Appeal No.96 of 2001 qua<br \/>\n\tregistration of M.Case No.1 of 2007 with Raopura Police Station,<br \/>\n\tVadodara against the appellants. Order passed by the learned<br \/>\n\tPrincipal District Judge, Vadodara on 31-7-2007 in Civil Misc.<br \/>\n\tAppeal No.96 of 2001 reads as under:\n<\/p>\n<p id=\"p_1\">\t This<br \/>\n\tMisc.Civil Appeal No.96 of 2001 is allowed, and the impugned order<br \/>\n\tdated 10-4-2001 passed by the learned Trial Judge below application<br \/>\n\t(Exh.5) in Rent Suit No.105 of 2001 is hereby set aside.\n<\/p>\n<p id=\"p_2\">\tThe<br \/>\n\trespondent\/defendant no.1 Bankimchandra A.Jhaveri who has obtained<br \/>\n\tpossession of the rented premises more particularly described in<br \/>\n\tpara:4(2) of the plaint of Rent Suit No.534\/1986 I.e. Southern<br \/>\n\tPortion, under the guise of the consent decree fraudulently, is<br \/>\n\thereby directed to hand over the possession of the said portion of<br \/>\n\tthe property in question to the appellant\/plaintiff  Dharam No<br \/>\n\tKanto  immediately, and with a view to avoid any unnecessary<br \/>\n\tconflicts between the parties, Mr.M.I.Ghanchi, Additional Registrar<br \/>\n\tof the District Court, Vadodara is hereby appointed as  Court<br \/>\n\tCommmissioner  who in presence of the panch witnesses shall<br \/>\n\tcomplete the process for handing over peaceful possession of that<br \/>\n\tportion to the appellant\/plaintiff latest by tomorrow 11.00 a.m. In<br \/>\n\tcase of necessity, the Court Commissioner is at liberty to get<br \/>\n\tpolice protection, as and when required. The office is directed to<br \/>\n\tissue Commission Patra as well as Yadi to police station concerned<br \/>\n\timmediately.\n<\/p>\n<p id=\"p_3\">\tAs<br \/>\n\tthe present respondents\/original defendants had obtained the consent<br \/>\n\tdecree in Rent Suit No.518\/2000 fraudulently by making false<br \/>\n\tdeclaration knowing fully well it is to be false, the present<br \/>\n\tRegistrar of the Small Causes Court is hereby directed to lodge a<br \/>\n\tcomplaint on behalf of the  Court  against the present<br \/>\n\trespondents (original defendants of Rent Suit No.518\/2000) before<br \/>\n\tthe Court having jurisdiction for the offence punishable U\/Secs.199,<br \/>\n\t200, 208, 209 and 210<a href=\"\/doc\/1569253\/\" id=\"a_1\"> of the Indian Penal Code<\/a> taking help of<br \/>\n\tlearned Government Pleader for drafting the Complaint and to report<br \/>\n\tto this Court latest by 4th August, 2007.\n<\/p>\n<p id=\"p_4\">\tThe<br \/>\n\trespondents\/original defendants shall pay Rs.1000\/- to the<br \/>\n\tAppellant\/plaintiffs towards Special Cost to this Misc.Civil<br \/>\n\tAppeal.\n<\/p>\n<p id=\"p_5\">The<br \/>\n\tcase in short is that the present respondent No.3-original plaintiff<br \/>\n\tfiled Rent Suit No.105 of 2001 before the Small Causes Court,<br \/>\n\tBaroda,  together with an injunction application at Ex.5. Learned<br \/>\n\tSmall Causes Court however has rejected the said application. Said<br \/>\n\torder was challenged before the learned District Judge by filing<br \/>\n\tCivil Misc. Appeal No.96 of 2001.  In the said appeal, learned<br \/>\n\tDistrict Judge found that the original defendant obtained a consent<br \/>\n\tdecree in Rent Suit No.18 of 2000 fraudulently by making a false<br \/>\n\tdeclaration knowing fully well it to be false. Hence, the Appellate<br \/>\n\tCourt passed order to lodge complaint by the Registrar of Small<br \/>\n\tCauses Court against the present appellants-original defendants in<br \/>\n\tRent Suit No.105 of 2001.\n<\/p>\n<p id=\"p_6\">Heard<br \/>\n\tlearned advocate, Mr.Asim Pandya for M\/s H.L.Patel Advocates for the<br \/>\n\tappellants and learned APP, Mr.K.P.Raval for the respondents Nos.1<br \/>\n\tand 2. None appeared on behalf of the respondent No.3.\n<\/p>\n<p id=\"p_7\">It<br \/>\n\tis vehemently argued by learned advocate, Mr.Asim Pandya, for the<br \/>\n\tappellants that Civil Misc. Appeal was preferred against the interim<br \/>\n\torder passed below injunction application and so, till the suit is<br \/>\n\tfinally decided, the Appellate Court has no jurisdiction to pass<br \/>\n\torder to lodge the complaint against the present appellants. It is<br \/>\n\tfurther submitted that the matter is settled between the parties and<br \/>\n\tcompromise pursis was also placed on record by the plaintiff&#8217;s<br \/>\n\tadvocate on which the original defendants have also made endorsement<br \/>\n\tthat possession of the disputed shop was handed over to the present<br \/>\n\trespondent No.3 and so also, no criminal prosecution could have been<br \/>\n\t initiated against the present appellants. It is also submitted that<br \/>\n\tfirst of all the Court has to be satisfied as to whether fraud was<br \/>\n\tcommitted for obtaining the decree, then only, the Court can pass<br \/>\n\torder to lodge complaint after following due procedure of law under<br \/>\n\tthe <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>. Same is not followed by the learned Judge and while<br \/>\n\tdeciding the appeal against the order passed below injunction<br \/>\n\tapplication, learned Appellate Judge without following due procedure<br \/>\n\tof law of holding inquiry, ordered to lodge the complaint, which is<br \/>\n\tprima facie illegal and hence also, the order is required to be<br \/>\n\tquashed and set aside.\n<\/p>\n<p id=\"p_8\">This<br \/>\n\tCourt has gone through the order passed by the learned Appellate<br \/>\n\tJudge. The Appellate Court has found that the present appellant<br \/>\n\tNo.1-original defendant No.1 has obtained consent decree in Rent<br \/>\n\tSuit No.518 of 2000 fraudulently. As far as Rent Suit No.518 of 2000<br \/>\n\tis concerned, it is finally decided by the Small Causes Court.\n<\/p>\n<p id=\"p_9\">No<br \/>\n\tdoubt, Rent Suit No.105 of  2001 was pending before the Small Causes<br \/>\n\tCourt. However,  thereafter since a settlement took place between<br \/>\n\tthe parties, the suit was disposed of as withdrawn. However, the<br \/>\n\tperson, who has been alleged to have committed fraud cannot escape<br \/>\n\tfrom the criminal liability only on the ground that matter is<br \/>\n\tsettled between the parties. In the opinion of this Court, if the<br \/>\n\tCourt is satisfied that the decree was obtained by committing fraud<br \/>\n\twith the Court then, Court cannot sit as a mute spectator but has to<br \/>\n\ttake appropriate steps against the persons, who committed fraud with<br \/>\n\tthe Court. No doubt, this Court is in agreement with the submission<br \/>\n\tof learned advocate, Mr.Asim Pandya  that first of all the Court is<br \/>\n\tto be satisfied of the fraud having committed, then only,<br \/>\n\tappropriate steps under the criminal law could be finally initiated<br \/>\n\tafter following due procedure of law. In the opinion of this Court,<br \/>\n\tthe Appellate Court should have ordered to hold inquiry by the<br \/>\n\tRegistrar Small Causes Court and at the end of inquiry, if it is<br \/>\n\tfound that decree has been obtained by committing fraud  with the<br \/>\n\tCourt, then only order can be passed to lodge complaint.<br \/>\n\tStraightaway, without  conducting an inquiry, order cannot be passed<br \/>\n\tto lodge criminal complaint. Hence, the  impugned order has to be<br \/>\n\tmodified to the aforesaid extent and the appeal is to be partly<br \/>\n\tallowed.\n<\/p>\n<p id=\"p_10\">This<br \/>\n\tappeal is allowed. Impugned order dated 31-7-2007 passed by the<br \/>\n\tlearned Principal District Judge, Vadodara in Civil Misc. Appeal<br \/>\n\tNo.96 of 2001 is hereby quashed and set aside. Learned Small Causes<br \/>\n\tCourt is directed to hold inquiry to ascertain whether the present<br \/>\n\tappellants-original defendants have obtained consent decree in Rent<br \/>\n\tSuit No.518 of 2000 fraudulently or not and if it is found on<br \/>\n\tinquiry that the decree has been obtained fraudulently by committing<br \/>\n\tfraud with the Court, then to take legal steps against the concerned<br \/>\n\tperson\/s who obtained the decree fraudulently by following due<br \/>\n\tprocedure of law under the <a href=\"\/doc\/445276\/\" id=\"a_2\">Cr.P.C<\/a>.\n<\/p>\n<p id=\"p_11\">In<br \/>\n\tview of the above order passed in main appeal,<br \/>\n\tCri.Misc.Appln.No.4283 of 2008 for stay does not survive and is<br \/>\n\tdisposed of accordingly.
