 on Bangalore – Kanakapura road, near<\/p>\n
Somfgdiahally KPTCL from Harohally side towards<\/p>\n
A  .’lE3angalore a lorry bearing registration No.C’I’X–803O<\/p>\n
came in a rash and negligent manner and dashed<\/p>\n
against the car, as a result the car was fully damaged<\/p>\n
and the claimant sustained grievous injuries. Hence,
\nhe filed a claim petition before MACT, Bangalore<\/p>\n
seeking compensation of Rs.3.G0,000\/– <\/p>\n
Tribunal has awarded compensation -7<\/p>\n
with interest at 6% pa<\/p>\n
4. As there is no dispute i=.3garrding”oC(:urren(:eV”of<\/p>\n
accident, negligence and liability of. the  of the
\noffending vehicle the only’ that”‘re’rr1ains for
\nconsideration is:\n<\/p>\n

5. _After’ hearing.v’th.e””1earned Counsel appearing for
\nthe parties and -per_nsi.rig the judgment and award of the<\/p>\n
 I  the view that the compensation<\/p>\n
V  the Tribunal is not just and reasonable, it<\/p>\n
it ‘islvlon _the?.g_1ower side and therefore it is deserved to be<\/p>\n
enhaneed.\n<\/p>\n
A’   per wound certi\ufb01cate Ex P <1 the claimant has<\/p>\n
 siistained the following injuries:<\/p>\n
i} Surgical sutured wound over the right side
\nupper lip; ._<\/p>\n
ii) Loosening (displacement) of rightlrliiigyper
\nincisor teeth and blunt  <\/p>\n
forehead;\n<\/p>\n
iii} Nose and maxillary area_Witjh coiitjusiorir,  V<\/p>\n
injuries sustained and treatment talten  <\/p>\n
evident from OPD card anldalsupported’ by”‘.=or”2.::llllevidencel<\/p>\n
of the claimant   1_ll’1~re has not
\nexamined the doctor\n<\/p>\n
7. Considering the injuries sustained by<\/p>\n
the clailnaiifaikfarded by the Tribunal<\/p>\n
towards  on the lower side and it is
\ndeserved’-.._to.be._enlj1an\u00e9ed by Rs.10,000\/– and I award<\/p>\n
\/a Aund_ersthis head.\n<\/p>\n
 -v..VfI’he\u00abnclaimant has produced medical bills for<\/p>\n
‘nsl\u00a72,soog_\u00e9t’a1=ldand the Tribunal has rightly awarded<\/p>\n
— towards medical and incidental expenses<\/p>\n
” _ and there is no scope for enhancement under this head.<\/p>\n

9. The claimant claims that he was earning
\nRs.25,000\/- by working as Engineer and con_tra<:tor,<\/p>\n
but no document is produced in this<\/p>\n
Considering the nature of injuries  V."<\/p>\n
treatment 1 award Rs.10,000\/{towards [of'infcoi.-:iex ' j <\/p>\n
during laid up period as against__Rs_i6:,7dC{'\u00a7 <\/p>\n
the Tribunal.\n<\/p>\n
10. Considering   loosening
\n{displacement} of right  teeth and blunt
\ninjury    awarded by the
\nTribunal’ and discomfort is on
\n Rs.10,000\/- under this<\/p>\n
head.   bl<\/p>\n
  ..__has  examined the doctor regarding<\/p>\n
 _ \u00ab\ufb01igabiiity.ithierefore he is not entitled for compensation<\/p>\n
towards, \u00abloss of future income.<\/p>\n
  Considering the nature of injuries particularly<\/p>\n
 loosening (displacement) of right upper incisor teeth it<\/p>\n
($36<\/p>\n
is just and proper to award Rs. 10,000\/– towards future
\nmedical expenses and it is awarded.<\/p>\n
13. The Tribunal has rightly rejected gof<\/p>\n
Rs.75,708\/– towards damages for damageeausedtitto <\/p>\n
Vehicle on the ground that hemdgot  if’ <\/p>\n
Rs.61,129\/– from the Ins:urane4e__C;’ornpan;yj.Atowiard.s~~hills’<\/p>\n
and final settiement of “damage
\ncaused to his vehicle _.and’ -:t4h_e1*~ep is ‘Vnodseope for
\nenhancement under <\/p>\n

extent stated hereinabove. The ciainiant is entitled for<\/p>\n

a totai compensation of Rs.60,000\/– as against
\nRs.3\u00a3,760\/~ awarded by the Tribunal with interest at<\/p>\n
