Respondent\n\n\n        Criminal Original Petition filed under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section  482<\/a>  of  the  Code  of\nCriminal Procedure for the relief as stated therein.\n\nFor petitioners :  Mr.M.Ravindran\n\nFor respondent :  Mr.A.N.Thambidurai,\n                Govt.Advocate(Crl.side)\n\n:O R D E R\n<\/pre>\n<p id=\"p_1\">                The petitioners have brought forth the above Criminal Original<br \/>\nPetition,  to  call  for  the records in M.C.No.364 of 2002 on the file of the<br \/>\nSub-Divisional Magistrate and Revenue  Divisional  Officer,  Krishnagiri,  and<br \/>\nquash the same.\n<\/p>\n<p id=\"p_1\">        2.   The  case of the petitioners is that, the first petitioner is the<br \/>\nPresident, the second petitioner is the Treasurer and  other  petitioners  are<br \/>\nthe  Members  of  the  Krishnagiri Taluk Lorry Owners Association, situated at<br \/>\nNo.59, Car Street, Krishnagiri.  A dispute arose between the President and the<br \/>\nSecretary, when the first petitioner had tried to initiate action against  the<br \/>\nMembers,  who had not paid the debts on purchase of spares from the shop owned<br \/>\nby the Association and to deny  voting  right  to  the  defaulters  of  annual<br \/>\nsubscription  to the association, which was to be brought in the agenda of the<br \/>\nAnnual General Body Meeting.\n<\/p>\n<p id=\"p_2\">                3.  It is the further case of the petitioners that  while  the<br \/>\nassociation   had  sought  for  the  permission  to  conduct  the  meeting  at<br \/>\nJayalaxshmi Kalyana Mandapam, Madras  Road,  Krishnagiri  on  21.07.2002,  the<br \/>\nother  faction approached the District Munsif Court, Krishnagiri, for an order<br \/>\nof injunction, restraining the association to  hold  the  meeting,  which  was<br \/>\ndismissed  by  the said Court; that parallel to that, two FIRs were registered<br \/>\nby the respondent police in Crime No.1344 of 2002 under  <a href=\"\/doc\/1405190\/\" id=\"a_1\">Section  145<\/a>  Cr.P.C.<br \/>\nand Crime No.1345 of 2002 under <a href=\"\/doc\/1914745\/\" id=\"a_2\">Section 107<\/a> Cr.P.C.  and in the meanwhile, the<br \/>\nvery  meeting  itself  was  held at the association premises on 21.07.2002 and<br \/>\ntherefore, any continuation of  the  proceedings  under  <a href=\"\/doc\/1914745\/\" id=\"a_3\">Section  107<\/a>  Cr.P.C.<br \/>\nwithout  any  basis  and  need  by  the  learned Sub-Divisional Magistrate and<br \/>\nRevenue Divisional Officer, Krishnagiri, in M.C.No.364 of 2002 would amount to<br \/>\nan abuse of process of law and the same is liable to be quashed.\n<\/p>\n<p id=\"p_3\">                4.  While so, the petitioners were served with the  notice  of<br \/>\nthe proceeding  under  <a href=\"\/doc\/1914745\/\" id=\"a_4\">Section  107<\/a>  of  Cr.P.C.    based on the report of the<br \/>\nInspector of Police, Krishnagiri Police Station, and hence, the  SubDivisional<br \/>\nMagistrate,  initiating the said proceeding, has issued notice calling for the<br \/>\npetitioners to appear before him on 21.10.2002 as per notice dated  02.09.2002<br \/>\nin  M.C.No.364  of  2002  and  the  petitioners  have filed the above Criminal<br \/>\nOriginal Petition testifying the validity of the same on grounds such as  that<br \/>\nthe  case  has been registered out of jurisdiction by the respondent regarding<br \/>\nthe dispute amongst the parties; that the issue involved  would  neither  fall<br \/>\nunder  the  jurisdiction  of  Sub  Divisional Magistrate, Krishnagiri, nor the<br \/>\nKrishnagiri Town Police; that the instance referred to in the impugned  notice<br \/>\nwill  not  amount  to initiating action under <a href=\"\/doc\/1914745\/\" id=\"a_5\">Section 107<\/a> of Cr.P.C.; that the<br \/>\nimpugned notice is not in consonance under  <a href=\"\/doc\/1863990\/\" id=\"a_6\">Section  111<\/a>  of  Cr.P.C.    etc.,<br \/>\nultimately seeking for quashing the proceeding initiated by the Sub-Divisional<br \/>\nMagistrate, Krishnagiri, against the petitioners.\n<\/p>\n<p id=\"p_4\">                5.  When the above Criminal Original Petition was taken up for<br \/>\nconsideration  in  the presence of the learned counsel for the petitioners and<br \/>\nthe learned Government Advocate on the Criminal side, taking notice on  behalf<br \/>\nof  the  respondent,  learned counsel for the petitioners would highlight that<br \/>\nthe order passed under <a href=\"\/doc\/1914745\/\" id=\"a_7\">Section 107<\/a> of Cr.P.C.  in the form  of  a  show  cause<br \/>\nnotice calling for the appearance of the petitioners is not an order passed in<br \/>\ncompliance  of  the  warranting  provisions of law nor is it in the format and<br \/>\ntherefore, the  order  only  becomes  liable  to  be  quashed  in  limine  and<br \/>\ntherefore, would pray for the same.\n<\/p>\n<p id=\"p_5\">                6.   On  the  part  of  the respondent, the learned Government<br \/>\nAdvocate also has nothing to say against the arguments advanced on the part of<br \/>\nthe learned counsel for the petitioners, since it pertains to the legality and<br \/>\ntherefore, this Court is inclined to pass the following order.\n<\/p>\n<p id=\"p_6\">                7.   In  consideration  of  the   facts   and   circumstances,<br \/>\nencircling the notice issued by the Sub- Divisional Executive Magistrate under<br \/>\n<a href=\"\/doc\/1914745\/\" id=\"a_8\">Section 107<\/a>  of  Cr.P.C.    calling  for the petitioners to appear before him,<br \/>\nhaving regard to the materials placed on record and upon hearing  the  learned<br \/>\ncounsel  for  the petitioners and the learned Government Advocate contra, what<br \/>\ncomes to be known is that the impugned notice  issued  by  the  Sub-Divisional<br \/>\nMagistrate,  Krishnagiri,  is  neither  in the accepted format nor has it been<br \/>\nprepared in a  constructive  manner  adopting  the  necessary  and  warranting<br \/>\nprocedures established under <a href=\"\/doc\/1863990\/\" id=\"a_9\">Section 111<\/a> of Cr.P.C.  and therefore, no mention<br \/>\nneed  be  necessary  that  the notice impugned issued to the petitioners is an<br \/>\ninconsistent and improper one and the same only becomes liable to be quashed.\n<\/p>\n<p id=\"p_7\">                8.  Time and again, this Court has insisted on  the  operative<br \/>\ningredients covered  under <a href=\"\/doc\/1863990\/\" id=\"a_10\">Section 111<\/a> of Cr.P.C.  to be complied with thereby<br \/>\n&#8216;setting forth the substance of the information received, the  amount  of  the<br \/>\nbond  to  be executed, the term for which it is to be in force and the number,<br \/>\ncharacter and clause of sureties (if any) required&#8217; and  without  these  vital<br \/>\ninformations  forming  part  of the notice, it cannot be a valid notice in law<br \/>\nand hence, the notice impugned herein issued to the petitioners under  <a href=\"\/doc\/1914745\/\" id=\"a_11\">Section<br \/>\n107<\/a> of Cr.P.C.  is without compliance of the operative portions of <a href=\"\/doc\/1863990\/\" id=\"a_12\">Section 111<\/a><br \/>\nof Cr.P.C.  and illegal and only becomes liable to be quashed.\n<\/p>\n<p id=\"p_8\">                In result,\n<\/p>\n<p id=\"p_9\">        (i)  the  above  Criminal  Original  Petition succeeds and the same is<br \/>\nallowed;\n<\/p>\n<p id=\"p_10\">        (ii)the impugned notice issued to the petitioners  in  M.C.No.364\/2002<br \/>\nby the Sub-Divisional Magistrate, Krishnagiri, is hereby quashed;\n<\/p>\n<p id=\"p_11\">        iii)  however,  the  Sub-Divisional  Magistrate and Revenue Divisional<br \/>\nOfficer, Krishnagiri, will be at liberty to issue a fresh notice in compliance<br \/>\nof the requirements of <a href=\"\/doc\/1863990\/\" id=\"a_13\">Section 111<\/a> of Cr.P.C.\n<\/p>\n<p id=\"p_12\">        iv) Consequently, the connected Crl.M.P.is closed.\n<\/p>\n<p id=\"p_13\">Index:  Yes<br \/>\nInternet:  Yes<\/p>\n<p>dixit<\/p>\n<p>To<\/p>\n<p id=\"p_14\">1.The Inspector of Police,<br \/>\nKrishnagiri Town Police Station,<br \/>\nDharmapuri District.\n<\/p>\n<p id=\"p_15\">(Crime No.1345\/2001)<\/p>\n<p id=\"p_16\">2.
