Deepak Pandey son of Moghal Pandey\n                                     Versus\n                               STATE OF BIHAR\n                                    -----------\n<\/pre>\n<p id=\"p_1\">2\/   17.06.2010              Heard learned counsel for the petitioners and the State.<\/p>\n<p id=\"p_1\">                                The petitioners seek bail in a case instituted for the<\/p>\n<p>                   offence under <a href=\"\/doc\/1101188\/\" id=\"a_1\">sections 379<\/a> and <a href=\"\/doc\/812083\/\" id=\"a_1\">411<\/a> of the Indian Penal Code.<\/p>\n<p id=\"p_2\">                                Considering that now the matter has been compromised<\/p>\n<p>                  between the parties and the petitioners have no criminal antecedents, let<\/p>\n<p>                  the petitioners, above named, be released on bail on furnishing bail<\/p>\n<p>                  bond of Rs.5,000\/- (five thousand) with two sureties of the like amount<\/p>\n<p>                  each to the satisfaction of the Chief Judicial Magistrate, Katihar, in<\/p>\n<p>                  connection with Katihar Town P.S. Case No.99 of 2010, subject to the<\/p>\n<p>                  conditions (i) that one of the bailors will be a close relative of the<\/p>\n<p>                  petitioners, who will give an affidavit giving genealogy as to how he is<\/p>\n<p>                  related with the petitioners. The bailor will undertake to furnish<\/p>\n<p>                  information to the court about any change in the address of the<\/p>\n<p>                  petitioners, (ii) that the affidavit shall clearly state that the petitioners<\/p>\n<p>                  are not accused in any other case and, if they are, they shall not be<\/p>\n<p>                  released on bail, (iii) that the bailor shall also state on affidavit that he<\/p>\n<p>                  will inform the court concerned if the petitioners are implicated in any<\/p>\n<p>                  other case of similar nature after their release in the present case and<\/p>\n<p>                  thereafter the court below will be at liberty to initiate the proceeding for<\/p>\n<p>                  cancellation of bail on the ground of misuse,(iv) that the petitioners will<\/p>\n<p>                  give an undertaking that they will receive the police papers on the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                -2-<\/span><\/p>\n<p>       given date and be present on date fixed for charge and if they fail to do<\/p>\n<p>       so on two given dates and delay the trial in any manner, their bail will<\/p>\n<p>       be liable to be cancelled for reasons of misuse, and (v) that the<\/p>\n<p>       petitioners will be well represented on each date and if they fail to do<\/p>\n<p>       so on two consecutive dates, their bail will be liable to be cancelled.<\/p>\n<pre id=\"pre_1\">JA\/-                                     (Anjana Prakash, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sunil Pandey &amp;Amp; Ors vs State Of Bihar on 17 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
