\tThe
\nappellant, in this appeal, came to be convicted by the Sessions
\nCourt, Navsari, for the offences punishable under Sections 376<\/a> &
\n323<\/a> of the Indian Penal Code, by judgment rendered in Sessions Case
\nNo.37\/2004 on 28th October, 2004. The appellant was
\nsentenced to undergo R.I for a period of ten years and to pay a fine
\nof Rs. 200\/-, in default, to undergo S.I for one month for the
\noffence punishable under Section 376<\/a> IPC. He was ordered to undergo
\nS.I for six months and to pay a fine of Rs. 200\/-, in default, S.I
\nfor one month, for the offence punishable under Section 323<\/a> IPC. Both
\nthe sentences were ordered to run concurrently.\n<\/p>\n
2.\tThe
\ncase of the prosecution, in short, is that the appellant is the
\nfoster-father of the victim, who is congenitally deaf and dumb.
\nAccording to the prosecution, her mother, the complainant, came to
\nreside with the appellant along with the victim, after the death of
\nher husband Rameshbhai. It is the case of the prosecution that the
\nappellant committed rape on the victim on various occasions, as a
\nresult of which, she became pregnant. Deviben, mother of the victim,
\ntherefore, lodged F.I.R., with the Navsari (Rural) Police Station on
\n25.5.2004 to the above effect, on the basis of which, offence was
\nregistered at C.R.No.I.91\/2004 and investigated. Upon investigation,
\npolice having found sufficient evidence, filed charge sheet against
\nthe appellant in the Court of learned J.M.F.C.,Navsari, who, in turn,
\ncommitted the case to the Court of Sessions and Sessions Case
\nNo.37\/2004 came to be registered.\n<\/p>\n
3.\tThe
\ncharge against the appellant was framed at Exh.2 for the offences
\npunishable under Sections 376<\/a>, 323<\/a> & 506(2)<\/a> of the Indian Penal
\nCode, to which the appellant-accused pleaded not guilty and claimed
\nto be tried.\n<\/p>\n
3.1\t\tAfter
\nconsidering the evidence led by the prosecution, the trial Court came
\nto the conclusion that the prosecution was successful in establishing
\nthe charges for the offences punishable under Sections 376<\/a> & 323<\/a>
\nIPC and recorded conviction and sentence, as stated hereinabove. It
\nis against this judgment and order that this appeal is preferred by
\nthe convict.\n<\/p>\n
4.\tAfter
\nthe appeal was admitted, the State of Gujarat preferred Criminal
\nMisc.Application No.9120\/2005 before this Court, during the pendency
\nof this appeal, under Section 391<\/a> of the Code of Criminal Procedure,
\npraying for a permission to lead additional evidence of the victim
\ngirl and direct the Sessions Court, Navsari to record her evidence
\nwith the help of an interpreter and certify such evidence to this
\nCourt so as to enable this Court to proceed to dispose of the appeal
\nfiled by the appellant. This Court, by order dated 10.8.2005, allowed
\nthe application and permitted the State to lead the additional
\nevidence of the victim girl. The learned Sessions Judge, Navsari was
\ndirected to record the evidence of the victim girl with the help of
\nan interpreter as early as possible, preferably, within two months
\nfrom the date of receipt of the writ of the Court, and after
\nrecording the evidence, certify the same to this Court as required
\nunder Section 391(2)<\/a> of the Code of Criminal Procedure so as to
\nenable this Court to proceed with the hearing of the appeal.\n<\/p>\n
5.\tAccordingly,
\nthe Sessions Court appointed one Radhaben Bharatbhai Nayak, who is a
\nteacher in the Deaf & Dumb School of village Kachholi, as an
\ninterpreter and recorded the evidence of the prosecutrix at Exh.52
\nand certified the same to this Court.\n<\/p>\n
6.\tWe
\nhave heard learned advocate Mr.Shukla for the appellant, and learned
\nA.P.P. Mr.Bhatt for the respondent-State. We have also examined the
\nrecord and proceedings in the context of submissions made to us.\n<\/p>\n
7.\tThe
\nlearned advocate for the appellant submitted that the prosecution
\ncase is founded on a belated F.I.R. The F.I.R. is lodged after a
\nperiod of about 8 months. The medical evidence is Nil for
\nestablishing commission of either of the offences. The trial Court
\nhas not appreciated these aspects. It is also submitted by the
\nlearned advocate for the appellant that the prosecutrix was not
\nstaying with the appellant alone, but, used to go to the house of
\nP.W.2 and stay there also and, therefore, the conviction is recorded
\nwithout taking into consideration this aspect. The appeal may,
\ntherefore, be allowed.\n<\/p>\n
8.\tOn
\nthe other hand, the learned A.P.P. has opposed this appeal. According
\nto him, the appellant took undue advantage of his fiduciary position
\nas the foster-father as against the prosecutrix. The prosecutrix is a
\nyoung girl, both deaf and dumb, who has lost her father and could not
\nhave mustered enough courage to expose her foster-father and,
\ntherefore, the incident was detected only upon the prosecutrix
\nbecoming pregnant.\n<\/p>\n
8.1\t\tThe
\nlearned A.P.P. submitted that the FIR is given by the mother of the
\nprosecutrix, who is none-else, but, the wife of the appellant. Even
\nthe deposition of the prosecutrix, if read in its entirety,
\nimplicates the appellant. Therefore, at this stage, there is
\nadditional material in the form of deposition of the prosecutrix to
\nshow the involvement of the appellant in the offence. The Court,
\ntherefore, may not interfere with the conviction recorded by the
\nTrial Court and the appeal may be dismissed.\n<\/p>\n
9.\tWe
\nare faced with a very peculiar case, where a deaf and dumb girl is
\nsexually exploited by her foster-father. The mother of the
\nprosecutrix, i.e., complainant, says that on noticing the girl to be
\npregnant, she inquired from her as to who was responsible for her
\npregnancy, who, by finger sign, pointed at the appellant. She then
\nasked the appellant about the same and he, in turn, told the truth.
\nHe said that let the girl deliver the child and he would rear the
\nchild. Thereafter, the appellant started beating them and intimidated
\nthem  asking them not to disclose to anyone-else. The witness has
\nbeen cross-examined at length, but, nothing material emerges
\ntherefrom.\n<\/p>\n
9.1\t\tP.W.2
\nis Ukabhai Ravjibhai Halpati, who is examined at Exh.8. He happens to
\nbe the brother-in-law of Deviben, the first informant. He is a
\npostman. He says that there was a quarrel between the first informant
\nand the appellant on 24th. The first informant told him
\nthat the dispute was because of the pregnancy of the victim. He says
\nthat later on the prosecutrix delivered a male child, who expired on
\nthe next day.\n<\/p>\n
9.2\t\tPushpaben
\nHarishbhai Balsara (Exh.9) is  a neighbour. She says that Deviben had
\ntold her that the victim is pregnant and she had advised her to go to
\na good doctor.\n<\/p>\n
9.3\t\tRameshbhai
\nBabarbhai (Exh.10) says that he knows the appellant and the appellant
\nhad come to him for borrowing Rs.500\/- saying that the victim is
\npregnant.\n<\/p>\n
10.\tThe
\ndeposition of the prosecutrix, recorded at Exh.52, is the most
\nimportant piece of evidence, which clearly implicates the appellant.
\nShe has given replies  in sign language. She implicates the appellant
\nby gestures of establishing physical relationship with her during
\nnight, as a result of which, she became pregnant and delivered a
\nchild. She has been cross-examined, but, nothing special emerges.\n<\/p>\n
11.\tIn
\nour view, the evidence proves that upon the prosecutrix becoming
\npregnant, there was a quarrel between the appellant and his wife,
\nfirst informant Deviben, and pursuant thereto, he assaulted her also.\n<\/p>\n
11.1\t\tThere
\nis evidence that the appellant took undue advantage of his fiduciary
\nposition and established physical relationship with the prosecutrix,
\nwho was about 16 years of age, as a result of which, she became
\npregnant. The prosecutrix is a congenitally deaf and dumb girl. She
\nhad lost her father and was staying with the appellant, her
\nfoster-father. Obviously, she could not have mustered enough courage
\nto expose the exploitation  by the appellant. But, when she herself
\nis exposed by pregnancy and is asked as to who was responsible for
\nthe pregnancy, she had to disclose the fact. The evidence led by the
\nprosecution, particularly the evidence of prosecutrix, is consistent
\nand has ring of truth in it.\n<\/p>\n
12.\tIn
\nthe light of the above discussion, we have no reason to disbelieve
\nthe evidence of the victim herself. The delay in lodging the
\ncomplaint deserves to be condoned. Considering the mental position of
\nthe prosecutrix, the delay is justified. She has no reason to falsely
\nimplicate the appellant. The complainant also has no reason to
\nfalsely implicate the appellant, her husband. Therefore, in our
\nopinion, the conviction recorded by the trial Court does not call for
\nany interference. The appeal must fail. Stands  dismissed.\n<\/p>\n
