This Revision petition has been filed against the order of the Sessions<br \/>\n            Judge, Giridih, whereby the Sessions Judge has partly allowed the appeal<br \/>\n            preferred against the judgment passed by the First Class Judicial Magistrate,<br \/>\n            Giridih.\n<\/p>\n<p id=\"p_1\">            3.     The accused persons were tried in the trial court for the offence under<br \/>\n            <a href=\"\/doc\/1011035\/\" id=\"a_1\">Section 323<\/a>, <a href=\"\/doc\/1599401\/\" id=\"a_1\">341<\/a>, <a href=\"\/doc\/222396\/\" id=\"a_2\">427<\/a>,<a href=\"\/doc\/37788\/\" id=\"a_3\">34<\/a> and <a href=\"\/doc\/724142\/\" id=\"a_4\">324<\/a> IPC. The learned Appellate court had set<br \/>\n            aside the conviction of the appellants\/petitioners before the appellate court<br \/>\n            under <a href=\"\/doc\/222396\/\" id=\"a_5\">Section 427<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_6\">34<\/a>. However, conviction of the petitioner nos.2 and 3<br \/>\n            under <a href=\"\/doc\/1011035\/\" id=\"a_7\">Section 323<\/a>, <a href=\"\/doc\/1599401\/\" id=\"a_8\">341<\/a>\/<a href=\"\/doc\/898393\/\" id=\"a_9\">24<\/a> was maintained and the conviction under <a href=\"\/doc\/1599401\/\" id=\"a_10\">Section<br \/>\n            341<\/a> and <a href=\"\/doc\/724142\/\" id=\"a_11\">324<\/a> IPC was also upheld against all the petitioners. The petitioner<br \/>\n            no.1 was found guilty under <a href=\"\/doc\/724142\/\" id=\"a_12\">Section 324<\/a> IPC and therefore no conviction<br \/>\n            was recorded under <a href=\"\/doc\/1011035\/\" id=\"a_13\">Section 323<\/a> IPC. The petitioner nos.2 and 3 was granted<br \/>\n            benefit of the <a href=\"\/doc\/167447\/\" id=\"a_14\">Probation of Offenders Act<\/a> and the sentence was reduced to<br \/>\n            admonition. The sentence of petitioner no.1 under <a href=\"\/doc\/1599401\/\" id=\"a_15\">Section 341<\/a> IPC was also<br \/>\n            reduced to admonition. Further, the sentence against petitioner no.1 under<br \/>\n            <a href=\"\/doc\/167447\/\" id=\"a_16\">Section 324IPC<\/a> was reduced to six months from one year.\n<\/p>\n<p id=\"p_2\">            3.     The occurrence is of 1996. We are in 2011. This Court considers that<br \/>\n            it would not be appropriate to send the accused behind the bar after so<br \/>\n            many years. In the eventuality, it is considered appropriate that instead of<br \/>\n            maintaining the sentence of imprisonment for petitioner no.1, a fine be<br \/>\n            imposed on him and accordingly, a fine of Rs.5,000\/-(five thousand) is<br \/>\n            imposed on petitioner no.1-Parshu Ram Mahto. If the fine is not paid within a<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 2.<\/span><br \/>\n       period of three months, the original order of of sentence of six months<br \/>\n       passed by the learned Sessions Judge will come into operation and he will<br \/>\n       have to serve the sentence.\n<\/p>\n<p id=\"p_3\">       4.     The sentence under other Sections in which benefit of <a href=\"\/doc\/167447\/\" id=\"a_17\">Probation of<br \/>\n       Offenders Act<\/a> and admonition was awarded is not interfered.\n<\/p>\n<p id=\"p_4\">       5.
