DILIP RABI DAS S\/O SRI DINESHWAR RABIDAS R\/O VILL.-\n          ALAWALPUR, PANCHAYAT ALAWALPUR, P.S.- GAURICHAK,\n          DISTT.- PATNA\n                              -----------\n<\/pre>\n<p id=\"p_1\">03.   07.04.2011                Heard learned counsel for the petitioner and for<\/p>\n<p>                   the State.\n<\/p>\n<p id=\"p_1\">                                The writ petition was filed on 9.4.2010 after<\/p>\n<p>                   serving two copies in the office of the Advocate General.<\/p>\n<p>                   The second copy was to facilitate expeditious filing of a<\/p>\n<p>                   counter affidavit to enable the respondents to assist the<\/p>\n<p>                   Court in timely dispensation of justice. Today when the<\/p>\n<p>                   matter is taken up one year later, learned counsel for the<\/p>\n<p>                   State prays for adjournment to seek instruction and file a<\/p>\n<p>                   counter affidavit. This Court has already observed in<\/p>\n<p>                   another      proceeding    that   the   officers   of   the   State<\/p>\n<p>                   Government        appear    to    be    harbouring      under    a<\/p>\n<p>                   misconception that it was their compulsive right to get an<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                    2<\/span><\/p>\n<p>adjournment on the first date that the writ petition was<\/p>\n<p>taken for filing of counter affidavit irrespective of the date<\/p>\n<p>of filing and the long delay that they may have been<\/p>\n<p>negligent, whiling away time since the filing of the writ<\/p>\n<p>petition not filing the counter affidavit.<\/p>\n<p id=\"p_2\">            The attitude of the respondents in stalling the<\/p>\n<p>proceeding before the Court is unfortunate. Had a counter<\/p>\n<p>affidavit been filed, the writ petition could have been<\/p>\n<p>disposed off today in clear terms positively or negatively<\/p>\n<p>bringing the litigation to an end. That the controversy<\/p>\n<p>continues even after the writ application shall be disposed<\/p>\n<p>today, the responsibility shall lie squarely with the<\/p>\n<p>respondents.\n<\/p>\n<p id=\"p_3\">            The petitioner alleges that the P.D.S. license for<\/p>\n<p>Alawalpur Panchayat has been directed to be given to<\/p>\n<p>respondent      no.7   contrary     to     statutory   procedures<\/p>\n<p>prescribed under Section 2 of the Fair Price Shop Order,<\/p>\n<p>2007   framed     under    the    Public    Distribution   System<\/p>\n<p>(Control) Order, 2001 mandating it to be routed through a<\/p>\n<p>Selection     Committee.     Reliance       is   placed    on   a<\/p>\n<p>representation dated 16.11.2009 raising this specific<\/p>\n<p>objection in paragraph-3 of the same. Learned counsel<\/p>\n<p>submits that in pursuance thereof the State Government<\/p>\n<p>in the Department of Food and Civil Supply on 25.1.2010<\/p>\n<p>have also called for a report in this regard which is yet to<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                    3<\/span><\/p>\n<p>be submitted. He next submits that District Magistrate<\/p>\n<p>himself has approved the grant of license to respondent<\/p>\n<p>no.7 as noticed in the order dated 19.2.2010 of the<\/p>\n<p>Additional District Magistrate (Supply), Patna.<\/p>\n<p id=\"p_4\">            No orders with regard to the license granted to<\/p>\n<p>respondent no.7 can be passed at this stage in absence of<\/p>\n<p>the said respondent.\n<\/p>\n<p id=\"p_5\">            The writ application is therefore disposed with<\/p>\n<p>directions to the District Magistrate, Patna to call for the<\/p>\n<p>original records and satisfy himself, if the selection of<\/p>\n<p>respondent no.7 was routed through and with the approval<\/p>\n<p>of the statutory Selection Committee. If the District<\/p>\n<p>Magistrate is so satisfied, he shall pass a brief reasoned<\/p>\n<p>order on this aspect. If the petitioner is aggrieved by the<\/p>\n<p>same he may avail his remedy in accordance with law.<\/p>\n<p id=\"p_6\">            Conversely, if the District Magistrate be of the<\/p>\n<p>opinion that the selection was not routed through the<\/p>\n<p>statutory Selection Committee he shall issue necessary<\/p>\n<p>directions to the licensing authority to issue notice to<\/p>\n<p>respondent no.7 and then proceed to act in accordance<\/p>\n<p>with law.\n<\/p>\n<p id=\"p_7\">            Let the first direction contained in the present<\/p>\n<p>order be complied within a maximum period of two months<\/p>\n<p>from the date of receipt\/production of a copy of this order.<\/p>\n<p>The second direction, circumstances warranting, must be<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                         4<\/span><\/p>\n<p>      complied with within a maximum period of four months<\/p>\n<p>      from the date of receipt\/production of a copy of this order.<\/p>\n<p id=\"p_8\">                The writ application stands disposed with the<\/p>\n<p>      aforesaid directions.\n<\/p>\n<p id=\"p_9\">\n<pre id=\"pre_1\">P.K                                   ( Navin Sinha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Shiv Shankar Singh vs The State Of Bihar &amp;Amp; Ors on 7 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.6228 of 2010 1.
