PANGARKAR J.\n<\/p>\n<p id=\"p_3\">                          Date: 7th OCTOBER 2008.\n<\/p>\n<p id=\"p_4\">    ORAL JUDGMENT:\n<\/p>\n<p id=\"p_5\">               This is a second appeal against the order of Additional<\/p>\n<p>    District Judge who confirmed the order of Assistant Charity<\/p>\n<p>    Commissioner framing a Scheme of the trust known as Khairullasha<\/p>\n<p>    Darga.\n<\/p>\n<p id=\"p_6\">    2.        Respondents 1 and 2 herein filed an application under<\/p>\n<p>    Section 50-A of the Bombay Public Trust Act before the Assistant<\/p>\n<p>    Charity Commissioner for settlement of a Scheme in respect of<\/p>\n<p>    Khairullasha Darga Chikhli district Buldhana. Applicants contended<\/p>\n<p>    that applicant No.1 was a Trustee of the Trust and No.2 was the<\/p>\n<p>    person having interest in the said Trust. There were in all 9 trustees<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                    ::: Downloaded on &#8211; 09\/06\/2013 13:56:59 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                          3<\/span><\/p>\n<p>    and out of them three had resigned and three trustees had died. There<\/p>\n<p>    was a Meeting on 20.02.1999 and the vacancies were filled in. As a<\/p>\n<p>    result the Change Report was filed which was registered as Inquiry<\/p>\n<p>    Case No. 259 of 1999.          The said Change Report was admittedly<\/p>\n<p>    allowed.    It is contended by the applicants before the Charity<\/p>\n<p>    Commissioner that there is no Scheme for proper management of the<\/p>\n<p>    trust and there is no proper mode of succession.          They therefore<\/p>\n<p>    prayed that a Scheme be framed.             Learned Assistant Charity<\/p>\n<p>    Commissioner framed a Scheme for the said trust and appointed 9<\/p>\n<p>    persons as Trustees. Being aggrieved by that order one Hanifshah<\/p>\n<p>    filed an appeal before the District Judge Buldhana.         District Judge<\/p>\n<p>    Buldhana dismissed the appeal and confirmed the finding of the<\/p>\n<p>    Assistant Charity Commissioner.\n<\/p>\n<p id=\"p_7\">    3.         Being aggrieved by that order Hanifsha has preferred this<\/p>\n<p>    appeal.    The appeal was admitted by this Court on the following<\/p>\n<p>    substantial question of law:\n<\/p>\n<p id=\"p_8\">                         Whether    the     Assistant   Charity<br \/>\n               Commissioner erred in entertaining an application<br \/>\n               for framing a Scheme and whether the Additional<br \/>\n               District Judge also erred in entertaining and<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                                     ::: Downloaded on &#8211; 09\/06\/2013 13:56:59 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                       4<\/span><\/p>\n<p>             deciding the appeal against the order of the<br \/>\n             Assistant Charity Commissioner in view of the<\/p>\n<p>             provisions of <a href=\"\/doc\/1906047\/\" id=\"a_1\">Section 32<\/a> of the Wakf Act, 1995?\n<\/p>\n<p id=\"p_9\">    4.        I have heard the learned counsel for the appellant<\/p>\n<p>    and the respondents.\n<\/p>\n<p id=\"p_10\">    5.        Shri Khapre learned counsel for the appellant contended<\/p>\n<p>    that the orders of both the Courts below are without jurisdiction. He<\/p>\n<p>    submits that the Trust Khairullasha Darga besides being a Trust is a<\/p>\n<p>    Wakf and as such now governed by the <a href=\"\/doc\/631210\/\" id=\"a_1\">Wakf Act<\/a>, 1995 which came<\/p>\n<p>    into force from 01.01.1996. He submits that proceedings with regard<\/p>\n<p>    to any Wakf now need to be taken up under this new Act and only<\/p>\n<p>    before the forums provided under the Act. Application under Section<\/p>\n<p>    50-A of the Bombay Public Trust Act was filed by the respondents<\/p>\n<p>    before the Charity Commissioner on 25.05.1999.            Obviously the<\/p>\n<p>    application under Bombay Public Trust Act was filed after coming into<\/p>\n<p>    force of the <a href=\"\/doc\/631210\/\" id=\"a_2\">Wakf Act<\/a> 1995. He submits that by virtue of provisions of<\/p>\n<p>    <a href=\"\/doc\/59036073\/\" id=\"a_3\">Section 112<\/a> of the Wakf Act, all Acts are deemed to be repealed and<\/p>\n<p>    therefore Bombay Public Trust Act is not applicable to the Wakf. After<\/p>\n<p>    having gone through the provisions of <a href=\"\/doc\/185980570\/\" id=\"a_4\">Section 112(3)<\/a> of the Wakf Act<\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">                                                    ::: Downloaded on &#8211; 09\/06\/2013 13:56:59 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_5\">                                         5<\/span><\/p>\n<p>    it is clear that as far as applicability of the Bombay Public Trust Act to<\/p>\n<p>    Wakf is concerned the said Act stands repealed. The result of such<\/p>\n<p>    repeal is that all Wakfs are now governed by <a href=\"\/doc\/631210\/\" id=\"a_5\">Wakf Act<\/a> and whosoever<\/p>\n<p>    wants to get his grievance redressed for or against the Wakf has to do<\/p>\n<p>    it under the <a href=\"\/doc\/631210\/\" id=\"a_6\">Wakf Act<\/a>.       Respondents therefore had no right to<\/p>\n<p>    approach the Charity Commissioner under <a href=\"\/doc\/631210\/\" id=\"a_7\">Section 50-A<\/a> nor did the<\/p>\n<p>    Charity Commissioner have jurisdiction to entertain the application<\/p>\n<p>    under <a href=\"\/doc\/631210\/\" id=\"a_8\">Section 50-A<\/a>.\n<\/p>\n<p id=\"p_11\">    6.          There is yet another reason why Charity Commissioner<\/p>\n<p>    could not assume jurisdiction. If the Scheme of the Wakf Act is seen it<\/p>\n<p>    would be clear that it makes a remedy as well Forum available under<\/p>\n<p>    the Act. The forum i.e. the Tribunal or Board can grant all those<\/p>\n<p>    reliefs which can be granted by the Charity Commissioner. <a href=\"\/doc\/4241422\/\" id=\"a_9\">Section<\/p>\n<p>    32(2)(d)(g)<\/a> makes it clear that the party can approach a Board for<\/p>\n<p>    settlement of Scheme for Wakf and it can also appoint Mutawallis i.e.<\/p>\n<p>    Trustees.\n<\/p>\n<p id=\"p_12\">    7.          Upon consideration of provisions of law as discussed above<\/p>\n<p>    it is clear that both Courts fell in error in assuming jurisdiction in<\/p>\n<p><span class=\"hidden_text\" id=\"span_6\">                                                       ::: Downloaded on &#8211; 09\/06\/2013 13:56:59 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_7\">                                         6<\/span><\/p>\n<p>    framing a Scheme of a Wakf. The orders having been passed without<\/p>\n<p>    jurisdiction are in fact void. Yet they need to be set aside and they are<\/p>\n<p>    set aside. Appeal is allowed. Orders passed by the Courts below are<\/p>\n<p>    set aside.
