RADHAKRISHNAN, J\n                  ...........................................\n                WP(C).NO. 24887                  OF 2009\n                  ............................................\n      DATED THIS THE          16TH DAY OF SEPTEMBER, 2009\n\n                                JUDGMENT\n<\/pre>\n<p id=\"p_1\">     Notice to respondents 4 to 6 dispensed with, preserving<\/p>\n<p>their right to seek rehearing, if aggrieved by the directions<\/p>\n<p>contained in this judgment.\n<\/p>\n<p id=\"p_1\">     2.    Heard learned counsel for the petitioner, learned<\/p>\n<p>Government Pleader for respondents 1 and 2 and learned<\/p>\n<p>standing counsel for third respondent. Alleging that private<\/p>\n<p>respondents have trespassed into a public way, which vests in<\/p>\n<p>the panchayat, there were earlier litigations before this court.<\/p>\n<p>Following the directions of this court, the Municipality considered<\/p>\n<p>the matter and concluded that even if there was reduction of the<\/p>\n<p>width of the road at the relevant location, the question whether it<\/p>\n<p>is because of encroachment, is a matter that could be finally<\/p>\n<p>decided only on appropriate survey and any further proceedings<\/p>\n<p>could be taken only on identifying the land, if any, encroached<\/p>\n<p>upon. While the petitioner states that no due action follows on<\/p>\n<p>such decision, third respondent Municipality states that it has<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Wpc 24887\/2009                  2<\/span><\/p>\n<p>written to the survey department to measure out the property<\/p>\n<p>and fix the alignment so that if there is encroachment,<\/p>\n<p>appropriate action could be taken. The Kerala Municipalities Act,<\/p>\n<p>1994 and the Rules framed thereunder and law relating to Land<\/p>\n<p>Conservancy provide the effective measures for recovery of<\/p>\n<p>lands, if any, encroached upon. Those statutory provisions also<\/p>\n<p>have sufficient remedies to any person who is proceeded against<\/p>\n<p>under those laws. But matters cannot be delayed. For this,<\/p>\n<p>survey department has to conclude its action as requested by the<\/p>\n<p>Municipality. Obviously, there cannot be any limited time frame<\/p>\n<p>for the Municipality to finally decide or to take action in the<\/p>\n<p>matter.\n<\/p>\n<p id=\"p_2\">     3.    For the aforesaid reasons, respondents 1 and 2 are<\/p>\n<p>directed to ensure that the application of the third respondent<\/p>\n<p>before the survey authorities are taken up and acted upon in<\/p>\n<p>accordance with law, at the earliest and any required survey is<\/p>\n<p>completed within an outer limit of four months from the date of<\/p>\n<p>receipt of a copy of this judgment. On obtaining report from the<\/p>\n<p>survey department, if further steps are found necessary, third<\/p>\n<p>respondent shall take the necessary steps by commencing<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Wpc 24887\/2009                 3<\/span><\/p>\n<p>proceedings, in accordance with law, within a period of four<\/p>\n<p>weeks therefrom. All other issues left open.
