DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 01\/08\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tLearned<br \/>\nadvocate for the applicant submits that the applicant is sister-in<br \/>\nlaw (jethani) of the deceased and initial statement dated 2.5.2011 of<br \/>\nthe complainant do not indicate her name.  Besides, the complaint was<br \/>\nfiled after about 38 days of the alleged incident.  In the above<br \/>\ncircumstances, by imposing suitable conditions the applicant may be<br \/>\nenlarged on bail.\n<\/p>\n<p id=\"p_1\">\tConsidering<br \/>\nthe above prima facie aspects of the matter, I find this is a fit<br \/>\ncase for granting bail. Under the circumstances, the applicant is<br \/>\nordered to be released on bail in connection with C.R. No.I-05 of<br \/>\n2011 with Khadir, Kutch, on his furnishing bond of Rs. 5000\/-(Rupees<br \/>\nFive Thousand) with one surety of like amount to the satisfaction of<br \/>\nthe lower Court and subject to following conditions :\n<\/p>\n<p id=\"p_2\">not<br \/>\n\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p id=\"p_3\">not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_4\">maintain<br \/>\n\tlaw and order;\n<\/p>\n<p id=\"p_5\">mark<br \/>\n\this presence before the concerned Police Station on every 1st<br \/>\n\tand 15th day of English Calendar month between 11:00 am<br \/>\n\tto 2:00 pm:\n<\/p>\n<p id=\"p_6\">not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p id=\"p_7\">furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p id=\"p_8\">surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p id=\"p_9\">\tThe<br \/>\nAuthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p id=\"p_10\">\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p id=\"p_11\">\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p id=\"p_12\">\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p id=\"p_13\">\tRule<br \/>\nis made absolute to the aforesaid extent.
