JUSTICE DINESH MAHESHWARI\n\nMr.J.R.Patel with Mr.Manish Patel for the petitioner.\nMr.R.K.Thanvi, Sr.Advocate with Mr.Narendra Thanvi for the\nrespondent\n                         ....\n\nBY THE COURT:<\/pre>\n<p id=\"p_1\">      While allowing the application (IA No.14355\/2011) for<\/p>\n<p>preponing, at the request of learned counsel for the parties,<\/p>\n<p>the matter has been finally heard at this stage itself.<\/p>\n<p id=\"p_1\">      The petitioner-tenant has preferred this writ petition<\/p>\n<p>against the judgment and order dated 25.02.2010 (Annex.8)<\/p>\n<p>as passed in Rent Appeal No.52\/2008 whereby the Appellate<\/p>\n<p>Rent Tribunal, Jodhpur dismissed the appeal and affirmed the<\/p>\n<p>judgment and order dated 15.03.2008 as passed in Original<\/p>\n<p>Petition No.452\/2004 whereby the Rent Tribunal, Jodhpur<\/p>\n<p>issued the certificate for recovery of possession and ordered<\/p>\n<p>revision of rent while allowing the petition filed by the<\/p>\n<p>respondent-landlord.\n<\/p>\n<p id=\"p_2\">      After hearing, upon this Court being not persuaded to<\/p>\n<p>consider interference, the learned counsel for the petitioner<\/p>\n<p>submitted in the alternative that the petitioner may be granted<\/p>\n<p>some extra time to vacate the premises in question on<\/p>\n<p>reasonable conditions. The learned senior counsel appearing<\/p>\n<p>for the respondent-landlord submitted       that the respondent<\/p>\n<p>shall not stand on ceremonies and shall not oppose granting<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  2<\/span><\/p>\n<p>of some extra time to vacate but shall pray for the conditions<\/p>\n<p>regarding submission of undertaking                  and payment of<\/p>\n<p>enhanced amount towards mesne profits.\n<\/p>\n<p id=\"p_3\">      In conformity with the submissions and suggestions<\/p>\n<p>aforesaid, the petitioner has filed an undertaking supported by<\/p>\n<p>the affidavit to the effect, inter alia, that he shall hand over<\/p>\n<p>vacant possession by 31.08.2012 and shall pay enhanced<\/p>\n<p>mesne profits from the month of September 2011 @<\/p>\n<p>Rs.3,300\/- per month.\n<\/p>\n<p id=\"p_4\">      Having    given   a   thoughtful        consideration     to   the<\/p>\n<p>submissions made, while this Court finds no ground to<\/p>\n<p>interfere,   however,   having       regard     to    the   facts    and<\/p>\n<p>circumstances of the case, it appears just and proper to allow<\/p>\n<p>time to the petitioner to vacate the premises in question by<\/p>\n<p>31st August 2012 while allowing enhanced mesne profits to<\/p>\n<p>respondent, particularly during the extra period to vacate as<\/p>\n<p>being allowed herein. Having regard to the overall facts and<\/p>\n<p>circumstances of the case, it appears appropriate to allow<\/p>\n<p>mesne profits to the respondent from 1st September 2011 until<\/p>\n<p>the petitioner vacates the premises @ Rs. 3,300\/- per month.<\/p>\n<p id=\"p_5\">      Of course, for there being no ground to interfere<\/p>\n<p>otherwise, this writ petition is dismissed; however, the<\/p>\n<p>petitioner is granted time to vacate the premises in question<\/p>\n<p>by 31st August 2012 on the following conditions:-<\/p>\n<blockquote id=\"blockquote_1\"><p>       (i)   The   petitioner    shall    personally        submit   an<br \/>\n             undertaking supported by affidavit before the Rent<br \/>\n             Tribunal within     three weeks from today to the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                         3<\/span><\/p>\n<p>                   effect that on or before 31st August 2012, he shall<br \/>\n                   hand over peaceful and vacant possession of the<br \/>\n                   premises in question to the plaintiff-respondent.<br \/>\n                   He shall also undertake not to cause any damage<br \/>\n                   to the premises nor to make any alteration and not<br \/>\n                   to assign, sublet or in any manner part with<br \/>\n                   possession to any other person and not to put the<br \/>\n                   premises to any use other than the present use<br \/>\n                   and not to cause any nuisance.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>            (ii)   The petitioner shall deposit within three weeks the<br \/>\n                   arrears, if any, of the rent\/mesne profits and of the<br \/>\n                   decreetal amount and        shall further pay to the<br \/>\n                   landlord the amount for use and occupation of the<br \/>\n                   premises in question at the rate of Rs. 3,300\/-<br \/>\n                   (three thousand three hundred)       per month with<br \/>\n                   effect from 1st September 2011 or deposit this<br \/>\n                   amount in the bank account of the landlord (if<br \/>\n                   particulars   whereof      are   furnished   to   the<br \/>\n                   petitioner) month by month on or before 15th day<br \/>\n                   of the next month.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>             It is made clear that upon the petitioner&#8217;s failure to<\/p>\n<p>       comply with any of the conditions aforesaid or violating any<\/p>\n<p>       terms of the undertaking, the respondent      shall be entitled to<\/p>\n<p>       move for execution in accordance with law.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>             No costs.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>                                            (DINESH MAHESHWARI), J.\n<\/p><\/blockquote>\n<p id=\"p_6\">\/MK\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Ashok Kumar Somani vs Smt.
