PRASAD.\n                                                       ------- OPPOSITE PARTIES.\n                                           -----------\n<\/pre>\n<p id=\"p_1\">2.   03.12.2010                No one appears on behalf of the petitioners.<\/p>\n<p id=\"p_1\">                               The petitioners have sought quashing of the entire<\/p>\n<p>                    proceeding including the order dated 12.8.2009 passed by<\/p>\n<p>                    Judicial Magistrate, 1st Class, Patna, in Complaint Case No.<\/p>\n<p>                    1538(C) of 2009 in which cognizance was taken under <a href=\"\/doc\/1011035\/\" id=\"a_1\">Sections<\/p>\n<p>                    323<\/a> and <a href=\"\/doc\/180217\/\" id=\"a_1\">506<\/a> of the Indian Penal Code.\n<\/p>\n<p id=\"p_2\">                               The background of the case is that the Complainant<\/p>\n<p>                    was married to the accused Prity Kumari but some dispute<\/p>\n<p>                    arose between them on account of which his wife committed<\/p>\n<p>                    theft of some articles and the Complainant was also assaulted<\/p>\n<p>                    in the process.\n<\/p>\n<p id=\"p_3\">                               Considering the nature of allegations and the<\/p>\n<p>                    absurdity of the same, I am inclined to allow the application.<\/p>\n<p id=\"p_4\">                               In view of such, the entire proceeding of Complaint<\/p>\n<p>                    Case No. 1538 (C) of 2009 including the order dated 12.8.2009<\/p>\n<p>                    pending before the Judicial Magistrate, 1st Class, Patna, is<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             2<\/span><\/p>\n<p>        hereby set aside.\n<\/p>\n<p id=\"p_5\">                  The application stands allowed.\n<\/p>\n<p id=\"p_6\">\n<p id=\"p_7\">                                ( Anjana Prakash, J.)<br \/>\nS.Ali\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Santosh Kumar &amp;Amp; Anr vs State Of Bihar &amp;Amp; Anr on 3 December, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
