Civil Suit No. 108 of 2004 whereby the\tplaint<br \/>\nwas dismissed under Order 7 Rule 11(D).\n<\/p>\n<p id=\"p_1\">2.\tThe<br \/>\nfact of the case is that the\tappellant,residing of village Sikkka<br \/>\nDistrict\tJamnagar   holding agricultural  land  being\tRevenue Survey<br \/>\nNo.153.The acquisition proceeding \tfor the state machinery, was<br \/>\ninitiated by the \tthe Government  \tunder the <a href=\"\/doc\/7832\/\" id=\"a_1\">Land Acquisition Act<\/a><br \/>\n\t1984, at the \tinstance of the respondent no.1.\tFor determining the<br \/>\n\tcompensation  the LAQ Case \tNo. 5 of 1993, was \tinitiated and award<br \/>\nwas\tpassed, but the \tappellant was not satisfied\twith the awarded<br \/>\n\tamount. An agreement was\texecuted between the \tappellant and<br \/>\nthe\tRespondent No.1 dated \t19.5.1995 for payment of \thigher amount of<br \/>\n\tcompensation than the award in \tLAQ  Case No. 5 of \t1993. The award<br \/>\namount was \tenhanced  in appeal, the  respondent  no.1 would \thave to<br \/>\npay 6% of the award amount to  the State \tGovernment  towards<br \/>\nadministrative  charges,  to \tavoid making such a payments,  the<br \/>\nofficers   of \tthe  respondent  no.1,  executed  the  aforesaid<br \/>\n\tagreement  to  prevent higher payment being made \tto the State<br \/>\n\tGovernment. Therefore the suit in\tquestion came to be filed which<br \/>\ncome to be\tdismissed.\n<\/p>\n<p id=\"p_2\">3.\tLearned<br \/>\nAdvocate for the appellant submitted\tthat the trial court has<br \/>\ncommitted  an error in\tallowing the application and rejecting<br \/>\nthe\tplaint of the appellant.\n<\/p>\n<p id=\"p_3\">4.\tOn<br \/>\n\tgoing to the record it evident that the \ttrial court found that<br \/>\naward of  less \tcompensation of a land in LAQ Case is not \tillegal<br \/>\nland acquisition. I am therefore of the \tview that  a decision of the<br \/>\ntrial court is just \tand \tproper,more particularly prayers of<br \/>\nsuit\tchallenging proceedings under <a href=\"\/doc\/7832\/\" id=\"a_1\">Land Acquisition\tAct<\/a> 1894.\n<\/p>\n<p id=\"p_4\">5.\tHowever<br \/>\nthe counsel for the appellant  submitted \tthat in view of the list<br \/>\nproduced by the\tplaintiff, the payment is not made as per<br \/>\nthe\tagreement between the parties, Mark -3\/8 dated\t19th<br \/>\nMay 1995. It is made clear that the suit was \trightly rejected since<br \/>\nno prayer can be granted\tin view of the decision of the Apex court .\n<\/p>\n<p id=\"p_5\">6.\tHowever,<br \/>\nif suit for the nonpayment  of the\tamount as per the agreement  is<br \/>\nfiled, the same\twill be considered on merit   without<br \/>\nbeing\tinfluenced by the fact that earlier suit has\tbeen rejected by<br \/>\nthe competent court.\n<\/p>\n<p id=\"p_6\">7.\tIn<br \/>\nthat view of the  above mention facts, this\tappeal is not entertained<br \/>\nand it  stands\tdisposed of.
