Justice ANTONY DOMINIC\n\n Dated :28\/01\/2011\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                    ================\n                   W.P.(C) NO. 2914 OF 2011\n                =====================\n\n           Dated this the 28th day of January, 2011\n\n                          J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      Ext.P3 order is under challenge. This order was passed by<\/p>\n<p>the District Collector, Malappuram on 14\/7\/2010 in the purported<\/p>\n<p>exercise of his powers under the Kerala Protection of River Banks<\/p>\n<p>and Regulation of Removal of Sand Act, 2001. Admittedly, Act<\/p>\n<p>was amended w.e.f. 14\/6\/2010, and with effect from that date,<\/p>\n<p>the power to pass order in the nature of Ext.P3 has been<\/p>\n<p>conferred on the Sub Divisional Magistrate. In that view, Ext.P3<\/p>\n<p>has to be held as an order passed without jurisdiction and<\/p>\n<p>therefore the order is liable to be set aside.<\/p>\n<p id=\"p_1\">      2.   However fact remains that more than 6 months have<\/p>\n<p>already elapsed since the passing of Ext.P3. In the meantime, if<\/p>\n<p>further action has been taken based on Ext.P3 and the vehicle has<\/p>\n<p>been auctioned, no useful purpose will be served by directing a re<\/p>\n<p>adjudication in the matter.\n<\/p>\n<p id=\"p_2\">      3.   Taking note of the above, I dispose of this writ petition<\/p>\n<p>directing that, if as asserted by the learned counsel for the<\/p>\n<p>petitioner, vehicle has not been auctioned so far, Ext.P3 will be<\/p>\n<p>WPC No. 2914\/11<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                :2 :<\/span><\/p>\n<p>treated as set aside and Sub Divisional Magistrate concerned will<\/p>\n<p>reconsider the matter with notice to the petitioner and pass<\/p>\n<p>appropriate orders in the matter.\n<\/p>\n<p id=\"p_3\">     Petitioner shall produce a copy of this judgment along with<\/p>\n<p>a copy of this writ petition before the 2nd respondent, who shall<\/p>\n<p>take appropriate action as directed.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">                                     ANTONY DOMINIC, JUDGE<br \/>\nRp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Mansoor Ali N. vs The State Of Kerala Rep.By on 28 January, 2011 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 2914 of 2011(L) 1.
