                     record.\n<\/p>\n
                               Heard learned counsel for the petitioner, State<\/p>\n
                     and the Union of India.\n<\/p>\n
                               The petitioner seeks bail in a case instituted for<\/p>\n
                     the offences under Section 413<\/a> of the Indian Penal Code<\/p>\n
                     and Sections 20<\/a> and 22<\/a> of the N.D.P.S. Act.<\/p>\n
                               The petitioner was refused bail by order dated<\/p>\n
                     23.09.2010 since 51 Kgs. of ganja was recovered from the<\/p>\n
                     room where the petitioner was present along with other<\/p>\n
                     co-accused persons.\n<\/p>\n
                               The petitioner has renewed his prayer for bail on<\/p>\n
                     the ground that the trial is pending as also that he is not<\/p>\n
                     accused in any other case and in fact the co-accused who<\/p>\n
                     was arrested along with the petitioner from the same room<\/p>\n
                     is involved in the business of ganja which is evident from<\/p>\n
                     another case which has been instituted under the<\/p>\n
                     provisions of NDPS Act<\/a>. The report of the Trial Court<\/p>\n
                     reveals that the two co-accused persons who are on bail<\/p>\n
                     have delayed the trial and the delay was not attributable<\/p>\n
                     to the petitioner.\n<\/p>\n
                     2<\/span><\/p>\n

          Considering this fact as also that he has fair<\/p>\n
antecedents, let the petitioner, above named be released<\/p>\n
on bail on furnishing bail bond of Rs. 5,000\/- (Five<\/p>\n
Thousand) with two sureties of the like amount each or<\/p>\n
any other surety as fixed by the Court to the satisfaction<\/p>\n
of Additional Sessions Judge-II, Patna in connection with<\/p>\n
Special P.S. Case No. 77 of 2009 arising out of Fatuha<\/p>\n
P.S.   Case   No.   463\/2009     subject    to   the   following<\/p>\n
conditions:- (i) That one of the bailors will be a close<\/p>\n
relative of the petitioner who will give an affidavit giving<\/p>\n
genealogy as to how he is related with the petitioner and<\/p>\n
the other bailor shall be the sister of the petitioner namely<\/p>\n
Ranjan Devi. The bailor will also undertake to inform the<\/p>\n
Court if there is any change in the address of the<\/p>\n
petitioner. (ii) That the affidavit shall clearly state that the<\/p>\n
petitioner is not an accused in any other case and if he is<\/p>\n
he shall not be released on bail. (iii) That the bailor shall<\/p>\n
also state on affidavit that he will inform the court<\/p>\n
concerned if the petitioner is implicated in any other case<\/p>\n
of similar nature after his release in the present case and<\/p>\n
thereafter the court below will be at liberty to initiate the<\/p>\n
proceeding for cancellation of bail on the ground of<\/p>\n
misuse. (iv) That the petitioner will be well represented on<\/p>\n
each date and if he fails to do so on two consecutive dates,<\/p>\n
his bail will be liable to be cancelled.
\n                               3<\/span><\/p>\n
                     The Trial Court is directed to send a list of<\/p>\n
           witnesses fixing specific dates to the S.P. Patna along with<\/p>\n
           the copy of this order who will ensure the attendance of<\/p>\n
           the witnesses on the said dates so that there is no further<\/p>\n
           delay in trial.\n<\/p>\n
                     From henceforth the Trial Court will make out a<\/p>\n
           trial plan in consultation with the APP and defence Lawyer<\/p>\n
           and issue summons simultaneously to all the witnesses<\/p>\n
           instead of sending it one after the other thus delaying the<\/p>\n
           trial.\n<\/p>\n
