The learned Small Cause Judge<br \/>\n\tapplied the criteria of 7% p.a. and  has fixed the GRV of the<br \/>\n\tpremises as referred in the impugned order for the respective year.<br \/>\n\tUnder he circumstances, the present appeals.\n<\/p>\n<p id=\"p_2\">The<br \/>\n\tlearned counsel appearing for the appellant as well as Mr.I.A.<br \/>\n\tPatel, appearing in First Appeal No.1260\/04 submit that the issues<br \/>\n\twhich arise for consideration were required to be considered by the<br \/>\n\tlearned Small Cause Judge in light of the decision of this Court in<br \/>\n\tthe case of Ahmedabad Municipal Corporation Vs. Dena Bank reported<br \/>\n\tat 2004(2) GLR 1117 and therefore, they submitted that the matter<br \/>\n\tmay be remanded.  It was also submitted that the learned Judge has<br \/>\n\tnot recorded the detailed reasons casewise and has only filled up<br \/>\n\tthe blanks by the draft order.  The other respondents are served but<br \/>\n\tnone appears on their behalf.\n<\/p>\n<p id=\"p_3\">Considering<br \/>\n\tthe facts and circumstances, it appears that the questions which<br \/>\n\tarise were required to be considered in light of the decision of<br \/>\n\tthis Court in the case of Ahmedabad Municipal Corporation (supra)<br \/>\n\tbut they have not been considered.  Hence, all the impugned orders<br \/>\n\tare quashed and set aside with the direction that the concerned<br \/>\n\tappeal shall stand restored to the file and the learned Judge shall<br \/>\n\tdecide the matter in light of the principles laid down by this Court<br \/>\n\tin the case of Ahmedabad Municipal Corporation (supra) and shall<br \/>\n\trender the decision as early as possible, preferably within a period<br \/>\n\tof one year from the receipt of the order of this Court.\n<\/p>\n<p id=\"p_4\">Appeals<br \/>\n\tare allowed to the aforesaid extent.
