Shubhakar Kumar Choudhary\n                                      Versus\n                                 The STATE OF BIHAR\n                                      ------\n<\/pre>\n
2\/      17\/09\/2010               Heard learned counsel for the petitioners and learned<\/p>\n
                     counsel for the State.\n<\/p>\n
                                 Petitioner no.1 is alleged for causing assault by means of<\/p>\n
                     fersa on informant’s head, while petitioners no.2 and 3 are alleged<\/p>\n
                     for causing assault by means of lathi but only two injuries are found<\/p>\n
                     on person of the informant, one on head simple in nature and<\/p>\n
                     another on arm that is grievous may not be taken for intention to kill<\/p>\n
                     for refusal of anticipatory bail.\n<\/p>\n
                                 Considering the facts and circumstances of the case,<\/p>\n
                     prayer of the petitioners is allowed.\n<\/p>\n
                                 In the event of arrest or surrender within one month<\/p>\n
                     from the date of receipt\/production of a copy of this order in<\/p>\n
                     connection with Shambhuganj P.S. Case No. 40 of 2010 above<\/p>\n
                     named petitioners shall be released on bail on furnishing bail bond<\/p>\n
                     of Rs. 10,000\/- (ten thousand) each with two sureties of the like<\/p>\n
                     amount each to the satisfaction of C.J.M., Banka subject to the<\/p>\n
                     conditions as laid down under Section 438(2)<\/a> of Cr. P.C.<\/p>\n
