UPADHYAY\n                                       ------\n              For the Petitioners      :      Mr. Ananda Sen, Advocate\n              For the Opp. Party       :      A.P.P.\n              For the Complainant      :      Mr. Manish Kumar, Advocate\n                                              -----\n\n04     \/12.10.2011<\/pre>\n<p id=\"p_1\">   Heard learned counsel for the parties.\n<\/p>\n<p id=\"p_1\">                     Petitioner is accused in a case registered under <a href=\"\/doc\/1436241\/\" id=\"a_1\">Sections 420<\/a>\/<a href=\"\/doc\/556166\/\" id=\"a_1\">468<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_2\">34<\/a> of the<\/p>\n<p>              Indian Penal Code.\n<\/p>\n<p id=\"p_2\">                     It reveals from the complaint that one cheque leaf, belonging to complainant,<\/p>\n<p>              was lost somewhere and it was used by the petitioner no.2, Manoj Kumar Sharma.<\/p>\n<p id=\"p_3\">                     It is submitted that the present complaint has been filed after a notice was<\/p>\n<p>              served against the complainant when the cheque issued by him got dishonored. As a<\/p>\n<p>              matter of fact, the complainant had taken friendly loan to the tune of Rs.4,65,000\/-<\/p>\n<p>              and the cheque in question was given to the petitioner no.2, Manoj Kumar Sharma.<\/p>\n<p>              The complainant, in order to grab the money, has lodged this false case.<\/p>\n<p id=\"p_4\">                     Learned counsel for the complainant has opposed the prayer and submitted<\/p>\n<p>              that the story concocted by the petitioner Manoj Kumar Sharma is pulpably false<\/p>\n<p>              because such amount of cash could not be given in terms of loan at a place<\/p>\n<p>              mentioned in the complaint.\n<\/p>\n<p id=\"p_5\">                     It is apparent that after service of notice, after dishonor of the cheque, this<\/p>\n<p>              complaint has been filed against the petitioners.\n<\/p>\n<p id=\"p_6\">                     Considering the aforesaid aspects of the matter, above named petitioners are<\/p>\n<p>              directed to surrender in the Court below within three weeks and on such surrender<\/p>\n<p>              or in the event of their arrest the petitioners shall be released on bail by the Court<\/p>\n<p>              below on furnishing bail bond of Rs. 10,000\/- (Ten thousand) each with two sureties<\/p>\n<p>              of the like amount each to the satisfaction of learned Judicial Magistrate, 1 st Class,<\/p>\n<p>              Jamshedpur in connection with C\/1 Case No.05 of 2011 subject to the conditions as<\/p>\n<p>              laid down under <a href=\"\/doc\/1144664\/\" id=\"a_3\">Section 438<\/a> (2) of the <a href=\"\/doc\/445276\/\" id=\"a_4\">Cr.P.C<\/a>.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">                                                                      (D.N.
