No.356\/2010\n21.5.2010<\/pre>\n<p id=\"p_1\">      Shri Manish Datt and Ankit Saxena, Advocates for the<\/p>\n<p>applicant.\n<\/p>\n<pre id=\"pre_1\">      Shri      Ravi      Chauhan,       Advocate    for    non-\n\napplicant\/complainant.\n\n<\/pre>\n<p id=\"p_1\">      Applicant\/accused-Sandeep Sharma and non-applicant\/<\/p>\n<p>complainant-Vinod Bhargava are present in the Court.<\/p>\n<p id=\"p_2\">      Heard on I.A. No.6043\/3010 and I.A. No.6045\/2010,<\/p>\n<p>applications under Section 147, <a href=\"\/doc\/1132672\/\" id=\"a_1\">Negotiable Instruments Act<\/a>, 1881<\/p>\n<p>for permission for compounding the offence punishable under<\/p>\n<p><a href=\"\/doc\/1132672\/\" id=\"a_1\">Negotiable Instruments Act<\/a>, 1881. The trial Court on the basis of<\/p>\n<p>evidence adduced by the complainant, convicted the accused<\/p>\n<p>and ordered him to pay compensation.\n<\/p>\n<p id=\"p_3\">      Applicant has been convicted by the trial Court under<\/p>\n<p><a href=\"\/doc\/1823824\/\" id=\"a_2\">Section 138<\/a> of Negotiable Instruments Act, 1881 with a direction<\/p>\n<p>to undergo six months RI and also directed the applicant to pay<\/p>\n<p>Rs.1,50,000\/- to the non-applicant\/complainant.<\/p>\n<p id=\"p_4\">      Non-applicant\/complainant made a statement that he has<\/p>\n<p>received a sum of Rs.1,50,000\/- as awarded by the Judicial<\/p>\n<p>Magistrate First Class, Bhopal vide judgment and order dated<\/p>\n<p>14\/7\/2009.\n<\/p>\n<p id=\"p_5\">      Learned counsel for the parties submits that during<\/p>\n<p>pendency of this criminal revision, the matter has been amicably<\/p>\n<p>settled between the parties and in compliance to the order dated<\/p>\n<p>14\/7\/2009 passed by the trial Court, compensation amounting to<\/p>\n<p>Rs.1,50,000\/-    has      been       received   by   the    non-<br \/>\n applicant\/complainant today.      They further submits that non-<\/p>\n<p>applicant\/complainant has received Rs.75,000\/- vide demand<\/p>\n<p>draft No.1616 dated 20th May, 2010 and Rs.75,000\/- vide cheque<\/p>\n<p>No.6332 dated 20th May, 2010 of ICICI bank and Rs.3500\/- is<\/p>\n<p>lying in CCD of concerned trial Court which will be withdrawn by<\/p>\n<p>the non-applicant\/complainant.\n<\/p>\n<p id=\"p_6\">      Learned    counsel    for   the   non-applicant\/complainant<\/p>\n<p>submits that    now non-applicant\/complainant do not wish to<\/p>\n<p>prosecute the matter further against the applicant.<\/p>\n<p id=\"p_7\">      <a href=\"\/doc\/482575\/\" id=\"a_3\">In Cranex Ltd. V. Nagarjuna Finance Ltd<\/a>., 2000(7) SCC<\/p>\n<p>388, a settlement had been entered between the parties during<\/p>\n<p>the pendency of appeal in the Sessions Court against an order of<\/p>\n<p>conviction and sentence recorded by the Magistrate under<\/p>\n<p><a href=\"\/doc\/1823824\/\" id=\"a_4\">Section 138<\/a> of the Act. The Apex Court directed the appellate<\/p>\n<p>Court to consider the settlement and to take appropriate action in<\/p>\n<p>accordance with law. The fact as to compromise between the<\/p>\n<p>parties and payment of dues under <a href=\"\/doc\/1823824\/\" id=\"a_5\">Section 138<\/a> of the Act was<\/p>\n<p>considered a relevant fact and compounding was allowed by the<\/p>\n<p>Apex Court in the case of Kishore Kumar V. J.K. Corporation<\/p>\n<p>Ltd., (2004) 13 SCC 494.\n<\/p>\n<p id=\"p_8\">      Taking into consideration the provision of <a href=\"\/doc\/177946336\/\" id=\"a_6\">Section 147<\/a> and<\/p>\n<p>the primary object underlying <a href=\"\/doc\/1823824\/\" id=\"a_7\">Section 138<\/a>, there is no reason to<\/p>\n<p>refuse the compromise between the parties.<\/p>\n<p id=\"p_9\">      Considering the fact that matter has been settled and the<\/p>\n<p>amount of Rs.1,50,000\/- has been paid by the applicant as full<br \/>\n and final settlement      and non-applicant\/complainant has no<\/p>\n<p>objection to allow the application and acquit the applicant of the<\/p>\n<p>offence with which he was     charged and convicted by the Court<\/p>\n<p>below, for the foregoing reasons, I.A. No.6043\/3010 and I.A.<\/p>\n<p>No.6045\/2010 are allowed. Parties are permitted to compound<\/p>\n<p>the offence under 138 of <a href=\"\/doc\/1132672\/\" id=\"a_8\">Negotiable Instruments Act<\/a>, 1881. In<\/p>\n<p>view of the compromise arrived at between both the parties,<\/p>\n<p>the conviction of the applicant under <a href=\"\/doc\/1823824\/\" id=\"a_9\">Section 138<\/a> of Negotiable<\/p>\n<p>Instruments    Act, 1881 is    set   aside and the applicant is<\/p>\n<p>acquitted from the said charge. He is on bail, his bail bonds are<\/p>\n<p>hereby discharged.\n<\/p>\n<p id=\"p_10\">      With the aforesaid, the criminal revision is allowed and<\/p>\n<p>disposed of.\n<\/p>\n<p id=\"p_11\">      C.C.as per rules.\n<\/p>\n<p id=\"p_12\">\n<p id=\"p_13\">                                                 (P.K.
