Siri Jagan, J.\n                =-=-=-=-=-=-=-=--=-=-=-=-=-=-=-=-=-=\n                       W.P(C) No. 24852 of 2009\n                =-=-=-=-=-=-=-=-=--=-=-=-=-=-=-=-=-=\n              Dated this, the 20th day of January, 2010.\n\n                              J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The petitioners are Lecturers (Selection Grade) in English,<\/p>\n<p>working in S.N. College, Chempazhanthy and S.N. College for<\/p>\n<p>Women, Kollam.        By Exts. P1 and P2, the petitioners have been<\/p>\n<p>deputed to undergo Faculty Improvement Programme sponsored by<\/p>\n<p>the University Grants Commission, whereby teachers of Government<\/p>\n<p>and Aided Colleges are given deputation benefit for undergoing<\/p>\n<p>M.Phil and Ph.D courses, during which period they would continue to<\/p>\n<p>receive salary in the post of Lecturers (Selection Grade) and the<\/p>\n<p>salary paid by the Government to the substitute teachers appointed in<\/p>\n<p>their place would be reimbursed by the UGC. Since the petitioners<\/p>\n<p>could not complete the course within the deputation period originally<\/p>\n<p>granted, the petitioners applied for extension. That extension was<\/p>\n<p>approved by the UGC. But, by Ext. P7 and P8, the State Government<\/p>\n<p>refused to grant extension on the ground that the deputation was<\/p>\n<p>sanctioned with the specific condition that no further extension would<\/p>\n<p>be granted. It is under the above circumstances, the petitioners have<\/p>\n<p>filed this writ petition challenging Exts. P7 and P8.<\/p>\n<p id=\"p_1\">      2. The contention of the State is that although the UGC would<\/p>\n<p>reimburse the salary to be paid to the substituted teachers, the salary<\/p>\n<p>of the petitioners would have to be borne by the Government with no<\/p>\n<p>corresponding return to the Government. It is also submitted that<\/p>\n<p>they have been given deputation benefits after execution of a bond<\/p>\n<p>undertaking that      they would complete the programme within the<\/p>\n<p>period mentioned therein, which period has already expired.<\/p>\n<p>According to the learned Government Pleader, the petitioners have no<\/p>\n<p>right to get extension of time contrary to the specific clauses agreed<\/p>\n<p>to by them in the bond executed by them. The learned Government<\/p>\n<p>Pleader therefore argues in support of Exts. P7 and P8.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.C. No. 24852\/09                -: 2 :-<\/span><\/p>\n<p id=\"p_2\">      3.   I have considered the rival contentions in detail.<\/p>\n<p id=\"p_3\">      4.    The very object of Faculty Improvement Programme<\/p>\n<p>sponsored by the UGC is to enhance the standard of teaching and<\/p>\n<p>standard of education in the State. The Government would not lose<\/p>\n<p>anything because they are not liable to incur any extra expenses t on<\/p>\n<p>account of the petitioners being deputed for Faculty Improvement<\/p>\n<p>Programme. The extra expenses necessary for appointing substitute<\/p>\n<p>teachers are borne by the UGC. If the petitioners have not completed<\/p>\n<p>the Faculty Improvement Programme, then that wold be a national<\/p>\n<p>waste since the object of the Faculty Improvement Programme would<\/p>\n<p>not be achieved, if they are not permitted to complete the Programme<\/p>\n<p>and at the same time the amount spent on them would go waste. By<\/p>\n<p>approving the extension requested for by the petitioners, the UGC,<\/p>\n<p>who are sponsoring the Facility Improvement Programme,               has<\/p>\n<p>accepted the fact that further time is necessary for completing the<\/p>\n<p>programme by the petitioners. In such circumstances, I am of opinion<\/p>\n<p>that there is no justification for the Government to refuse to grant the<\/p>\n<p>extension requested for by the petitioners. It is also a fact that in the<\/p>\n<p>case of many other teachers, the Government have granted extension<\/p>\n<p>of the period of deputation of teachers deputed for Faculty<\/p>\n<p>Improvement Programme.\n<\/p>\n<p id=\"p_4\">      Accordingly, Exts.P7 and P8 are quashed. The Government is<\/p>\n<p>directed to give approval for the extension requested for by the<\/p>\n<p>petitioners and approved by the UGC and release salary due to them<\/p>\n<p>for the period of deputation, as expeditiously as possible, at any rate,<\/p>\n<p>within two months from the date of receipt of a copy of this judgment.<\/p>\n<p id=\"p_5\">                                           Sd\/- S.
