MOTIHARI AT EAST\n                  CHAMPARAN --- PETITIONER.\n                                           Versus\n                           THE STATE OF BIHAR--OPP. PARTY.\n                                         -----------\n<\/pre>\n<p id=\"p_1\">2\/   17.06.2010           Heard the parties.\n<\/p>\n<p id=\"p_1\">                             In   a   criminal   prosecution   instituted   for<\/p>\n<p>                  offences under <a href=\"\/doc\/1560742\/\" id=\"a_1\">section 302<\/a>, <a href=\"\/doc\/1128948\/\" id=\"a_1\">120(B)<\/a>, <a href=\"\/doc\/37788\/\" id=\"a_2\">34<\/a> I.P.C. and 27 of<\/p>\n<p>                  the <a href=\"\/doc\/1934415\/\" id=\"a_3\">Arms Act<\/a>, though the petitioner is named in the<\/p>\n<p>                  F.I.R. as an accused, but allegation of killing of the<\/p>\n<p>                  deceased is against two other unknown accused persons.<\/p>\n<p>                  The petitioner is stated to be one of the conspirators for<\/p>\n<p>                  getting   the   crime   in   question   committed,   though<\/p>\n<p>                  admittedly the petitioner was not present there on the<\/p>\n<p>                  alleged place of occurrence. The enmity between the<\/p>\n<p>                  parties is admitted in the F.I.R. itself. By referring to<\/p>\n<p>                  Annexure- 2 and 3 it is submitted that co-accused Raju<\/p>\n<p>                  Tiwary, Ratan Tiwary and Rabindra Mishra, who are also<\/p>\n<p>                  named in the F.I.R. as accused, have been granted either<\/p>\n<p>                  anticipatory or regular bail by different Benches of this<\/p>\n<p>                  Court.\n<\/p>\n<p id=\"p_2\">                             In the aforesaid facts and circumstances, let<\/p>\n<p>                  the above named petitioner be enlarged on bail on<\/p>\n<p>                  furnishing bail bond of Rs. 10,000\/- with two sureties of<\/p>\n<p>                  the like amount each to the satisfaction of Chief Judicial<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 -2-<\/span><\/p>\n<p>           Magistrate, East Champaran at Motihari in connection<\/p>\n<p>           with Paharpur P.S. Case No. 51 of 2006,              subject to<\/p>\n<p>           conditions that :\n<\/p>\n<p id=\"p_3\">            (A)                one of the bailors must be government<\/p>\n<p>                               servant or close family member of the<\/p>\n<p>                               petitioner, who will file an affidavit in the<\/p>\n<p>                               court      below      showing       his\/her<\/p>\n<p>                               relationship with the petitioner,<\/p>\n<p>            (B)                if the petitioner is found involved in<\/p>\n<p>                               same and similar nature of cases in<\/p>\n<p>                               future, then in that case the informant\/<\/p>\n<p>                               prosecution shall be at liberty to file a<\/p>\n<p>                               petition for cancellation of the bail of the<\/p>\n<p>                               petitioner, and if such a petition is filed,<\/p>\n<p>                               the court below would be obliged to<\/p>\n<p>                               dispose of the same in accordance with<\/p>\n<p>                               law after giving opportunity of hearing to<\/p>\n<p>                               all concerned .\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">                                       ( Birendra Prasad Verma, J )<\/p>\n<p>BTiwary\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Dineshwar Dubey vs The State Of Bihar on 17 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
