Kandpal, President):\n<\/p>\n<p>      This is an appeal under Section 15 of the Consumer Protection<br \/>\nAct, 1986 against the order dated 18.12.2010 passed by the District<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>Forum, Almora in consumer complaint No. 66 of 2001, whereby the<br \/>\nDistrict Forum has allowed the consumer complaint and directed the<br \/>\nopposite party No. 1 &#8211; appellant before this Commission to pay sum<br \/>\nof Rs. 12,600\/- to the respondent Nos. 1 and 2 &#8211; complainants<br \/>\ntogether with interest @15% p.a. from 28.09.1998 till payment.\n<\/p>\n<p>2.      Briefly stated, the facts of the case as mentioned in the<br \/>\nconsumer complaint, are that the complainants applied for shares of<br \/>\nUTI Bank Limited and submitted the demand drafts of the required<br \/>\namount to UTI Bank Limited through respondent No. 3 &#8211; Sh.<br \/>\nRavinder Kumar Agarwal, but the complainants did not receive the<br \/>\nshare certificates. On inquiry, it was found that the demand drafts<br \/>\nsent by the complainants were attached with some other application<br \/>\nform.    The complainants had written the serial number of their<br \/>\napplication and their names on the overleaf of the bank drafts, so that<br \/>\nthe same could not be misused. Alleging deficiency in service on the<br \/>\npart of the opposite parties, the complainants filed a consumer<br \/>\ncomplaint before the District Forum, Almora.\n<\/p>\n<p>3.      The appellant filed written statement before the District Forum<br \/>\nand pleaded that the complainants wrongly submitted their application<br \/>\nthrough respondent No. 3 &#8211; Sh. Ravinder Kumar Agarwal and there<br \/>\nwas no such procedure mentioned in the offer document; that Sh.<br \/>\nRavinder Kumar Agarwal was not their authorised agent; that there<br \/>\nhas been neglect on the part of the complainants; that the application<br \/>\nform was not properly submitted and that there is no deficiency in<br \/>\nservice on their part.\n<\/p>\n<p>4.      The respondent No. 3 filed written statement before the District<br \/>\nForum and pleaded that the consideration amount of the shares was<br \/>\n<span class=\"hidden_text\">                                       3<\/span><\/p>\n<p>received by UTI Bank Limited and that there has not been any<br \/>\ndeficiency in service on his part.\n<\/p>\n<p>5.    The District Forum, on an appreciation of the material on<br \/>\nrecord, allowed the consumer complaint vide impugned order dated<br \/>\n18.12.2010 in the above terms. Aggrieved by the said order, the<br \/>\nappellant has filed this appeal.\n<\/p>\n<p>6.    None appeared on behalf of respondent Nos. 1 and 2. We have<br \/>\nheard the learned counsel for the appellant and respondent No. 3 and<br \/>\nhave also perused the record.\n<\/p>\n<p>7.    The main ground taken by the appellant is that Sh. Ravinder<br \/>\nKumar Agarwal was not their authorised agent and that the<br \/>\ncomplainants should not have handed over their application to him. It<br \/>\nis an admitted fact that the application forms and the demand drafts of<br \/>\nthe required amount were received by the appellant and the same were<br \/>\nencashed by the appellant.         The appellant has also admitted that<br \/>\noverleaf the demand drafts, the application number and the name of<br \/>\nthe applicants were also mentioned. If Sh. Ravinder Kumar Agarwal<br \/>\nwas not the authorised agent of the appellant, then why the application<br \/>\nforms were accepted and the amount of the demand drafts was<br \/>\nrealized by the appellant. The District Forum has rightly held that if<br \/>\nSh. Ravinder Kumar Agarwal was not the agent of the bank, then the<br \/>\napplications forms forwarded through him, should not have been<br \/>\naccepted and the consideration amount of the shares should not have<br \/>\nbeen realized by the bank by encashing the demand drafts. We also<br \/>\nendorse the said view of the District Forum.\n<\/p>\n<p>8.    So far as the territorial jurisdiction of the District Forum,<br \/>\nAlmora in the matter is concerned, the District Forum has rightly held<br \/>\n<span class=\"hidden_text\">                                   4<\/span><\/p>\n<p>that the part of cause of action has arisen in favour of the<br \/>\ncomplainants at Almora and, as such, the consumer complaint was<br \/>\nmaintainable before the District Forum, Almora.\n<\/p>\n<p>9.    It was also argued that the complainants do not fall under the<br \/>\ncategory of &#8220;consumer&#8221;.     We do not find any force in the said<br \/>\nsubmission raised on behalf of the appellant, for the reason that the<br \/>\ncomplainants have paid the amount for purchase of shares, which<br \/>\nwere not allotted to them and nor the amount was refunded. Thus, the<br \/>\ncomplainants fall under the category of &#8220;consumer&#8221; and their<br \/>\nconsumer complaint was maintainable.\n<\/p>\n<p>10.   The District Forum has considered all the aspects of the matter<br \/>\nand has passed a reasoned order, which does not call for any<br \/>\ninterference, except on the count that the rate of interest awarded by<br \/>\nthe District Forum @15% p.a. is on the higher side. In our considered<br \/>\nopinion, the same need to be reduced to 7% p.a. This way, the appeal<br \/>\nis to be partly allowed and the order impugned is to be modified<br \/>\naccordingly.\n<\/p>\n<p>11.   For the reasons aforesaid, appeal is partly allowed.      Order<br \/>\nimpugned dated 18.12.2010 of the District Forum is modified to the<br \/>\nextent that the rate of interest is reduced from 15% p.a. to 7% p.a.<br \/>\nRest of the impugned order passed by the District Forum is confirmed.<br \/>\nNo order as to costs.\n<\/p>\n<p>(SMT.
