PUBLIC\nPROSECUTOR for Respondent(s) :\n1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 07\/09\/2011\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">By<br \/>\n\tway of present application, filed under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> of the Code of<br \/>\n\tCriminal Procedure, 1973, the applicants have prayed to release them<br \/>\n\ton anticipatory bail in connection with CR No.I-160 of 2011<br \/>\n\tregistered with Chandkheda Police Station, Ahmedabad for the offence<br \/>\n\tpunishable under <a href=\"\/doc\/92983\/\" id=\"a_1\">Sections 306<\/a>, <a href=\"\/doc\/653797\/\" id=\"a_2\">304-B<\/a>, <a href=\"\/doc\/538436\/\" id=\"a_3\">498-A<\/a>, <a href=\"\/doc\/1569253\/\" id=\"a_4\">294-B<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_5\">114<\/a> of the<br \/>\n\tIndian Penal Code.\n<\/p>\n<p id=\"p_1\">Heard<br \/>\n\tMr.P.P. Majmudar, learned counsel for the applicants and Mr.Maulik<br \/>\n\tNanavati, learned Additional Public Prosecutor for respondent-State.\n<\/p>\n<p id=\"p_2\">Mr.Majmudar<br \/>\n\thas contended that the applicants are absolutely innocent persons<br \/>\n\tand have not committed any offence. He has contended that the<br \/>\n\tapplicants are father-in-law and mother-in-law of the deceased. He<br \/>\n\thas also contended that the applicants are falsely implicated in the<br \/>\n\tpresent case. He has also contended that the applicants are senior<br \/>\n\tcitizens and they will co-operate with the investigation. He has<br \/>\n\talso contended that husband and brother-in-law of the deceased are<br \/>\n\talready granted anticipatory bail by this Court and other co-accused<br \/>\n\thave also been granted anticipatory bail by the learned District and<br \/>\n\tSessions Judge, Gandhinagar and therefore, on the ground of parity<br \/>\n\talso, present applicants are required to be released on anticipatory<br \/>\n\tbail. He, therefore, contended that looking to the overall facts of<br \/>\n\tthe case, present applicants may be released on anticipatory bail.\n<\/p>\n<p id=\"p_3\">Mr.Nanavati,<br \/>\n\tlearned Additional Public Prosecutor, has vehemently opposed the<br \/>\n\tpresent application and contended that because of cruelty meted out<br \/>\n\tby the applicants, the deceased died an unnatural death. He,<br \/>\n\ttherefore, contended that present application deserves to be<br \/>\n\tdismissed.\n<\/p>\n<p id=\"p_4\">Heard<br \/>\n\tlearned counsel for the respective parties and also perused papers<br \/>\n\tproduced before me. It appears from the papers that specific role is<br \/>\n\tattributed to the applicants. It appears from the dying declaration<br \/>\n\tthat the applicants are the abater and due to their instigation,<br \/>\n\tdeceased has committed suicide. I have also perused provisions of<br \/>\n\t<a href=\"\/doc\/1667403\/\" id=\"a_6\">Sections 107<\/a> and <a href=\"\/doc\/1494082\/\" id=\"a_7\">108<\/a> of the Indian Penal Code and from the<br \/>\n\tingredient of the said provisions, prima-facie it is established<br \/>\n\tthat the applicants are involved in this case. It also appears from<br \/>\n\tthe papers that applicant No.1 abused the deceased by specifically<br \/>\n\tsaying that she should not come back.\n<\/p>\n<p id=\"p_5\">In<br \/>\n\tview of above, present application deserves to be dismissed and is<br \/>\n\thereby dismissed.\n<\/p>\n<p id=\"p_6\">(Z.\n<\/p>\n<p id=\"p_7\">K.
