DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/12\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">This<br \/>\n\tapplication is filed under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered at<br \/>\n\tC.R.No. I- 452 of 2010 with Amraiwadi Police Station, for the<br \/>\n\toffences punishable under <a href=\"\/doc\/1171128\/\" id=\"a_1\">Sections 384<\/a>. 294(b), 506(1) and 114 etc.<br \/>\n\tof<a href=\"\/doc\/1569253\/\" id=\"a_2\"> the Indian Penal Code<\/a> and Sections 33 and 34 of the Money Lending<br \/>\n\tAct.\n<\/p>\n<p id=\"p_1\">Mr.D.\n<\/p>\n<p id=\"p_2\">\tT. Dave, learned counsel appearing for the applicants submits that<br \/>\n\tthe applicants are falsely implicated in the offences registered<br \/>\n\tinasmuch as the applicants had not taken any coercive action against<br \/>\n\tthe deceased for recovery of their dues and on the contrary, the<br \/>\n\tapplicants had made payment to the complainant on five different<br \/>\n\toccasions through cheques in the month of December, 2009 and<br \/>\n\tJanuary, 2010. Besides the version of the complainant reveals that<br \/>\n\tthe applicants were dealing in share transactions and illegal<br \/>\n\tactivities of &#8220;dabba&#8221; and thus incurred debts which<br \/>\n\tcould not be paid by him. It is submitted that hence, the applicants<br \/>\n\tmay be enlarged on anticipatory bail by imposing suitable<br \/>\n\tconditions.\n<\/p>\n<p id=\"p_3\">Mr.Kartik<br \/>\n\tPandya, learned APP for the respondent &#8211; State submits that<br \/>\n\tthe applicants are involved in serious offences and they may not be<br \/>\n\tenlarged on anticipatory bail.\n<\/p>\n<p id=\"p_4\">Having<br \/>\n\theard learned counsel for the parties and perused the record of the<br \/>\n\tcase and considering the facts and circumstances and the backdrop of<br \/>\n\tthe facts, I am inclined to grant anticipatory bail to the<br \/>\n\tapplicants.\n<\/p>\n<p id=\"p_5\">Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p id=\"p_6\">In<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of the applicant herein being arrested pursuant to FIR being<br \/>\n\tC.R.No. I- 452 of 2010 with Amraiwadi Police Station, the applicants<br \/>\n\tshall be released on bail on furnishing a bond of Rs.5,000\/- [Rupees<br \/>\n\tFive Thousand Only] each with one surety of like amount on following<br \/>\n\tconditions :-\n<\/p>\n<p id=\"p_7\">(a)\tshall<br \/>\ncooperate with the investigation and make available for whenever<br \/>\nrequired;\n<\/p>\n<p id=\"p_8\">(b)\tshall<br \/>\nremain present at the concerned Police Station on 30.12.2010 at<br \/>\n11.00 a.m ;\n<\/p>\n<p id=\"p_9\">(c)\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them for disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p id=\"p_10\">(d)\tat the<br \/>\ntime of execution of bond, furnish the address to the Investigating<br \/>\nOfficer and the Court concerned and shall not change the residence<br \/>\ntill the final disposal of the case till further orders;\n<\/p>\n<p id=\"p_11\">(e)\twill<br \/>\nnot leave India without the permission of the Court and, if is<br \/>\nholding passports, shall surrender the same before the trial Court<br \/>\nwithin a week;\n<\/p>\n<p id=\"p_12\">(f)\tit<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if they consider it just and proper and the concerned<br \/>\nMagistrate would decide it on merits ;\n<\/p>\n<p id=\"p_13\">(g)\tthis<br \/>\norder will be operative if the applicants are arrested at any time<br \/>\nwithin a period of 90 days ;\n<\/p>\n<p id=\"p_14\">(h)\twithin<br \/>\na period of ten days from the date of arrest, the applicants shall<br \/>\napply for regular bail which application shall be decided by the<br \/>\ncompetent Court in accordance with law without being influenced by<br \/>\nthe fact that anticipatory bail was granted.\n<\/p>\n<p id=\"p_15\">With<br \/>\n\tthese directions, this Criminal Misc.
