MANN, J.\n<\/pre>\n<p id=\"p_1\">            Petition filed by the appellant through Electrical Engineer<\/p>\n<p>under <a href=\"\/doc\/1243820\/\" id=\"a_1\">Section 75<\/a> of the Employees&#8217; <a href=\"\/doc\/88376\/\" id=\"a_1\">State Insurance Act<\/a>, 1948 (for short<\/p>\n<p>&#8216;the Act&#8217;) with a prayer for quashing the order dated 17.4.1970 issued by<\/p>\n<p>Employees&#8217; State Insurance Corporation (hereinafter referred to as &#8216;the<\/p>\n<p>Corporation&#8217;) was dismissed by learned Employees&#8217; Insurance Court,<\/p>\n<p>Chandigarh on 31.5.1984, which order has been challenged by the<\/p>\n<p>appellant by filing the present appeal under <a href=\"\/doc\/1122914\/\" id=\"a_2\">Section 82<\/a> of the Act.<\/p>\n<p id=\"p_1\">            According to the appellant, it was engaged in a public utility<\/p>\n<p>service of supplying electricity to the residents of Amritsar City under a<\/p>\n<p>licence issued by the State government. The appellant had been purchasing<\/p>\n<p>electric energy from the Punjab State Electricity Board (for short &#8216;the<\/p>\n<p>Board&#8217;) for the purpose of use and distribution, within the area of supply.<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> F.A.O. No. 708 of 1984                                               -2-<\/span><\/p>\n<p>The electric energy was supplied by the Board on certain points in three<\/p>\n<p>phases A.C. at a normal voltage of 11 KV for H.T. supply and the supplier<\/p>\n<p>was also at liberty to supply 400 volts for L.T. supply. All points upto the<\/p>\n<p>supply were installed by the Board. The appellant had been purchasing<\/p>\n<p>electric energy from the Board and supplying the same to the consumers<\/p>\n<p>in the city of Amritsar. It was an establishment, engaged in the supply of<\/p>\n<p>the electricity and not engaged in either manufacturing or producing the<\/p>\n<p>electricity. The supply was given by the Board on various points in the<\/p>\n<p>city and the same distributed and supplied by the appellant by laying<\/p>\n<p>various supply lines in the city. The appellant had established sub stations<\/p>\n<p>and administrative office, known as Municipal Power House. In each sub<\/p>\n<p>station, maximum number of persons employed for wages never exceeded<\/p>\n<p>nine. It was only the head office where administrative work was done,<\/p>\n<p>which was employing more than 20 persons. The electricity was not<\/p>\n<p>manufactured at any place by the appellant and, therefore, it did not fall<\/p>\n<p>within the definition of &#8216;factory&#8217;. Thus, the order dated 17.4.1970 passed<\/p>\n<p>by the respondent-Corporation covering the appellant under the Act was<\/p>\n<p>illegal and liable to be set aside.\n<\/p>\n<p id=\"p_2\">\n<p id=\"p_3\">             While contesting the claim of the appellant before the learned<\/p>\n<p>lower Court, the respondent-Corporation pleaded that survey and<\/p>\n<p>inspection had been carried out by the Corporation, wherein it was found<\/p>\n<p>that the appellant was manufacturing electric energy and transmitting the<\/p>\n<p>same. Though, the appellant was purchasing the electric energy from the<\/p>\n<p>Board and distributing the same thereafter, yet it was transforming the<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> F.A.O. No. 708 of 1984                                               -3-<\/span><\/p>\n<p>same in the main switch house through various sub stations in the city.<\/p>\n<p>Apart from it, there was a workshop in the main switch building. The<\/p>\n<p>appellant had employed more than 20 persons.          Hence, it was rightly<\/p>\n<p>covered under the Act.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">            The contest between the parties was on the following issues,<\/p>\n<p>which were framed by the learned lower Court :-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>            1.     Whether the impugned order dated 17.4.1970<br \/>\n                   covering the petitioner is illegal, void and is<br \/>\n                   liable to be set aside on the grounds<br \/>\n                   mentioned in the petition ? OPP.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>            2.     Whether the petition is within limitation ?\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                   OPP.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>            3.     Whether the petition has been filed by a<br \/>\n                   competent and authorised person ? OPP.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>            4.     Relief ?<\/p><\/blockquote>\n<p id=\"p_6\">\n<p id=\"p_7\">            After going through the evidence led by the parties and<\/p>\n<p>affording hearing to their learned counsel, learned Court below held that<\/p>\n<p>the appellant had been rightly covered under the Act. The petition filed by<\/p>\n<p>the appellant was also held to be barred by time as it had been filed after<\/p>\n<p>the expiry of three years from the date of the order. Accordingly, the<\/p>\n<p>petition was dismissed with costs.\n<\/p>\n<p id=\"p_8\">\n<p id=\"p_9\">            Learned counsel for the appellant submitted that the appellant<\/p>\n<p>did not fall within the definition of &#8216;factory&#8217; because number of persons<\/p>\n<p>employed had never increased from 20. Moreover, no manufacturing<br \/>\n<span class=\"hidden_text\" id=\"span_2\"> F.A.O. No. 708 of 1984                                               -4-<\/span><\/p>\n<p>process was going on in the building of the appellant. The appellant had<\/p>\n<p>been purchasing electric energy from the Board and thereafter distributing<\/p>\n<p>the same to the consumers under the licence issued by the State<\/p>\n<p>government.\n<\/p>\n<p id=\"p_10\">\n<p id=\"p_11\">              The stand of the appellant has been opposed by the respondent<\/p>\n<p>by submitting that as the appellant was engaged in the manufacturing<\/p>\n<p>process because of generation, transformation and transmission of electric<\/p>\n<p>energy, it fell within the definition of    &#8216;factory&#8217; and therefore, rightly<\/p>\n<p>covered under the Act.\n<\/p>\n<p id=\"p_12\">\n<p id=\"p_13\">              Before adverting to the arguments addressed by learned<\/p>\n<p>counsel for the parties, the evidence led by them may be analysed. The<\/p>\n<p>appellant had examined K.K. Vohra PW1, Ram Rattan Gupta PW2 and<\/p>\n<p>R.K. Salwan PW3, whereas the respondent-Corporation had examined<\/p>\n<p>only one witness, namely, Hari Mitra RW1.          It has appeared in the<\/p>\n<p>testimony of K.K. Vohra PW1, who was Chief Electrical Engineer, that the<\/p>\n<p>strength of the employees of the appellant was 700 in the year 1968 and<\/p>\n<p>kept on increasing till the year 1981 when it was 1000\/-. According to<\/p>\n<p>him, the electric energy was being distributed by the appellant through the<\/p>\n<p>distribution lines from one point to the other. As per Ram Rattan PW2, the<\/p>\n<p>electric energy was distributed from the switch house. However, he could<\/p>\n<p>not deny that the electric energy was transformed and transmitted from one<\/p>\n<p>switch house to the other by the appellant. R.K. Salwan PW3 went on to<\/p>\n<p>state that the voltage of electric energy was controlled through setting up<br \/>\n<span class=\"hidden_text\" id=\"span_3\"> F.A.O. No. 708 of 1984                                                -5-<\/span><\/p>\n<p>of transformers as a result of which the voltage was brought down to the<\/p>\n<p>level as used in residential houses and industrial concerns. There were 86<\/p>\n<p>sub stations in which the said process was going on. The electricity was<\/p>\n<p>supplied by the appellant through these sub stations. The sub stations were<\/p>\n<p>known as switch houses because transformers had been put up there. In<\/p>\n<p>all, 4000 persons were working in the Power House Complex. On the<\/p>\n<p>other hand, in his testimony, Hari Mitra RW1 stated that there was a sub<\/p>\n<p>station in the power house of the appellant where the electricity after being<\/p>\n<p>received from the Board was transformed and transmitted thereafter to the<\/p>\n<p>various consumers.\n<\/p>\n<p id=\"p_14\">\n<p id=\"p_15\">            As is clear from the above, more than 20 person were<\/p>\n<p>employed for wages and &#8216;manufacturing process&#8217; was going on in the<\/p>\n<p>various sub stations with the aid of power. Therefore, the appellant was<\/p>\n<p>rightly found to be a &#8216;factory&#8217; and covered under the Act.<\/p>\n<p id=\"p_16\">            The question as to whether the process of transforming and<\/p>\n<p>transmitting electric energy    was a manufacturing process or not was<\/p>\n<p>settled by the Hon&#8217;ble Supreme Court in <a href=\"\/doc\/316117\/\" id=\"a_3\">The Nagpur Electric Light and<\/p>\n<p>Power Co. Ltd. v. The Regional Director, Employees&#8217; State Insurance<\/p>\n<p>Corporation<\/a>, A.I.R. 1967 Supreme Court 1364, wherein it was held that in<\/p>\n<p>view of <a href=\"\/doc\/1049683\/\" id=\"a_4\">Section 2(k)(iii)<\/a> of the Factories Act, 1948, the process of<\/p>\n<p>transforming electric energy from high to a low potential and the process<\/p>\n<p>of transmitting the energy through supply lines were both &#8216;manufacturing<\/p>\n<p>processes&#8217;. Moreover, wherein a part of the premises occupied by the<br \/>\n<span class=\"hidden_text\" id=\"span_4\"> F.A.O. No. 708 of 1984                                                  -6-<\/span><\/p>\n<p>company, the two processes were carried on with the aid of power by<\/p>\n<p>means of electrical gadgets and other devices and on the premises more<\/p>\n<p>than 20 persons were working and no part of the premises was used for<\/p>\n<p>purposes unconnected with the manufacturing processes, the premises<\/p>\n<p>constituted a factory within the meaning of <a href=\"\/doc\/305412\/\" id=\"a_5\">Section 2(12)<\/a> of the Act. The<\/p>\n<p>conclusions arrived at are reproduced here-in-below :-<\/p>\n<blockquote id=\"blockquote_5\"><p>              &#8220;In view of S.2(k)(iii), the process of transforming<br \/>\n              electrical energy from a high to a low potential and<br \/>\n              the process of transmitting the energy through<br \/>\n              supply lines are both manufacturing processes. In a<br \/>\n              part of the premises occupied by the company, the<br \/>\n              two processes are carried on with the aid of power<br \/>\n              by means of electrical gadgets and other devices.<br \/>\n              On the premises more than twenty persons were<br \/>\n              and are working. No part of the premises is used<br \/>\n              for purposes unconnected with the manufacturing<br \/>\n              processes. The premises therefore constitute a<br \/>\n              factory within the meaning of S.2(12) of the<br \/>\n              Employees&#8217; <a href=\"\/doc\/88376\/\" id=\"a_6\">State Insurance Act<\/a>, 1948.&#8221;<\/p><\/blockquote>\n<p id=\"p_17\">\n<p id=\"p_18\">             <a href=\"\/doc\/1945035\/\" id=\"a_7\">In Transport Corporation of India v. Employees&#8217; State<\/p>\n<p>Insurance Corporation and another<\/a>, (2000) 1 Supreme Court Cases 332,<\/p>\n<p>while noticing the object of the Act, which was to provide certain benefits<\/p>\n<p>to the employees, the Hon&#8217;ble Supreme Court held that the beneficial piece<\/p>\n<p>of legislation had to be construed in its correct perspective so as to fructify<\/p>\n<p>the legislative intention underlying its enactment. When two views were<\/p>\n<p>possible on its applicability to a given set of employees, the one which<\/p>\n<p>resulted in furtherance of the legislative intention be preferred to the one<br \/>\n<span class=\"hidden_text\" id=\"span_5\"> F.A.O. No. 708 of 1984                                                  -7-<\/span><\/p>\n<p>which would frustrate it. It was observed as follows :-<\/p>\n<blockquote id=\"blockquote_6\"><p>                   &#8220;Before parting with the discussion on this<br \/>\n            point, it is necessary to keep in view the salient fact<br \/>\n            that the Act is a beneficial piece of legislation<br \/>\n            intended to provide benefits to employees in case of<br \/>\n            sickness, maternity, employment injury and for<br \/>\n            certain other matters in relation thereto. It is enacted<br \/>\n            with a view to ensuring social welfare and for<br \/>\n            providing safe insurance cover to employees who<br \/>\n            were likely to suffer from various physical illness<br \/>\n            during the course of their employment. Such a<br \/>\n            beneficial piece of legislation has to be construed in<br \/>\n            its correct perspective so as to fructify the legislative<br \/>\n            intention underlying its enactment. When two views<br \/>\n            are possible on its applicability to a given set of<br \/>\n            employees, that view which furthers the legislative<br \/>\n            intention should be preferred to the one which<br \/>\n            would frustrate it. It is difficult to appreciate how it<br \/>\n            could be contended by the appellant with any<br \/>\n            emphasis that an employee working at its head<br \/>\n            office in Secunderabad would be governed by the<br \/>\n            beneficial sweep of the Act as admittedly the head<br \/>\n            office employees are covered by the Act, but once<br \/>\n            such an employee, whether working on the<br \/>\n            administrative side or connected with the actual<br \/>\n            transportation of goods, if transferred to the Bombay<br \/>\n            branch even with his consent, cannot be governed<br \/>\n            by the beneficial provisions of the Act.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>                   Dealing with this very Act, a three-Judge<br \/>\n            Bench of this Court in the case of <a href=\"\/doc\/1446711\/\" id=\"a_8\">Buckingham and<br \/>\n            Carnatic Co. Ltd. v. Venkatiah<\/a> AIR 1964 SC 1272<br \/>\n<span class=\"hidden_text\" id=\"span_6\"> F.A.O. No. 708 of 1984                                           -8-<\/span><\/p>\n<p>         speaking through Gajendragadkar, J., (as he then<br \/>\n         was) held, accepting the contention of the learned<br \/>\n         counsel, Mr. Dolia that:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_8\"><p>                    &#8220;It is a piece of social legislation<br \/>\n             intended to confer specified benefits on<br \/>\n             workmen to whom it applies, and so, it would<br \/>\n             be inappropriate to attempt to construe the<br \/>\n             relevant provisions in a technical or a<br \/>\n             narrow sense.         This position cannot be<br \/>\n             disputed. But in dealing with the plea raised<br \/>\n             by Mr. Dolia that the section should be<br \/>\n             liberally construed, we cannot overlook the<br \/>\n             fact that the liberal construction must<br \/>\n             ultimately flow from the words used in the<br \/>\n             section. If the words used in the section are<br \/>\n             capable of two constructions one of which is<br \/>\n             shown patently to assist the achievement of<br \/>\n             the object of the Act, courts would be<br \/>\n             justified in preferring that construction to the<br \/>\n             other which may not be able to further the<br \/>\n             object of the Act.&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_9\"><p>         As we have already seen earlier, the express<br \/>\n         phraseology of <a href=\"\/doc\/1176844\/\" id=\"a_9\">Section 2(9)<\/a> of the Act defining an<br \/>\n         &#8220;employee&#8221; read with <a href=\"\/doc\/810029\/\" id=\"a_10\">Section 38<\/a> of the Act clearly<br \/>\n         projects the legislative intention of spreading the<br \/>\n         beneficial network of the Act sufficiently wide for<br \/>\n         covering all employees working for the main<br \/>\n         establishment covered by the Act even though<br \/>\n         actually stationed at different branches outside the<br \/>\n         State wherein the head office of the establishment is<br \/>\n         located.   In any case, the said construction can<br \/>\n         reasonably flow from the aforesaid statutory<br \/>\n<span class=\"hidden_text\" id=\"span_7\"> F.A.O. No. 708 of 1984                                                  -9-<\/span><\/p>\n<p>             provisions.    If that is so, any other technical or<br \/>\n             narrower construction, even if permissible, cannot<br \/>\n             be countenanced, as that would frustrate the<br \/>\n             legislative intent underlying the enactment of such a<br \/>\n             beneficial social security scheme.&#8221;<\/p><\/blockquote>\n<p id=\"p_19\">\n<p id=\"p_20\">             Order dated 17.4.1970 passed by the Corporation while<\/p>\n<p>covering the appellant under the Act was challenged by the appellant by<\/p>\n<p>filing the petition on 26.10.1982. Such an application could have been<\/p>\n<p>made only within a period of three years from the date on which the cause<\/p>\n<p>of action had arisen and not later. As the cause of action arose to the<\/p>\n<p>appellant on 17.4.1970, when the order was passed by the Corporation, the<\/p>\n<p>said order could be challenged within a period of three years from the date<\/p>\n<p>of the order and not beyond.\n<\/p>\n<p id=\"p_21\">\n<p id=\"p_22\">             Resultantly, no case is made out for any interference in the<\/p>\n<p>order passed by learned Employees&#8217; Insurance Court dated 31.5.1984<\/p>\n<p>whereby the petition filed by the appellant under <a href=\"\/doc\/1243820\/\" id=\"a_11\">Section 75<\/a> of the Act was<\/p>\n<p>dismissed.\n<\/p>\n<p id=\"p_23\">\n<p id=\"p_24\">             The appeal is without any merit, and, therefore, dismissed.<\/p>\n<pre id=\"pre_1\">\n\n\n\n\n                                                        ( T.P.S.
