Justice V.RAMKUMAR\n\n Dated :27\/11\/2006\n\n O R D E R\n                              V.RAMKUMAR, J.\n\n                    -------------------------------------\n\n                          B.A.No. 6965 OF  2006\n\n        -----------------------------------------------------------\n\n            DATED THIS THE 27th DAY OF   NOVEMBER, 2006\n\n\n                                  O R D E R\n<\/pre>\n<p id=\"p_1\">          Petitioner, who is the sole accused in Crime No.578\/2000<\/p>\n<p>of   Manjeri   Police   Station   for   offences   punishable   under   <a href=\"\/doc\/1270101\/\" id=\"a_1\">sections<\/p>\n<p>279<\/a>, <a href=\"\/doc\/1402213\/\" id=\"a_1\">337<\/a> and <a href=\"\/doc\/1371604\/\" id=\"a_2\">304A<\/a> IPC, seeks anticipatory bail. The case against<\/p>\n<p>the   petitioner   is   pending   before   the   C.J.M.,   Manjeri   as   L.P.Case<\/p>\n<p>No.29\/03.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      2.      Admittedly,   non-bailable   warrants   of   arrest   are<\/p>\n<p>pending  against   the   petitioner   for   his   non-appearance.     He   had<\/p>\n<p>jumped   bail   twice.     The   justification   offered   is   that   he   was<\/p>\n<p>employed abroad.   That is not a reason to remain absent.       At<\/p>\n<p>any   rate,   anticipatory   bail   cannot   be   granted   to   nullify   the<\/p>\n<p>process issued by a court of competent jurisdiction.   There is no<\/p>\n<p>reason   why   the   petitioner   should   not   surrender   before   the<\/p>\n<p>Magistrate   and   seek   regular   bail.     Accordingly,   if   the   petitioner<\/p>\n<p>surrenders before the C.J.M., Manjeri and files an application for<\/p>\n<p>regular   bail   within   10   days   from   today,   the   same   shall   be<\/p>\n<p>considered   and   disposed   of,   preferably   on   the   same   date   on<\/p>\n<p>BA.6965\/06<\/p>\n<p>                                   Page numbers<\/p>\n<p>which it is filed.
