Justice R.BASANT\n\n Dated :31\/10\/2007\n\n O R D E R\n                                R.BASANT, J\n                        ------------------------------------\n                         B.A.No.6496 of 2007\n                        -------------------------------------\n              Dated this the 31st day of October, 2007\n\n                                    ORDER\n<\/pre>\n<p id=\"p_1\">      Application for anticipatory bail. Petitioners face allegations in a<\/p>\n<p>crime registered under Sections 447, 427 and 379 r\/w 34 <a href=\"\/doc\/1569253\/\" id=\"a_1\">I.P.C<\/a>. The<\/p>\n<p>petitioners are brothers. The allegation is that they stealthily removed<\/p>\n<p>a door frame from a building, construction of which is going on. The<\/p>\n<p>construction is done by the defacto complainant on behalf of his<\/p>\n<p>principal. There is a dispute between the principal and the 1st accused<\/p>\n<p>about the rights in respect of the property in which the construction is<\/p>\n<p>going on.    The crux of the allegation is that the petitioners had<\/p>\n<p>stealthily removed the door frame at about 10.45 p.m on 13.10.07.<\/p>\n<p>Investigation is in progress.         The petitioners apprehend imminent<\/p>\n<p>arrest.\n<\/p>\n<p id=\"p_1\">      2.    The learned counsel for the petitioners submits that the<\/p>\n<p>petitioners are absolutely innocent. Because of the civil dispute and<\/p>\n<p>because of the fact that the petitioners had gone to court to get the<\/p>\n<p>further construction stayed, as a retaliation and               counter blast,<\/p>\n<p>allegations are being raised against the petitioners. The petitioners<\/p>\n<p>are respectable persons and the allegation of theft is resorted to only<\/p>\n<p>to bring them to ridicule. The petitioners are prepared to abide by any<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.No.6496 of 2007                  2<\/span><\/p>\n<p>conditions. They may be saved of the undeserved trauma of arrest<\/p>\n<p>and detention, submits the learned counsel for the petitioners.<\/p>\n<p id=\"p_2\">      3.    The learned Public Prosecutor        opposes the application.<\/p>\n<p>The learned Public Prosecutor submits that while it is evident that the<\/p>\n<p>civil dispute is there, that cannot be a valid defence for the allegation<\/p>\n<p>of theft, which the police on investigation is satisfied, had really taken<\/p>\n<p>place.\n<\/p>\n<p id=\"p_3\">      4.    Having considered all the relevant inputs, notwithstanding<\/p>\n<p>the opposition by the learned Public Prosecutor , I am satisfied, that<\/p>\n<p>the petitioners can be granted anticipatory bail subject of course to<\/p>\n<p>appropriate conditions which shall ensure the interests of a fair,<\/p>\n<p>efficient and expeditious investigation.\n<\/p>\n<p id=\"p_4\">      5.    In the result, the Bail Application is, allowed. The following<\/p>\n<p>directions are issued under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> Cr.P.C.<\/p>\n<p id=\"p_5\">      i)    The petitioners shall appear before the learned Magistrate<\/p>\n<p>at 11 a.m on 07.11.07. They shall be enlarged on regular bail on their<\/p>\n<p>executing a bond for Rs.25,000\/- (Rupees Twenty Five thousand only)<\/p>\n<p>each with two solvent sureties each for the like sum to the satisfaction<\/p>\n<p>of the learned Magistrate;\n<\/p>\n<p id=\"p_6\">      ii)   The petitioners shall make themselves available for<\/p>\n<p>interrogation before the Investigating Officer between 10 a.m and 3<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.No.6496 of 2007                 3<\/span><\/p>\n<p>p.m on 08.11.07 and 09.11.07. During this period, the Investigating<\/p>\n<p>Officer shall be entitled to interrogate the petitioners in custody and<\/p>\n<p>take all necessary steps in the investigation of the crime. Thereafter<\/p>\n<p>the petitioners shall make themselves available for interrogation before<\/p>\n<p>the Investigating Officer as and when directed by the Investigating<\/p>\n<p>Officer in writing to do so;\n<\/p>\n<p id=\"p_7\">      iii)  If the petitioners do not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p>thereafter stand revoked and the police shall be at liberty to arrest the<\/p>\n<p>petitioners and deal with them     in accordance with law as if those<\/p>\n<p>directions were not issued at all;\n<\/p>\n<p id=\"p_8\">      iv)   If the petitioners were arrested prior to their surrender<\/p>\n<p>on 07.11.07. as directed in clause (1) above, they shall be released<\/p>\n<p>from custody on their executing a bond for Rs.25,000\/- (Rupees<\/p>\n<p>Twenty Five thousand only)        without any sureties undertaking to<\/p>\n<p>appear before the learned Magistrate on 07.11.2007.<\/p>\n<p id=\"p_9\">                                                  (R.BASANT, JUDGE)<br \/>\nrtr\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court A.Narayanan Nair vs State on 31 October, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 6496 of 2007() 1.
