{"id":261717,"date":"2010-03-12T00:00:00","date_gmt":"2010-03-11T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/shri-mani-ram-sharma-vs-central-vigilance-commission-on-12-march-2010"},"modified":"2015-08-24T10:39:13","modified_gmt":"2015-08-24T05:09:13","slug":"shri-mani-ram-sharma-vs-central-vigilance-commission-on-12-march-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/shri-mani-ram-sharma-vs-central-vigilance-commission-on-12-march-2010","title":{"rendered":"Shri Mani Ram Sharma vs Central Vigilance Commission &#8230; on 12 March, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Central Information Commission<\/div>\n<div class=\"doc_title\">Shri Mani Ram Sharma vs Central Vigilance Commission &#8230; on 12 March, 2010<\/div>\n<pre id=\"pre_1\">                 CENTRAL INFORMATION COMMISSION\n                 Complaint No. - CIC\/WB\/C\/2009\/000057 dated: 19.02.'09\n                      Right to <a href=\"\/doc\/1965344\/\" id=\"a_1\">Information Act<\/a>- <a href=\"\/doc\/1210983\/\" id=\"a_1\">Section 18(1)<\/a> (b)\n\nComplainant:         Shri Mani Ram Sharma\nRespondent:          Central Vigilance Commission (CVC), New Delhi.\n                             Decision announced 12.3.'10\n\n\nFacts<\/pre>\n<p id=\"p_1\">:-\n<\/p>\n<p id=\"p_1\">       The Commission has received a complaint from Shri Mani Ram Sharma of<br \/>\nChuru, Rajasthan that his request under <a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a>, 2005 submitted to the Central<br \/>\nPublic Information Officer, Central Vigilance Commission, New Delhi, seeking<br \/>\ninformation regarding action taken on his application sent on 29.08.2009 for<br \/>\nregistering a complaint against DIG, CBI, BSFC, New Delhi for denying to<br \/>\nregister a case against State Bank of Bikaner &amp; Jaipur, together with other<br \/>\nrelated information, has not been responded to even though the same was duly<br \/>\nsubmitted along with the requisite fee, dated 29.08.2008. Similarly, no order has<br \/>\nbeen passed by the first appellate authority of CVC on his appeal u\/s 19(1) dated<br \/>\n29.09.2008.\n<\/p>\n<p id=\"p_2\">       Admitting the complaint of Shri Sharma under <a href=\"\/doc\/1210983\/\" id=\"a_3\">Section 18(1)<\/a> (b) of <a href=\"\/doc\/671631\/\" id=\"a_4\">RTI Act<\/a>,<br \/>\n2005 the Commission served notice on 06.01.2010 on CPIO, Central Vigilance<br \/>\nCommission, New Delhi for furnishing comments on the complaint. In response,<br \/>\nCPIO Shri R. Ravichandran, Advisor, CVC has submitted his comments of<br \/>\n18.01.2010 with a copy also endorsed to complainant. CPIO has informed the<br \/>\nCommission that not only was the application dated 29.08.2008 of the<br \/>\ncomplainant, which was received in the CVC on 23.09.2008, responded to by the<br \/>\nthen CPIO vide letter dated 06.10.2008 but his appeal dated 29.09.2008 was<br \/>\nalso disposed of by the 1st appellate authority after considering all the aspects of<br \/>\nthe case vide order dated 30.10.2008. The CPIO has enclosed the copies of<br \/>\nresponse of the CPIO and order passed by the appellate authority with the<br \/>\ncomments. The complainant has also filed a rejoinder against the comments<br \/>\nstating that the CPIO has provided only one information regarding action taken<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                          1<\/span><br \/>\n on his complaint dated 29.08.2008 whereas, the rest of the information sought<br \/>\nhas still not provided.\n<\/p>\n<p id=\"p_3\">                                    Decision<\/p>\n<p>       From a perusal of the file and the comments submitted by the CPIO, it is<br \/>\nevident that, contrary to the complaint of Shri Mani Ram Sharma the CPIO has<br \/>\nindeed responded to the request of complainant whose 1st appeal has also been<br \/>\ndisposed of by the appellate authority and that within the time mandated by law.<br \/>\nHence, the complaint against non-response to the request does not stand and in<br \/>\nlight of this the present complaint can only be dismissed.\n<\/p>\n<p id=\"p_4\">       On the other hand the complainant has pleaded that the CPIO has<br \/>\nresponded against one point only whereas, others have remained unaddressed.<br \/>\nFor that the complainant is hereby advised to approach the 1st appellate authority<br \/>\nbecause the appellate authority of CVC has not addressed the issues which has<br \/>\nnow been raised by the complainant through his rejoinder filed before the<br \/>\nCommission and if not satisfied with the information provided on his 1st appeal,<br \/>\ncomplainant Shri Sharma will be free to move a 2nd appeal before us as per<br \/>\n<a href=\"\/doc\/1852611\/\" id=\"a_5\">section 19(3)<\/a>.\n<\/p>\n<p id=\"p_5\">       Announced this twelfth day of March 2010.
