DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tIn<br \/>\n\tthis application filed by the applicant a prayer is made to modify<br \/>\n\tcondition No.[f] of Paragraph 7 of the order passed in Criminal<br \/>\n\tMiscellaneous Application No.1985\/2004 dated 01.03.2004 and to<br \/>\n\treturn the passport for a period of four months, already deposited<br \/>\n\tin the concerned Court.\n<\/p>\n<p id=\"p_1\">\tLearned<br \/>\n\tAdvocate for the applicant submits that the son of the applicant is<br \/>\n\tsettled in Canada and at the same time, the applicant would like to<br \/>\n\tvisit United States of America (U.S.A.) with his family and needs to<br \/>\n\tapply for visa of both the countries and therefore, the passport<br \/>\n\tdeposited in the Trial Court be returned or appropriate directions<br \/>\n\tbe given.  It is further submitted that the applicant has filed an<br \/>\n\tadditional affidavit dated 16.07.2011 in which various dates of<br \/>\n\tlisting of the case is mentioned and the applicant further<br \/>\n\tundertakes to return, if permission is granted by this Court.  In<br \/>\n\tthe past, on a number of occasions, the applicant was permitted to<br \/>\n\tapply for the visa and passport was returned by imposing suitable<br \/>\n\tconditions.\n<\/p>\n<p id=\"p_2\">\tI<br \/>\n\thave heard learned APP Mrs. Manisha L. Shah for the respondent &#8211;<br \/>\n\tState.\n<\/p>\n<p id=\"p_3\">\tConsidering<br \/>\n\toverall facts and circumstances and record produced by the applicant<br \/>\n\talongwith this application and additional affidavit dated 16.07.2011<br \/>\n\tfiled by him, I am inclined to accept the prayer of the applicant<br \/>\n\tand condition No.[f] of Paragraph 7 of the order dated 01.03.2004<br \/>\n\tpassed in  Criminal Miscellaneous Application No.1985\/2004 is<br \/>\n\tmodified to the extent that the passport of the applicant be<br \/>\n\treturned on submission of an appropriate application before the<br \/>\n\tTrial Court, within a week from the date of such of an application,<br \/>\n\ton furnishing an Undertaking to the extent that if the applicant is<br \/>\n\tgranted visa, by the concerned Consulate of the countries, the<br \/>\n\tapplicant would return to the country within a month after the<br \/>\n\tdeparture.  If such an application is submitted before the Trial<br \/>\n\tCourt, on depositing an amount of Rs.25,000\/=, the passport be<br \/>\n\treturned by the Trial Court and on return from the U.S.A. \/ Canada,<br \/>\n\tthe applicant shall deposit the passport.\n<\/p>\n<p id=\"p_4\">\tAccordingly,<br \/>\n\tthis Application is allowed to the aforesaid extent.
