The appellant was<br \/>\nsentenced to undergo R.I for a period of ten years and to pay a fine<br \/>\nof Rs. 200\/-, in default, to undergo S.I for one month for the<br \/>\noffence punishable under <a href=\"\/doc\/1279834\/\" id=\"a_2\">Section 376<\/a> IPC. He was ordered to undergo<br \/>\nS.I for six months and to pay a fine of Rs. 200\/-, in default, S.I<br \/>\nfor one month, for the offence punishable under <a href=\"\/doc\/1011035\/\" id=\"a_3\">Section 323<\/a> IPC. Both<br \/>\nthe sentences were ordered to run concurrently.\n<\/p>\n<p id=\"p_1\">2.\tThe<br \/>\ncase of the prosecution, in short, is that the appellant is the<br \/>\nfoster-father of the victim, who is congenitally deaf and dumb.<br \/>\nAccording to the prosecution, her mother, the complainant, came to<br \/>\nreside with the appellant along with the victim, after the death of<br \/>\nher husband Rameshbhai. It is the case of the prosecution that the<br \/>\nappellant committed rape on the victim on various occasions, as a<br \/>\nresult of which, she became pregnant. Deviben, mother of the victim,<br \/>\ntherefore, lodged F.I.R., with the Navsari (Rural) Police Station on<br \/>\n25.5.2004 to the above effect, on the basis of which, offence was<br \/>\nregistered at C.R.No.I.91\/2004 and investigated. Upon investigation,<br \/>\npolice having found sufficient evidence, filed charge sheet against<br \/>\nthe appellant in the Court of learned J.M.F.C.,Navsari, who, in turn,<br \/>\ncommitted the case to the Court of Sessions and Sessions Case<br \/>\nNo.37\/2004 came to be registered.\n<\/p>\n<p id=\"p_2\">3.\tThe<br \/>\ncharge against the appellant was framed at Exh.2 for the offences<br \/>\npunishable under <a href=\"\/doc\/1279834\/\" id=\"a_4\">Sections 376<\/a>, <a href=\"\/doc\/1011035\/\" id=\"a_5\">323<\/a> &amp; <a href=\"\/doc\/180217\/\" id=\"a_6\">506(2)<\/a> of the Indian Penal<br \/>\nCode, to which the appellant-accused pleaded not guilty and claimed<br \/>\nto be tried.\n<\/p>\n<p id=\"p_3\">3.1\t\tAfter<br \/>\nconsidering the evidence led by the prosecution, the trial Court came<br \/>\nto the conclusion that the prosecution was successful in establishing<br \/>\nthe charges for the offences punishable under <a href=\"\/doc\/1279834\/\" id=\"a_7\">Sections 376<\/a> &amp; <a href=\"\/doc\/1011035\/\" id=\"a_8\">323<\/a><br \/>\nIPC and recorded conviction and sentence, as stated hereinabove. It<br \/>\nis against this judgment and order that this appeal is preferred by<br \/>\nthe convict.\n<\/p>\n<p id=\"p_4\">4.\tAfter<br \/>\nthe appeal was admitted, the State of Gujarat preferred Criminal<br \/>\nMisc.Application No.9120\/2005 before this Court, during the pendency<br \/>\nof this appeal, under <a href=\"\/doc\/782148\/\" id=\"a_9\">Section 391<\/a> of the Code of Criminal Procedure,<br \/>\npraying for a permission to lead additional evidence of the victim<br \/>\ngirl and direct the Sessions Court, Navsari to record her evidence<br \/>\nwith the help of an interpreter and certify such evidence to this<br \/>\nCourt so as to enable this Court to proceed to dispose of the appeal<br \/>\nfiled by the appellant. This Court, by order dated 10.8.2005, allowed<br \/>\nthe application and permitted the State to lead the additional<br \/>\nevidence of the victim girl. The learned Sessions Judge, Navsari was<br \/>\ndirected to record the evidence of the victim girl with the help of<br \/>\nan interpreter as early as possible, preferably, within two months<br \/>\nfrom the date of receipt of the writ of the Court, and after<br \/>\nrecording the evidence, certify the same to this Court as required<br \/>\nunder <a href=\"\/doc\/1339483\/\" id=\"a_10\">Section 391(2)<\/a> of the Code of Criminal Procedure so as to<br \/>\nenable this Court to proceed with the hearing of the appeal.\n<\/p>\n<p id=\"p_5\">5.\tAccordingly,<br \/>\nthe Sessions Court appointed one Radhaben Bharatbhai Nayak, who is a<br \/>\nteacher in the Deaf &amp; Dumb School of village Kachholi, as an<br \/>\ninterpreter and recorded the evidence of the prosecutrix at Exh.52<br \/>\nand certified the same to this Court.\n<\/p>\n<p id=\"p_6\">6.\tWe<br \/>\nhave heard learned advocate Mr.Shukla for the appellant, and learned<br \/>\nA.P.P. Mr.Bhatt for the respondent-State. We have also examined the<br \/>\nrecord and proceedings in the context of submissions made to us.\n<\/p>\n<p id=\"p_7\">7.\tThe<br \/>\nlearned advocate for the appellant submitted that the prosecution<br \/>\ncase is founded on a belated F.I.R. The F.I.R. is lodged after a<br \/>\nperiod of about 8 months. The medical evidence is Nil for<br \/>\nestablishing commission of either of the offences. The trial Court<br \/>\nhas not appreciated these aspects. It is also submitted by the<br \/>\nlearned advocate for the appellant that the prosecutrix was not<br \/>\nstaying with the appellant alone, but, used to go to the house of<br \/>\nP.W.2 and stay there also and, therefore, the conviction is recorded<br \/>\nwithout taking into consideration this aspect. The appeal may,<br \/>\ntherefore, be allowed.\n<\/p>\n<p id=\"p_8\">8.\tOn<br \/>\nthe other hand, the learned A.P.P. has opposed this appeal. According<br \/>\nto him, the appellant took undue advantage of his fiduciary position<br \/>\nas the foster-father as against the prosecutrix. The prosecutrix is a<br \/>\nyoung girl, both deaf and dumb, who has lost her father and could not<br \/>\nhave mustered enough courage to expose her foster-father and,<br \/>\ntherefore, the incident was detected only upon the prosecutrix<br \/>\nbecoming pregnant.\n<\/p>\n<p id=\"p_9\">8.1\t\tThe<br \/>\nlearned A.P.P. submitted that the FIR is given by the mother of the<br \/>\nprosecutrix, who is none-else, but, the wife of the appellant. Even<br \/>\nthe deposition of the prosecutrix, if read in its entirety,<br \/>\nimplicates the appellant. Therefore, at this stage, there is<br \/>\nadditional material in the form of deposition of the prosecutrix to<br \/>\nshow the involvement of the appellant in the offence. The Court,<br \/>\ntherefore, may not interfere with the conviction recorded by the<br \/>\nTrial Court and the appeal may be dismissed.\n<\/p>\n<p id=\"p_10\">9.\tWe<br \/>\nare faced with a very peculiar case, where a deaf and dumb girl is<br \/>\nsexually exploited by her foster-father. The mother of the<br \/>\nprosecutrix, i.e., complainant, says that on noticing the girl to be<br \/>\npregnant, she inquired from her as to who was responsible for her<br \/>\npregnancy, who, by finger sign, pointed at the appellant. She then<br \/>\nasked the appellant about the same and he, in turn, told the truth.<br \/>\nHe said that let the girl deliver the child and he would rear the<br \/>\nchild. Thereafter, the appellant started beating them and intimidated<br \/>\nthem  asking them not to disclose to anyone-else. The witness has<br \/>\nbeen cross-examined at length, but, nothing material emerges<br \/>\ntherefrom.\n<\/p>\n<p id=\"p_11\">9.1\t\tP.W.2<br \/>\nis Ukabhai Ravjibhai Halpati, who is examined at Exh.8. He happens to<br \/>\nbe the brother-in-law of Deviben, the first informant. He is a<br \/>\npostman. He says that there was a quarrel between the first informant<br \/>\nand the appellant on 24th. The first informant told him<br \/>\nthat the dispute was because of the pregnancy of the victim. He says<br \/>\nthat later on the prosecutrix delivered a male child, who expired on<br \/>\nthe next day.\n<\/p>\n<p id=\"p_12\">9.2\t\tPushpaben<br \/>\nHarishbhai Balsara (Exh.9) is  a neighbour. She says that Deviben had<br \/>\ntold her that the victim is pregnant and she had advised her to go to<br \/>\na good doctor.\n<\/p>\n<p id=\"p_13\">9.3\t\tRameshbhai<br \/>\nBabarbhai (Exh.10) says that he knows the appellant and the appellant<br \/>\nhad come to him for borrowing Rs.500\/- saying that the victim is<br \/>\npregnant.\n<\/p>\n<p id=\"p_14\">10.\tThe<br \/>\ndeposition of the prosecutrix, recorded at Exh.52, is the most<br \/>\nimportant piece of evidence, which clearly implicates the appellant.<br \/>\nShe has given replies  in sign language. She implicates the appellant<br \/>\nby gestures of establishing physical relationship with her during<br \/>\nnight, as a result of which, she became pregnant and delivered a<br \/>\nchild. She has been cross-examined, but, nothing special emerges.\n<\/p>\n<p id=\"p_15\">11.\tIn<br \/>\nour view, the evidence proves that upon the prosecutrix becoming<br \/>\npregnant, there was a quarrel between the appellant and his wife,<br \/>\nfirst informant Deviben, and pursuant thereto, he assaulted her also.\n<\/p>\n<p id=\"p_16\">11.1\t\tThere<br \/>\nis evidence that the appellant took undue advantage of his fiduciary<br \/>\nposition and established physical relationship with the prosecutrix,<br \/>\nwho was about 16 years of age, as a result of which, she became<br \/>\npregnant. The prosecutrix is a congenitally deaf and dumb girl. She<br \/>\nhad lost her father and was staying with the appellant, her<br \/>\nfoster-father. Obviously, she could not have mustered enough courage<br \/>\nto expose the exploitation  by the appellant. But, when she herself<br \/>\nis exposed by pregnancy and is asked as to who was responsible for<br \/>\nthe pregnancy, she had to disclose the fact. The evidence led by the<br \/>\nprosecution, particularly the evidence of prosecutrix, is consistent<br \/>\nand has ring of truth in it.\n<\/p>\n<p id=\"p_17\">12.\tIn<br \/>\nthe light of the above discussion, we have no reason to disbelieve<br \/>\nthe evidence of the victim herself. The delay in lodging the<br \/>\ncomplaint deserves to be condoned. Considering the mental position of<br \/>\nthe prosecutrix, the delay is justified. She has no reason to falsely<br \/>\nimplicate the appellant. The complainant also has no reason to<br \/>\nfalsely implicate the appellant, her husband. Therefore, in our<br \/>\nopinion, the conviction recorded by the trial Court does not call for<br \/>\nany interference. The appeal must fail. Stands  dismissed.\n<\/p>\n<p id=\"p_18\">\t\t\t\t\t\t\t[<br \/>\nA.L.
