According to<br \/>\n\thim, no cause of action arose in favour of the petitioner and<br \/>\n\tagainst the respondent.\n<\/p>\n<p id=\"p_2\">\tThis Court has issued<br \/>\n\tnotice on 13.2.2007 and interim relief in terms of para 13(c) of the<br \/>\n\tpetition was granted whereby the respondents were restrained from<br \/>\n\tselling, transferring or alienating the properties as described in<br \/>\n\tthe schedule appended with the plaint. Thereafter, rule was issued<br \/>\n\tby this Court on 10.7.2007 and interim relief granted earlier stood<br \/>\n\tcontinued till the final disposal of this petition.\n<\/p>\n<p id=\"p_3\">\tHeard Mr. B.Y.Mankad,<br \/>\n\tlearned advocate appearing for the petitioner and Mr.Mahendra K.<br \/>\n\tPatel, learned advocate appearing for the respondents.\n<\/p>\n<p id=\"p_4\">\tIt is the case of the<br \/>\n\tpetitioner that the petitioner and the respondent No.2 are<br \/>\n\toriginally residents of Village ?  Shankhalpur, Dist. Mehsana.<br \/>\n\tThereafter, they settled at Nashik in the State of Maharashtra to do<br \/>\n\ttheir business.  The respondent No.2 is son of respondent No.1. The<br \/>\n\trespondent No.2 wanted to have loan from the Co.operative Bank at<br \/>\n\tNashik.  The respondent No.1 met the petitioner and requested him to<br \/>\n\tstand as guarantor for respondent No.2. The respondent No.1 had<br \/>\n\tagreed to create charge on the properties situated at  Village ?<br \/>\n\tShankhalpur, Taluka ?  Becharaji in Dist. Mehsana, for security of<br \/>\n\tloan.  The petitioner agreed for the same.  Therefore, as per the<br \/>\n\tmutually agreed terms and conditions the respondent No.1 had<br \/>\n\texecuted agreement cum irrevocable general power of attorney on<br \/>\n\t10.1.2000 in favour of the petitioner.  Thus, the petitioner was<br \/>\n\tauthorised by the respondent No.1 to sell the properties of<br \/>\n\tagricultural lands as well as buildings belonging to the<br \/>\n\trespondents, in case, the respondent No.2 fails to repay the loan<br \/>\n\tamount and interest to the Bank.\n<\/p>\n<p id=\"p_5\">\tThereafter, the<br \/>\n\tpetitioner stood as a guarantor and then the respondent No.2<br \/>\n\treceived loan of Rs.10 lacs from Jan-Kalyan Bank and Rs.7 lacs from<br \/>\n\tthe Jan-Laxmi Bank. Then the respondent No.2 committed default in<br \/>\n\trepayment of the loan and hence filed suits against the respondent<br \/>\n\tNo.2 before the Board of Nominee and the same are pending.  The<br \/>\n\tpetitioner has already deposited Rs.6,80,000\/- with the Jan-Kalyan<br \/>\n\tCo.operative Bank towards the outstanding amount of loan of<br \/>\n\trespondent No.2.\n<\/p>\n<p id=\"p_6\">\tThe respondent No.1<br \/>\n\tlodged criminal complaint on 16.9.2003 in Sarkarwada Police Station<br \/>\n\tat Nashik, which was registered as FIR No.CR I ?  183\/2003.  In<br \/>\n\tthis complaint he has alleged that the petitioner has committed a<br \/>\n\tfraud and the irrevocable power of attorney is a bogus and sham<br \/>\n\tdocument.  A Criminal Case No.999\/2003 based on this is pending<br \/>\n\tbefore the JMFC at Nashik.  Thereafter, on 18.9.2003 the police<br \/>\n\tauthorities have seized the original documents of irremovable power<br \/>\n\tof attorney dated 10.1.2000.\n<\/p>\n<p id=\"p_7\">\tThe petitioner,<br \/>\n\tthereafter, filed Regular Civil Suit No.51 of 2006 in the Court of<br \/>\n\tCivil Judge (S.D.) Mehsana.  The Court rejected the plaint under<br \/>\n\tOrder 7 Rule 11(a) of CPC on the ground that the suit does not<br \/>\n\tdisclose any cause of action on 14.3.2006. Thereafter, the<br \/>\n\tpetitioner filed another suit being Special Civil Suit No.12 of 2006<br \/>\n\ton 28.3.2006 on the same cause of action under Order 7 Rule 13 CPC<br \/>\n\tby making an exhaustive pleading and giving the specific cause of<br \/>\n\taction in para 36 of the plaint, wherein it is stated that since the<br \/>\n\tirrevocable power of attorney has been seized by the police and is<br \/>\n\tin the custody of the Court the petitioner can not sell the<br \/>\n\tproperties situated at Village ?  Shankhalpur.  Therefore, in order<br \/>\n\tto get injunction against the respondent No.2 from selling or<br \/>\n\talienating the properties, institution of the suit was necessary.\n<\/p>\n<p id=\"p_8\">\tThe learned trial Judge<br \/>\n\tvide his order dated 6.6.2006 rejected the plaint under Order 7 Rule<br \/>\n\t11(a) of CPC by holding that the plaintiff ?  petitioner has failed<br \/>\n\tto show that he has been stopped by the respondents in taking action<br \/>\n\tas per the power of attorney and, therefore, no cause of action has<br \/>\n\tarisen to institute the suit.\n<\/p>\n<p id=\"p_9\">\tIt is this order which is<br \/>\n\tunder challenge in the present petition filed by the petitioner<br \/>\n\tunder <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the Constitution of India.\n<\/p>\n<p id=\"p_10\">\tMr.Mankad, learned<br \/>\n\tadvocate appearing for he petitioner has submitted that the learned<br \/>\n\ttrial Judge has failed to ascertain cause of action from the<br \/>\n\taverments of the plaint by reading the express provision contained<br \/>\n\tunder Order 6 Rule 2 and Order 7 Rule 11 of CPC. He has further<br \/>\n\tsubmitted that the learned trial Judge has not correctly read the<br \/>\n\taverments made by the petitioner in the plaint.\n<\/p>\n<p id=\"p_11\">\tMr.Mahendra Patel,<br \/>\n\tlearned advocate appearing for the respondents submitted that all<br \/>\n\tthe transactions took place at Nashik and simply because the<br \/>\n\tproperty situated at Shankhalpur, no jurisdiction can be conferred<br \/>\n\ton the Court at Mehsana. Hence on the ground of jurisdiction the<br \/>\n\tplaint can be rejected under Order 7 Rule 11(a) of CPC.  Precisely<br \/>\n\tfor this reason the learned trial Judge has observed in his order<br \/>\n\tthat no cause of action arose within the jurisdiction of the Court<br \/>\n\tand hence the plaint was rightly rejected by the Court. He has,<br \/>\n\ttherefore, submitted that no interference is called for and it is<br \/>\n\tnot required to exercise writ jurisdiction by this Court under<br \/>\n\t<a href=\"\/doc\/1331149\/\" id=\"a_2\">Article 227<\/a> of the Constitution of India.\n<\/p>\n<p id=\"p_12\">\tHaving heard learned<br \/>\n\tadvocates appearing for the respective parties and having gone<br \/>\n\tthrough the orders of the trial Court as well as ground raised in<br \/>\n\tthe present petition and reply filed by the respondents, this Court<br \/>\n\tis of the view that the learned trial Judge has committed grave<br \/>\n\terror and wrongly exercised jurisdiction while rejecting the plaint<br \/>\n\tunder Order 7 Rule 11(a) of the plaint. While reading clause 36 of<br \/>\n\tthe plaint, it clearly appears that cause of action arose in favour<br \/>\n\tof the petitioner and, therefore, suit was rightly instituted by the<br \/>\n\tpetitioner.  The learned trial Judge has not addressed himself as to<br \/>\n\twhether he has jurisdiction to entertain the suit and hence the<br \/>\n\tsubmissions made by Mr. Patel in this regard cannot he accepted. The<br \/>\n\tCourt is, therefore, of the view that the order passed by the<br \/>\n\tlearned trial Judge for rejection of the plaint of the suit is<br \/>\n\trequired to be quashed and set aside and hence it is accordingly<br \/>\n\tquashed and set aside.  The Special Civil Suit No.12 of 2006 is<br \/>\n\trestored to the file and the learned trial Judge is directed to<br \/>\n\tproceed further in the said suit.  It is made clear that the Court<br \/>\n\thas not expressed any opinion as to whether Civil Judge (S.D.)<br \/>\n\tMehsana has jurisdiction to entertain the suit and hence it is open<br \/>\n\tfor the respondents to make appropriate application for framing of<br \/>\n\tpreliminary issue and if such an application is made by the<br \/>\n\trespondents the same should be decided in accordance with the<br \/>\n\tprovisions of law.\n<\/p>\n<p id=\"p_13\">\tSubject to the above<br \/>\n\tobservations and clarifications, the petition is accordingly allowed<br \/>\n\tand rule is made absolute without any order as to costs.  Interim<br \/>\n\trelief granted by this Court at the time of admission of this<br \/>\n\tpetition shall be continued till the application Ex.5 is decided by<br \/>\n\tthe trial Court.\n<\/p>\n<p id=\"p_14\">\t                       (K.\n<\/p>\n<p id=\"p_15\">\tA.
