SANKARAN, J.\n                  ---------------------------------------------\n                     CRL.M.C.NO. 5637 OF 2003\n                 ---------------------------------------------\n              Dated this the 22nd day of November, 2007\n\n                                 O R D E R\n<\/pre>\n<p id=\"p_1\">       The petitioners are the accused persons in C.C.No.555 of<\/p>\n<p>2002, on the file of the Court of the Judicial Magistrate of the first<\/p>\n<p>class II, Kanjirapally. The offences alleged against them         are<\/p>\n<p>under Sections 448, 294(b) and 506(1) read with <a href=\"\/doc\/37788\/\" id=\"a_1\">Section 34<\/a> of the<\/p>\n<p>Indian Penal Code.      On appearance before the court below, they<\/p>\n<p>filed an application under <a href=\"\/doc\/729109\/\" id=\"a_1\">Section 258<\/a> of the Code of Criminal<\/p>\n<p>Procedure, which was dismissed by the trial court and the order of<\/p>\n<p>the trial court was confirmed in Crl.R.P.No.18 of 2003, on the file<\/p>\n<p>of the Court of Session, Kottayam.         The prayer in the Crl.M.C is to<\/p>\n<p>quash Annexure-B order in Crl.R.P.No.18 of 2003 as well as to quash<\/p>\n<p>all the proceedings in C.C.No.555 of 2002, on the file of the Court<\/p>\n<p>of the Judicial Magistrate of the first class II, Kanjirapally.<\/p>\n<p id=\"p_1\">       2. It is submitted by the counsel for the petitioner that even<\/p>\n<p>if all the allegations contained in Annexure-A FIR are taken as true,<\/p>\n<p>CRL.M.C. NO.5637 OF 2003 D<\/p>\n<p>                              :: 2 ::\n<\/p>\n<p id=\"p_2\">no offence is made out against the petitioners. Accused No.1 is an<\/p>\n<p>advocate while accused No.2 is a member of the panchayat.         It is<\/p>\n<p>stated in Annexure-A FIR that the accused came to the police<\/p>\n<p>station and enquired about the petition submitted by Soosan, the<\/p>\n<p>wife of the second accused and in respect of which Crime No.206 of<\/p>\n<p>2001 was registered. The further allegation in the FIR is as follows:<\/p>\n<p>CRL.M.C. NO.5637 OF 2003 D<\/p>\n<p>                                :: 3 ::\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">      3.   Sri.K.Ramakumar, learned counsel appearing for the<\/p>\n<p>petitioners, submitted that the allegations made in the FIR do not<\/p>\n<p>constitute an offence under <a href=\"\/doc\/1198799\/\" id=\"a_2\">Section 294(b)<\/a> of the Indian Penal<\/p>\n<p>Code.   He relied on the decisions in Santhilal v. Parameswaran<\/p>\n<p>Pillai (1988 (2) KLT Short Notes Case No.112 at page 74),<\/p>\n<p>P.T.Chacko v. Nainan Chacko (1967 KLT 799), <a href=\"\/doc\/150527\/\" id=\"a_3\">Chacko George v.<\/p>\n<p>State of Kerala<\/a> (1968 KLT 219) and Ranjit V.Udeshi v. State of<\/p>\n<p>Maharashtra (AIR 1965 SC 881) in support of this contention.<\/p>\n<p id=\"p_5\">      4. <a href=\"\/doc\/594493\/\" id=\"a_4\">Section 294<\/a> of the Indian Penal Code reads as follows:<\/p>\n<p id=\"p_6\">           &#8220;294. Obscene acts and songs:&#8211;         Whoever, to<br \/>\n      the annoyance of others &#8212;\n<\/p>\n<p id=\"p_7\">           (a) does any obscene act in any public place, or<\/p>\n<p id=\"p_8\">           (b)   sings, recites or utters any obscene song,<br \/>\n      ballad or words, in or near any public place,<\/p>\n<p>      shall  be   punished    with   imprisonment   of  either<br \/>\n      description for a term which may extend to three<\/p>\n<p>CRL.M.C. NO.5637 OF 2003 D<\/p>\n<p>                               :: 4 ::\n<\/p>\n<p id=\"p_9\">     months, or with fine, or with both.&#8221;\n<\/p>\n<p id=\"p_10\">In order to constitute an offence under <a href=\"\/doc\/1198799\/\" id=\"a_5\">Section 294(b)<\/a>, the accused<\/p>\n<p>must sing, recite or utter any obscene song, ballad or words, in or<\/p>\n<p>near any public place. The question is whether the words allegedly<\/p>\n<p>uttered by the accused would constitute obscene words.<\/p>\n<p id=\"p_11\">     5. In P.T.Chacko v. Nainan Chacko (1967 KLT 799), Justice<\/p>\n<p>K.K.Mathew (as His Lordship then was) considered the question<\/p>\n<p>whether the words &#8221;\n<\/p>\n<p id=\"p_12\">                       &#8221; uttered    by the   first accused   would<\/p>\n<p>constitute an offence under <a href=\"\/doc\/1198799\/\" id=\"a_6\">Section 294(b)<\/a> and whether those<\/p>\n<p>words would be obscene. In paragraph 5 of the judgment it was<\/p>\n<p>held thus:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>           &#8220;5. The only point argued was that the 1st accused<br \/>\n     has not committed an offence punishable under S.294(b)<br \/>\n     <a href=\"\/doc\/1569253\/\" id=\"a_7\">IPC<\/a>, by uttering the words above-mentioned. The courts<br \/>\n     below have held that the words uttered were obscene<br \/>\n     and the utterance caused annoyance to the public. I am<br \/>\n     not inclined to take this view. In The Queen v. Hicklin<br \/>\n     1868-3-Q.B.360 at 371 Cockburn C.J., laid down the test<br \/>\n     of &#8216;obscenity&#8217; in these words:\n<\/p><\/blockquote>\n<p id=\"p_13\">CRL.M.C. NO.5637 OF 2003 D<\/p>\n<p>                               :: 5 ::\n<\/p>\n<p id=\"p_14\">\n<p>            &#8220;&#8230;. the test of obscenity is this, whether the<br \/>\n     tendency of the matter charged as obscenity is to<br \/>\n     deprave and corrupt those whose minds are open to such<br \/>\n     immoral influences.&#8221;\n<\/p>\n<p id=\"p_15\">     This test has been uniformly followed in India.      The<br \/>\n     Supreme Court has accepted the correctness of the test<br \/>\n     in <a href=\"\/doc\/1623275\/\" id=\"a_8\">Ranjit D.Udeshi v. State of Maharashtra<\/a> AIR, 1965 SC<br \/>\n     881 at 887. <a href=\"\/doc\/682644\/\" id=\"a_9\">In Samuel Roth v. U.S.A<\/a>. (1957) 354 U.S.<br \/>\n     476, Chief Justice Warren said that the test of<br \/>\n     &#8216;obscenity&#8217; is the &#8220;substantial tendency to corrupt by<br \/>\n     arousing lustful desires&#8221;.    Mr.Justice Harlan observed<br \/>\n     that in order to be &#8216;obscene&#8217; the matter must &#8220;tend to<br \/>\n     sexually impure thoughts&#8221;. I do not think that the words<br \/>\n     uttered in this case have such a tendency. It may be<br \/>\n     that the words are defamatory of the complainant, but I<br \/>\n     do not think that the words are &#8216;obscene&#8217; and the<br \/>\n     utterance would constitute an offence punishable under<br \/>\n     S.294(b) <a href=\"\/doc\/1569253\/\" id=\"a_10\">IPC<\/a>.&#8221;\n<\/p>\n<p id=\"p_16\">\n<p id=\"p_17\">     6.   <a href=\"\/doc\/150527\/\" id=\"a_11\">In Chacko George v. State of Kerala<\/a> (1968 KLT 219),<\/p>\n<p>Justice K.Sadasivan (as His Lordship then was) laid down the test of<\/p>\n<p>&#8216;obscenity&#8217; as follows:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>            &#8220;The test of obscenity &#8216;is whether the tendency of<br \/>\n     the matter charged as obscenity, is to deprave and<br \/>\n     corrupt those whose minds are open to such immoral<br \/>\n     influences&#8217;.    The words uttered must be capable of<br \/>\n     arousing sexually impure thoughts in the minds of the<br \/>\n     hearers.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_18\">CRL.M.C. NO.5637 OF 2003 D<\/p>\n<p>                                :: 6 ::\n<\/p>\n<p id=\"p_19\">\n<p id=\"p_20\">      7. In Ranjit V.Udeshi v. State of Maharashtra (AIR 1965 SC<\/p>\n<p id=\"p_21\">881), the Supreme Court, while dealing with the question whether<\/p>\n<p>the accused persons, who were partners of a book stall committed<\/p>\n<p>the offence under <a href=\"\/doc\/1704109\/\" id=\"a_12\">Section 292<\/a> of the Indian Penal Code (1860) as<\/p>\n<p>they were found in possession for the purpose of sale copies of an<\/p>\n<p>alleged obscene book called &#8220;Lady Chatterley&#8217;s Lover&#8221;, considered<\/p>\n<p>the test of obscenity, and held thus:\n<\/p>\n<blockquote id=\"blockquote_2\"><p>            &#8220;&#8230;. I think the test of obscenity is this whether<br \/>\n      the tendency of the matter charged as obscenity is to<br \/>\n      deprave and corrupt those whose minds are open to<br \/>\n      such immoral influences, and into whose hands a<br \/>\n      publication of this sort may fall. &#8230; it is quite certain<br \/>\n      that it would suggest to the minds of the young of either<br \/>\n      sex, or even to persons of more advanced years,<br \/>\n      thoughts of a most impure and libidinous character.&#8221;<\/p><\/blockquote>\n<p id=\"p_22\">\n<p id=\"p_23\">      8.   I am of the view that the words allegedly uttered by the<\/p>\n<p>accused cannot be said to be obscene words. I respectfully follow the<\/p>\n<p>decisions referred to above.\n<\/p>\n<p id=\"p_24\">      9. Learned Public Prosecutor submitted that it is also stated in the<\/p>\n<p>FIR as follows:\n<\/p>\n<p id=\"p_25\">CRL.M.C. NO.5637 OF 2003 D<\/p>\n<p>                                  :: 7 ::\n<\/p>\n<p id=\"p_26\">\n<p>Learned Public Prosecutor laid stress on the word &#8221;<\/p>\n<p>and contended that there are allegations in the FIR that the accused<\/p>\n<p>persons uttered obscene words.           In answer to this contention,<\/p>\n<p>Sri.K.Ramakumar submitted that the vague allegation that there was<\/p>\n<p>utterance of obscene words in the FIR is not enough to constitute an<\/p>\n<p>offence under <a href=\"\/doc\/1198799\/\" id=\"a_13\">Section 294(b)<\/a> IPC.\n<\/p>\n<p id=\"p_27\">\n<p id=\"p_28\">      10.  He relied on the decision in Santhilal v. Parameswaran<\/p>\n<p>Pillai (1988 (2) KLT Short Notes Case No.112 at page 74), wherein it<\/p>\n<p>was held:\n<\/p>\n<blockquote id=\"blockquote_3\"><p>            &#8220;It is not stated either in the complaint or sworn<br \/>\n      statement what the words used were, while alleging an<br \/>\n      offence under S.294 <a href=\"\/doc\/1569253\/\" id=\"a_14\">IPC<\/a>. Without that, it is not possible<br \/>\n      for a court to consider whether the offence under S.294<br \/>\n      is attracted.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_29\">CRL.M.C. NO.5637 OF 2003 D<\/p>\n<p>                                  :: 8 ::\n<\/p>\n<p id=\"p_30\">      11.   A vague or general statement in the FIR that the accused<\/p>\n<p>showered obscene words is not enough to constitute an offence under<\/p>\n<p><a href=\"\/doc\/1198799\/\" id=\"a_15\">Section 294(b)<\/a>.    It is necessary to state the words uttered by the<\/p>\n<p>accused.    The prosecution would not be justified in bringing in the<\/p>\n<p>evidence for the first time      the words allegedly spoken to by the<\/p>\n<p>accused, when the same is not recorded in the First Information<\/p>\n<p>Statement in a case instituted upon police report. The complaint or the<\/p>\n<p>FIR, as the case may be, shall contain the words spoken to by the<\/p>\n<p>accused, which, according to the prosecution, would attract the offence<\/p>\n<p>under <a href=\"\/doc\/1198799\/\" id=\"a_16\">Section 294(b)<\/a> of the Indian Penal Code. Or else, there is every<\/p>\n<p>possibility of evidence being tendered putting forth any words as the<\/p>\n<p>prosecution witnesses may wish to put forward improving upon or adding<\/p>\n<p>to the allegation in the complaint or FIR causing great prejudice to the<\/p>\n<p>accused and depriving his right to have a fair trial.<\/p>\n<p id=\"p_31\">      12. I am of the view that even if all the averments in the FIR are<\/p>\n<p>taken as true, no offence under <a href=\"\/doc\/1198799\/\" id=\"a_17\">Section 294(b)<\/a> is made out. Cognizance<\/p>\n<p>of offence under <a href=\"\/doc\/1198799\/\" id=\"a_18\">Section 294(b)<\/a> is accordingly, set aside.<\/p>\n<p>CRL.M.C. NO.5637 OF 2003 D<\/p>\n<p>                                  :: 9 ::\n<\/p>\n<p id=\"p_32\">      13. Learned counsel for the petitioner would also contend that no<\/p>\n<p>offence under <a href=\"\/doc\/1947545\/\" id=\"a_19\">Section 448<\/a> is made out. He submitted that police station<\/p>\n<p>being a public place, it cannot be said that the ingredients of <a href=\"\/doc\/1768645\/\" id=\"a_20\">Section 441<\/a><\/p>\n<p>(criminal trespass) are made out.     <a href=\"\/doc\/1768645\/\" id=\"a_21\">Section 441<\/a> provides that whoever<\/p>\n<p>enters into or upon property in the possession of another with intent to<\/p>\n<p>commit an offence or to intimidate, insult or annoy any person in<\/p>\n<p>possession of such property, or having lawfully entered into or upon such<\/p>\n<p>property, unlawfully remains there with intent thereby to intimidate,<\/p>\n<p>insult or annoy any such person, or with intent to commit an offence is<\/p>\n<p>said to commit criminal trespass.     <a href=\"\/doc\/691024\/\" id=\"a_22\">Section 442<\/a> provides that whoever<\/p>\n<p>commits criminal trespass by entering into or remaining in any building,<\/p>\n<p>tent or vessel used as a human dwelling or any building used as a place<\/p>\n<p>for worship, or as a place for the custody of property, is said to commit<\/p>\n<p>&#8220;house trespass&#8221;.     <a href=\"\/doc\/1947545\/\" id=\"a_23\">Section 448<\/a> provides the punishment for house<\/p>\n<p>trespass. I do not agree with the learned counsel for the petitioners that<\/p>\n<p>the allegations made in the First Information Report do not make out an<\/p>\n<p>offence under <a href=\"\/doc\/1947545\/\" id=\"a_24\">Section 448<\/a> of the Indian Penal Code. Jurisdiction under<\/p>\n<p><a href=\"\/doc\/903398\/\" id=\"a_25\">Section 482<\/a> cannot be invoked to quash the proceedings in this case in<\/p>\n<p>respect of the offence under <a href=\"\/doc\/1947545\/\" id=\"a_26\">Section 448<\/a> of the Indian Penal Code. I am<\/p>\n<p>CRL.M.C. NO.5637 OF 2003 D<\/p>\n<p>                                  :: 10 ::\n<\/p>\n<p id=\"p_33\">also of the view that it cannot be said that the allegations in the FIR do<\/p>\n<p>not constitute an offence under <a href=\"\/doc\/180217\/\" id=\"a_27\">Section 506(1)<\/a> IPC. I make it clear that<\/p>\n<p>the observations made by me in respect of the offences under <a href=\"\/doc\/1947545\/\" id=\"a_28\">Sections<\/p>\n<p>448<\/a> and <a href=\"\/doc\/180217\/\" id=\"a_29\">506(1)<\/a> are meant only to decide whether jurisdiction under<\/p>\n<p><a href=\"\/doc\/903398\/\" id=\"a_30\">Section 482<\/a> can be invoked at this stage.\n<\/p>\n<p id=\"p_34\">\n<p id=\"p_35\">      In the result, the Criminal Miscellaneous Case is partly allowed.<\/p>\n<p>The charge against the petitioners, in so far as it relates to the offence<\/p>\n<p>under <a href=\"\/doc\/1198799\/\" id=\"a_31\">Section 294(b)<\/a> of the Indian Penal Code, is quashed.
