Justice V.GIRI\n\n Dated :25\/<a href=\"\/doc\/1390448\/\" id=\"a_1\">01\/2008\n\n O R D E R\n                                   V.GIRI,J.\n\n                            -------------------------\n\n                       W.P ( C) No<\/a>. 2039 of 2008\n\n                            --------------------------\n\n                 Dated this the 25th  January, 2008\n\n\n                              J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      Petitioners   were   appointed   as     Nursing   Assistants   in<\/p>\n<p>different   Ayurveda   Dispensaries   in Thiruvanthapuram district<\/p>\n<p>on   a   provisional   basis   under   Exhibit   P1   and   thereafter   under<\/p>\n<p>Exhibits   P2   and   P3.       Petitioners   now   point   out   that     Hospital<\/p>\n<p>Attendants   Gr.II   in   the   Health   Services   Department,   though<\/p>\n<p>appointed  on a provisional basis  were subsequently regularised<\/p>\n<p>as   is   evident   from   Exhibit   P4   Government   Order   dated<\/p>\n<p>16.11.2007.     Petitioners   claim     parity   of   treatment   and   have<\/p>\n<p>submitted   Exhibits   P5   to   8   representations                before   the<\/p>\n<p>Government  in that regard.\n<\/p>\n<p id=\"p_1\">      Learned   Government   Pleader     submits   that   Exhibit   P4<\/p>\n<p>Government Order will  not apply  to the case of the  petitioners.\n<\/p>\n<p id=\"p_2\">Petitioners   were   appointed   in   the   Department   of   Ayurveda   and<\/p>\n<p>the beneficiaries under Exhibit P4  stands on a different footing.\n<\/p>\n<p id=\"p_3\">This   is   definitely   a   relevant   fact.       Without   expressing   any<\/p>\n<p>opinion on the merits of the case and after hearing   the counsel<\/p>\n<p>W.P ( C) No. 2039 of 2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                           2<\/span><\/p>\n<p>on   both   sides,   this   writ   petition   is   disposed   of   directing   the   3rd<\/p>\n<p>respondent     to   look   into   Exhibit   P5   to   8   and   take   a   decision<\/p>\n<p>thereon,   in   accordance   with   law,   after   hearing   the   petitioner,<\/p>\n<p>within   three   months   from   the   date   of   receipt   of   a   copy   of   this<\/p>\n<p>judgment.
