JUSTICE NARENDRA NATH TIWARI\n<\/p>\n<p id=\"p_1\">                                     &#8212;&#8212;<\/p>\n<pre id=\"pre_1\">\n           For the Petitioner :       Mr. Sunil Kumar, Advocate,\n           For the State       :      A.P.P.\n                                     ------\n           Reserved on 11.12.2008                    Delivered on 18.12.2008\n                                      ORDER\n<\/pre>\n<p id=\"p_2\">Narendra Nath Tiwari, J.: In this petition, the petitioner has prayed for<br \/>\n           quashing the order dated 28th March, 2005, whereby learned<br \/>\n           Chief Judicial Magistrate, Ranchi has taken cognizance against<br \/>\n           the petitioner for the offences under <a href=\"\/doc\/1326844\/\" id=\"a_1\">Sections 409<\/a>, <a href=\"\/doc\/1436241\/\" id=\"a_1\">420<\/a> and <a href=\"\/doc\/37788\/\" id=\"a_2\">34<\/a> of<br \/>\n           the Indian Penal Code. He has further prayed for quashing the<br \/>\n           order dated 2nd March, 2007, whereby learned Sub Divisional<br \/>\n           Judicial Magistrate, Ranchi has rejected the application filed by<br \/>\n           the petitioner under <a href=\"\/doc\/897083\/\" id=\"a_3\">Section 239<\/a> of the Code of Criminal<br \/>\n           Procedure.\n<\/p>\n<p id=\"p_3\">           2.    Prosecution case is that the informant as well as other<br \/>\n           eight girls, who had been studying at M. M. Public Welfare<br \/>\n           School and College, whose names are mentioned in the first<br \/>\n           information report, had deposited Rs.3,012\/-, each, against<br \/>\n           admission fee, registration fee, promotion test fee, forwarding<br \/>\n           charge, examination fee form and annual fee of two years. They<br \/>\n           were told by the Principal that the admit cards would be<br \/>\n           handed over to them in time for appearing in the Intermediate<br \/>\n           Examination. But when the complainant and others went to get<br \/>\n           their admit cards for appearing in the Intermediate Examination,<br \/>\n           admit cards were not issued to them. The victim students were,<br \/>\n           thus, prevented from appearing in the examination, which has<br \/>\n           adversely affected their future career. It has been alleged that<br \/>\n           the Principal of the said school has committed offence of<br \/>\n           breach of trust and cheating.\n<\/p>\n<p id=\"p_4\">           3.    Learned counsel appearing on behalf of the petitioner<br \/>\n           submitted that the entire allegations are false and baseless. The<br \/>\n           materials available on record are not sufficient for taking<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                           2                   Cr.M.P.No.540 of 2005<\/span><\/p>\n<p>cognizance of the offences under <a href=\"\/doc\/1326844\/\" id=\"a_4\">Sections 409<\/a> and <a href=\"\/doc\/1436241\/\" id=\"a_5\">420<\/a> of the<br \/>\nIndian Penal Code, but in spite of the above, charges have<br \/>\nbeen framed and the petitioner&#8217;s application under <a href=\"\/doc\/897083\/\" id=\"a_6\">Section 239<\/a><br \/>\nCr.P.C. has been erroneously rejected.\n<\/p>\n<p id=\"p_5\">4.    I have heard learned counsel for the parties and<br \/>\nconsidered the facts and material on record as well as the<br \/>\nsubmissions made by learned counsel for the parties.\n<\/p>\n<p id=\"p_6\">5.    Learned counsel for the petitioner submitted that the<br \/>\nallegations made in the first information report are wholly false,<br \/>\nbaseless and that no offence much less offences under <a href=\"\/doc\/1326844\/\" id=\"a_7\">Sections<br \/>\n409<\/a> and <a href=\"\/doc\/1436241\/\" id=\"a_8\">420<\/a> of the Indian Penal Code is made out against the<br \/>\npetitioner. Learned court below has not properly considered the<br \/>\npoints raised before him and has erroneously rejected the<br \/>\napplication filed under <a href=\"\/doc\/897083\/\" id=\"a_9\">Section 239<\/a> Cr.P.C.\n<\/p>\n<p id=\"p_7\">6.    Learned counsel referred to and relied on the decision of<br \/>\nthe Hon&#8217;ble Supreme Court in the case of State of Haryana &amp;<br \/>\nOrs. Vs. Bhajan Lal &amp; Ors. [1992 Supp (1) SCC 335] and submitted<br \/>\nthat where the allegations made in the first information report or<br \/>\nthe complaint, even if they are taken at their face value and<br \/>\naccepted in their entirety do not prima facie constitute any<br \/>\noffence or make out a case against the accused, the same are<br \/>\nliable to be quashed. Such situation comes within the category<br \/>\nof the case wherein the extraordinary power under <a href=\"\/doc\/1712542\/\" id=\"a_10\">Article 226<\/a> or<br \/>\nthe inherent power under <a href=\"\/doc\/1679850\/\" id=\"a_11\">Section 482<\/a> Cr.P.C. can be exercised<br \/>\nby the High Court either to prevent abuse of the process of Court<br \/>\nor otherwise to secure the ends of justice.      Learned counsel<br \/>\nfurther relied on the decision of the Hon&#8217;ble Supreme Court in<br \/>\nthe case of Inder Mohan Goswami &amp; Anr. Vs. State of Uttaranchal<br \/>\n&amp; Ors. [(2007)12 SCC 1] and submitted that the power possessed<br \/>\nby the High Court under <a href=\"\/doc\/1679850\/\" id=\"a_12\">Section 482<\/a> Cr.P.C. is very wide and the<br \/>\nvery plentitude of the power requires great caution in its<br \/>\nexercise. The Court must be careful to see that its decision in<br \/>\nexercise of this power is based on sound principles.\n<\/p>\n<p id=\"p_8\">7.    In that decision, the Apex Court has further held that the<br \/>\ninherent power should not be exercised to stifle a legitimate<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                            3                   Cr.M.P.No.540 of 2005<\/span><\/p>\n<p>prosecution. The High Court should normally refrain from giving a<br \/>\nprima facie decision in a case where all the facts are<br \/>\nincomplete and hazy, more so, when the evidence has not<br \/>\nbeen collected and produced before the Court and the issues<br \/>\ninvolved, whether factual or legal, are of such magnitude that<br \/>\nthey cannot be seen in their true perspective without sufficient<br \/>\nmaterial. Of course, no hard-and-fast rule can be laid down in<br \/>\nregard to cases in which the High Court will exercise its<br \/>\nextraordinary jurisdiction of quashing the proceedings at any<br \/>\nstage.\n<\/p>\n<p id=\"p_9\">8.    Learned counsel submitted that in the case of Inder<br \/>\nMohan Goswami (Supra), the Supreme Court has set aside the<br \/>\norder of the High Court which had refused to quash the criminal<br \/>\nproceeding initiated against the petitioner on the ground that<br \/>\nthe dispute, in question, was purely in civil nature and the<br \/>\nRespondent no.3 has already filed a civil suit in the court of Civil<br \/>\nJudge. In that circumstance, initiation of criminal proceeding by<br \/>\nthe respondents against the petitioner was held to be an abuse<br \/>\nof process of the Court.\n<\/p>\n<p id=\"p_10\">9.    Learned    A.P.P.,   on   the   other   hand,   opposed      the<br \/>\npetitioner&#8217;s prayer and submitted that the principles laid down in<br \/>\nthe cases of Bhajan Lal (Supra) and Inder Mohan Goswami<br \/>\n(Supra) have got no application to the facts of the instant case.<br \/>\nThe ground taken by the petitioner that the allegations made in<br \/>\nthe first information report are wholly false and baseless and the<br \/>\nsame do not constitute the alleged offences against him is<br \/>\nrequired to be proved by adducing evidences before the Trial<br \/>\nCourt. Learned court below has considered the facts and<br \/>\nmaterials available on record and has come to the finding that<br \/>\nthere are sufficient materials for taking cognizance of the said<br \/>\noffences against the petitioner. This Court in exercise of its<br \/>\njurisdiction under <a href=\"\/doc\/1679850\/\" id=\"a_13\">Section 482<\/a> Cr.P.C. cannot take evidences or<br \/>\nappraise the same. The disputed factual allegations are to be<br \/>\nadjudicated upon and decided by the trial court on the basis of<br \/>\nthe evidences brought before the said Court.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                         4                     Cr.M.P.No.540 of 2005<\/span><\/p>\n<p id=\"p_11\">              10.   After considering the submissions and the facts and<br \/>\n              materials on record, I find substance in the submissions made by<br \/>\n              learned A.P.P. The petitioner has no case that even if the first<br \/>\n              information report is taken at its face value any penal offence is<br \/>\n              not constituted. The petitioner has taken defence that the<br \/>\n              allegations are false and that he (the Principal) never took<br \/>\n              money, causing any harm to the students. Those points raised by<br \/>\n              the petitioner are to be scrutinized on the basis of the evidences<br \/>\n              brought before the court below after its due appraisal and<br \/>\n              consideration. Learned Court below has considered the facts<br \/>\n              and grounds taken by the petitioner in his application under<br \/>\n              <a href=\"\/doc\/897083\/\" id=\"a_14\">Section 239<\/a> Cr.P.C. and after due discussion and consideration<br \/>\n              has rejected the same. The order is well discussed and supported<br \/>\n              by valid reasons. I find no legal ground for interference with the<br \/>\n              impugned order.\n<\/p>\n<p id=\"p_12\">              11.   In the facts and circumstances of the case, the decisions<br \/>\n              referred to and relied upon by the petitioner have got no<br \/>\n              application to the facts of the present case.\n<\/p>\n<p id=\"p_13\">              12.
