N.  VARIAVA, J.\n<\/p>\n<p id=\"p_1\">      These  Appeals  are  against  a  Judgment\t dated\t11th<br \/>\nDecember,  1987\t in a Petition filed by the  3rd  Respondent<br \/>\nbefore\tthe  Central  Administrative Tribunal and  an  Order<br \/>\ndated 22nd August, 1988 by which, pursuant to Judgment dated<br \/>\n11th  December, 1987, the 1st Respondent has determined that<br \/>\nAppellant  is  junior to 3rd Respondent and reverted him  to<br \/>\npost of Porter in the Commercial Department.\n<\/p>\n<p id=\"p_2\">      The  3rd\tRespondent  has\t not  appeared\teven  though<br \/>\nserved.\n<\/p>\n<p id=\"p_3\">      Briefly  stated  the  facts are as follows:   On\t22nd<br \/>\nJuly, 1972 the Appellant was appointed as a Porter on casual<br \/>\nbasis  in  the\tTransportation (Traffic) Department  of\t the<br \/>\nSouth  Central Railway, Hubli Division.\t On 1st March,\t1973<br \/>\nthe Appellant was conferred a temporary status.\n<\/p>\n<p id=\"p_4\">      The  3rd\tRespondent was appointed as a Porter in\t the<br \/>\nCommercial Department on 30th August, 1974.\n<\/p>\n<p id=\"p_5\">      Rule  180 of the Railway Establishment Manual reads as<br \/>\nunder:\t  &#8220;180:\t  Transportation   (Traffic)  &amp;\t  Commercial<br \/>\nDepartment:- All railway servants in the lowest group should<br \/>\nbe eligible for consideration for promotion to higher grades<br \/>\nin   both  the\tTransportation\t and  Commercial   Branches.<br \/>\nApplications  should  be  invited  from\t amongst  candidates<br \/>\neligible  for promotion from both the branches.\t All railway<br \/>\nservants  who apply will be considered.\t An adhoc  seniority<br \/>\nlist  will be prepared on the basis of length of  continuous<br \/>\nservice in the grade and suitable men selected and placed on<br \/>\na  panel for training.\tSystematic and adequate training and<br \/>\nexaminations or tests must precede actual promotions.&#8221;\n<\/p>\n<p id=\"p_6\">      As  provided  in\tthis  Rule  Appellant  and  the\t 3rd<br \/>\nRespondent  were  allowed to attend promotional\t courses  to<br \/>\nqualify\t as  Ticket Collectors.\t In 1979 both Appellant\t and<br \/>\n3rd  Respondent were allowed to compete for selection to the<br \/>\npost  of Ticket Collectors.  However, neither got  selected.<br \/>\nOn  20th  August,  1980\t the Appellant\tgot  posted  in\t the<br \/>\nCommercial  Department.\t  They then again competed in  1981.<br \/>\nOn 17th June, 1981 both the Appellant and the 3rd Respondent<br \/>\nwere shown to have been selected.  However, as there were no<br \/>\nvacancies they were not appointed.\n<\/p>\n<p id=\"p_7\">      Thereafter  both the Appellant and the 3rd  Respondent<br \/>\nwere  appointed\t as Ticket Collectors on adhoc basis on\t the<br \/>\ncondition  that this would not confer any right for  regular<br \/>\nappointment  and  that\tthey  would make  room\tfor  regular<br \/>\nappointees as and when selected and appointed.\n<\/p>\n<p id=\"p_8\">      On  27th September, 1981 a provisional seniority\tlist<br \/>\nwas  prepared.\t In  the  seniority list  the  name  of\t the<br \/>\nAppellant  was missing.\t The Appellant made a representation<br \/>\nagainst\t the fact that his name had not been included in the<br \/>\nseniority list.\n<\/p>\n<p id=\"p_9\">      Selections  for  the post Ticket Collector were  again<br \/>\nmade  in 1982 and 1983.\t In 1983 the Appellant was  selected<br \/>\nalong  with 17 other persons.  Pursuant to this selection on<br \/>\n28th  May,  1983  the  Appellant   was\tpromoted  as  Ticket<br \/>\nCollector  in  a vacant post.  It must be mentioned that  in<br \/>\nthis selection the 3rd Respondent had also competed, but was<br \/>\nnot  selected.\t Thereafter  another selection was  held  in<br \/>\nApril  1986.   In  that selection again the  3rd  Respondent<br \/>\nappeared but was again not selected.\n<\/p>\n<p id=\"p_10\">      On  25th September, 1986 the Appellant was promoted to<br \/>\nthe  grade  of Senior Ticket Collector.\t On 29th  September,<br \/>\n1986  the  3rd Respondent who, during all this\tperiod,\t had<br \/>\nbeen  working  as an adhoc Ticket Collector was reverted  to<br \/>\nmake   room  for  candidates   who  had\t been\tsuccessfully<br \/>\nempanelled.   On  5th  January,\t  1987\tthe  3rd  Respondent<br \/>\nchallenged  his\t reversion  and the promotion order  of\t the<br \/>\nAppellant   by\t filing\t a   Petition  before  the   Central<br \/>\nAdministrative Tribunal.\n<\/p>\n<p id=\"p_11\">      On  11th\tDecember,  1987 the  Central  Administrative<br \/>\nTribunal  held\tthat the promotion of the Appellant was\t not<br \/>\nproper\tas  the\t Appellant was not  eligible.\tThe  Central<br \/>\nAdministrative\tTribunal held that the Appellant was working<br \/>\nin   the  Transportation  (Traffic)   Department   and\t the<br \/>\nselections were to be from persons working in the Commercial<br \/>\nDepartment.   The Central Administrative Tribunal held\tthat<br \/>\nas the Appellant had been appointed in Commercial Department<br \/>\non 22th August, 1980 he could not be considered to be senior<br \/>\nto the 3rd Respondent who had been appointed on 30th August,<br \/>\n1974.\tThe  Central  Administrative Tribunal  directed\t the<br \/>\nGovernment  to\tprepare\t a fresh  seniority  list  confining<br \/>\nthemselves  to the Commercial Department and thereafter,  if<br \/>\nthe  3rd  Respondent was found senior to the  Appellant,  to<br \/>\npromote\t him  with effect from the date of promotion of\t the<br \/>\nAppellant.  It is this Judgment which is assailed before us.<br \/>\nPursuant  to this Judgment the 1st Respondent has passed  an<br \/>\nOrder  dated  22nd  August,  1988   by\twhich  seniority  of<br \/>\nAppellant  is fixed below 3rd Respondent and it is  proposed<br \/>\nthat  Appellant\t be  reverted to the post of Porter  in\t the<br \/>\nCommercial Department.\n<\/p>\n<p id=\"p_12\">      Even  though the 3rd Respondent had not appeared,\t Mr.<br \/>\nNagaraja and Mr.  Qadri have fairly placed before us all the<br \/>\nmaterial and have assisted the Court.\n<\/p>\n<p id=\"p_13\">      Undoubtedly,  the\t selection  was to be  from  persons<br \/>\nworking\t in the Commercial Department.\tHowever, with effect<br \/>\nfrom 22nd August, 1980 the Appellant was also working in the<br \/>\nCommercial  Department.\t Therefore, in 1983 he was  eligible<br \/>\nto  be selected.  All persons who were eligible were allowed<br \/>\nto  compete  for  selection.   Being so\t eligible  both\t the<br \/>\nAppellant   and\t the  3rd   Respondent\thad  competed.\t The<br \/>\nAppellant  got\tselected and was put on the select panel  on<br \/>\n29th  April, 1983.  The 3rd Respondent had also competed but<br \/>\nhe  was\t not selected or empanelled.  Only persons who\twere<br \/>\nempanelled could be appointed as Ticket Collectors.  In such<br \/>\na  case, the question of inter se seniority between the\t two<br \/>\npersons did not arise.\tAs 3rd Respondent was not empanelled<br \/>\nhe  could not be promoted.  Even presuming the Appellant was<br \/>\njunior,\t the  Appellant could still get promoted as  he\t was<br \/>\nselected.\n<\/p>\n<p id=\"p_14\">      Rule  180,  set  out  above, shows  that\tall  railway<br \/>\nservants  were eligible for consideration of promotion.\t The<br \/>\n3rd  Respondent, having failed to get selected, could hardly<br \/>\ncomplain  about\t the  promotion of the Appellant.   On\tthis<br \/>\nbasis  itself  the  Order  of  the  Central   Administrative<br \/>\nTribunal cannot be sustained.\n<\/p>\n<p id=\"p_15\">      Even  otherwise, it is to be noted that the  Appellant<br \/>\ngot  promoted  to the post of Ticket Collector on 28th\tMay,<br \/>\n1983.\tHe  was\t thereafter  promoted  as  a  Senior  Ticket<br \/>\nCollector  on 25th September, 1986.  The Appellant was\tthen<br \/>\npromoted  as a Train Ticket Examiner on 25th May, 1987.\t The<br \/>\n3rd  Respondent\t chose\tto challenge the  promotion  of\t the<br \/>\nAppellant as a Ticket Collector only on 11th December, 1987,<br \/>\ni.e.  after a period of 4 years.  On the ground of delay and<br \/>\nlatches\t also  the application of the 3rd Respondent  should<br \/>\nhave been dismissed.\n<\/p>\n<p id=\"p_16\">      In  this\tview of the matter the impugned Order  dated<br \/>\n11th  December,\t 1987 is set aside.  The Application of\t the@@<br \/>\n      JJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJ<br \/>\n3rd  Respondent\t before the Central Administrative  Tribunal@@<br \/>\nJJJ<br \/>\nstands dismissed.  The Order dated 22nd August, 1988, passed<br \/>\npursuant  of  the Order dated 11th December, 1987, which  we<br \/>\nhave set aside in this appeal cannot survive and is quashed.<br \/>\nThese  Appeals stand allowed accordingly.
