And Another\nPetitioner Counsel :- Ashok Kumar Srivastava\nRespondent Counsel :- Govt Advocate\n\nHon'ble Rajesh Dayal Khare,J.\n<\/pre>\n<p id=\"p_1\">Heard learned counsel for the applicant and the learned<br \/>\nAGA for the State.\n<\/p>\n<p id=\"p_1\">The present petition under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> Code of Criminal<br \/>\nProcedure (in short &#8220;the Code&#8221;) has been filed for quashing<br \/>\nthe summoning order dated 10.02.2009 in Case No. 11\/XI of<br \/>\n2009 (Haidari Bibi v Iftikhar Hussain) under <a href=\"\/doc\/1056396\/\" id=\"a_1\">Section 125<\/a> of<br \/>\nthe Code, PS Khanpur, District Ghazipur pending before the<br \/>\nJudicial Magistrate, Saidpur, Ghazipur and for quashing of<br \/>\nthe proceedings in the aforesaid case.\n<\/p>\n<p id=\"p_2\">It is contended by learned counsel for the applicant that<br \/>\nopposite party no. 2 had married applicant no. 1, forty years<br \/>\nback and she is living in her parents&#8217; house for the last thirty<br \/>\nseven years and now she has moved an application under<br \/>\n<a href=\"\/doc\/1056396\/\" id=\"a_2\">Section 125<\/a> of the Code, in which the applicant has been<br \/>\nsummoned. It is contended that the applicant is not entitled<br \/>\nto grant of any maintainance in view of the provisions<br \/>\nenvisaged under proviso to <a href=\"\/doc\/1056396\/\" id=\"a_3\">Section 125<\/a> of the Code and as<br \/>\nsuch proceedings initiated by opposite party no. 2 cannot be<br \/>\nsustained under law.\n<\/p>\n<p id=\"p_3\">From the perusal of the material on record and looking into<br \/>\nthe facts of the case at this stage it cannot be said that no<br \/>\noffence is made out against the applicant. All the submission<br \/>\nmade at the bar relates to the disputed question of fact,<br \/>\nwhich cannot be adjudicated upon by this Court under<br \/>\n<a href=\"\/doc\/1679850\/\" id=\"a_4\">Section 482<\/a> Cr.P.C. At this stage only prima facie case is to<br \/>\nbe seen in the light of the law laid down by Supreme Court in<br \/>\ncases of R.P. Kapur Vs. State of Punjab, A.I.R. 1960 S.C.<br \/>\n 866, State of Haryana Vs. Bhajan Lal, 1992 SCC (Cr.) 426,<br \/>\nState of Bihar Vs. P.P.Sharma, 1992 SCC (Cr.) 192 and<br \/>\nlastly Zandu Pharmaceutical Works Ltd. Vs. Mohd. Saraful<br \/>\nHaq and another (Para-10) 2005 SCC (Cr.) 283. The<br \/>\ndisputed defence of the accused cannot be considered at<br \/>\nthis stage. Moreover, the applicant has got right of discharge<br \/>\nunder <a href=\"\/doc\/897083\/\" id=\"a_5\">Section 239<\/a> or 227\/228 <a href=\"\/doc\/445276\/\" id=\"a_6\">Cr.P.C<\/a>. as the case may<br \/>\nthrough a proper application for the said purpose and he is<br \/>\nfree to take all the submissions in the said discharge<br \/>\napplication before the Trial Court.\n<\/p>\n<p id=\"p_4\">The prayer for quashing of the summoning order dated<br \/>\n10.02.2009 and also for quashing of the proceedings of the<br \/>\naforesaid case is refused.\n<\/p>\n<p id=\"p_5\">However, it is directed that the applicant shall appears and<br \/>\nsurrenders before the court below within 30 days from today<br \/>\nand applies for bail, his prayer for bail shall be considered<br \/>\nand decided in view of the settled law laid by this Court in<br \/>\nthe case of Amrawati and another Vs. State of U.P.<br \/>\nreported in 2004 (57) ALR 290 as well as judgement passed<br \/>\nby Hon&#8217;ble Apex Court reported in 2009 (3) ADJ 322 (SC)<br \/>\nLal Kamlendra Pratap Singh Vs. State of U.P. For a period<br \/>\nof 30 days from today or till the disposal of the application for<br \/>\ngrant of bail whichever is earlier, no coercive action shall be<br \/>\ntaken against the applicant.
