sought to justify the award passediiibygthe Co’IIi\u00ab-rnissioftier.<\/p>\n
5. Firstly with r’e1\u00a72;~,td–i_   disab\ufb02ity, the<\/p>\n
Commissioner  .c_o’nysi’d.e”r’ed this aspect while answering<\/p>\n
point No.  which  for its consideration. in<\/p>\n
this regard, the’-wioundi’ certi\ufb01cate which was marked as<\/p>\n
been noticed and in that background, after<\/p>\n
reiferri’1_1g “to-\u00ab..thei’g’-evidence tendered by Sri.S. R. Angadi,<\/p>\n
 _Orthoipedi.r_;\u00b0Suii’geon who had stated the disability to the limb<\/p>\n
it ‘at.”3..5%, the “Commissioner has arrived at the conclusion that<\/p>\n
_’ 1~;eepi’ng’in View the nature of the injuries and the avocation,<\/p>\n
.:i_’t’i1\u00bbe”lioss of earning capacity is to be reckoned at 50%. On<\/p>\n
f<\/p>\n
that aspect of the matter, I see no error committed by the<\/p>\n
Commissioner.\n<\/p>\n
6. With reference to the wages, the Commis;si’oin,er__:’iia___si <\/p>\n
considered this aspect of the matter while point’  i<\/p>\n
No.4 raised for its consideration, :.T,hjef<\/p>\n
contended that he was earnineg.,__a su’mvii’of  <\/p>\n
month. However, in the absence_ of i’an:y”‘isatisfactory
\nevidence, the Commission.ery\u00ab–has: ta.1<:e"ri..,in,to\u00abconsideration the
\nminimum wages noti\ufb01cati.Oir._1i–.,date:d  and has<\/p>\n
reckoned',  atgi"-Rs.2_O6S\/–. In the normal<\/p>\n
circumstances, in the"\u00aba'bse'ncei.of documentary evidence, the<\/p>\n
Commigssioner wouilidiibe justified in relying on the minimum<\/p>\n
in'..wagesiiiiiiotii\ufb01cation. However, having placed reliance on the<\/p>\n
no'ti\ufb01c'atio'n,'theVi.Commissi0ner has not thereafter considered<\/p>\n
V as to i"Whe.th'er<"the very same wages are to be reckoned for<\/p>\n
 specific reason or any other wage is admissible. As<\/p>\n
_i_n,oti_ced~,' in the instant case the notification is of the year<\/p>\n
2002 and even though the wages could be fixed for a period<\/p>\n

\nof the same is reckoned for the of hcalmilatilon and<\/p>\n
the very same relevant jfactoftli. adopted by the<\/p>\n
Commissioner ‘la.-;?opted,’etheclaimant would be entitled to<\/p>\n
the sum of ..Rs.1,lT0,l604,l;”‘\u00ab–.to\\vards 50% loss of earning<\/p>\n
 l_thle~–.Commissioner has already awarded a<\/p>\n
  suni.of\u00bblRls.l;1l?;’432\/-, the claimant would be entitled to the<\/p>\n
;u..t_._4dliffVerence~.arnoiint of Rs.53,172\/~ by way of enhancement.<\/p>\n
  amount, the claimant would be entitled to the<\/p>\n
l’v~..s___interest at 7.5% from the date of petition till the date of<\/p>\n
