Justice R.BASANT\n\n Dated :20\/08\/2007\n\n O R D E R\n                             R.BASANT, J.\n                          ----------------------\n                          B.A.No.5036 of 2007\n                      ----------------------------------------\n               Dated this the 20th day of August 2007\n\n                                 O R D E R\n<\/pre>\n<p id=\"p_1\">      Application for anticipatory bail.                  The petitioner faces<\/p>\n<p>allegations under the Kerala Abkari Act.                    Investigation is now<\/p>\n<p>complete. Final report has already been filed. Committal court<\/p>\n<p>has taken cognizance.          Coercive processes have been issued<\/p>\n<p>against the petitioner. The petitioner finds a warrant of arrest<\/p>\n<p>issued by the learned Magistrate chasing him.\n<\/p>\n<p id=\"p_1\">      2.   The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is absolutely innocent.             His absence earlier was not<\/p>\n<p>wilful. But was on account of reasons beyond his control. The<\/p>\n<p>petitioner is willing to surrender before the learned Magistrate and<\/p>\n<p>apply for bail. But he apprehends that his application for bail may<\/p>\n<p>not be considered by the learned Magistrate on merits, in<\/p>\n<p>accordance with law and expeditiously.                He, therefore, prays that<\/p>\n<p>directions under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> Cr.P.C. may be issued to the learned<\/p>\n<p>Magistrate to release the petitioner on bail when he appears and<\/p>\n<p>applies for bail.\n<\/p>\n<p id=\"p_2\">      3.   After the decision in <a href=\"\/doc\/257280\/\" id=\"a_1\">Bharat Chaudhary v. State of Bihar<\/a><\/p>\n<p>[AIR 2003 SC 4662] it is well settled that powers under <a href=\"\/doc\/1783708\/\" id=\"a_2\">Section<\/p>\n<p>438<\/a> Cr.P.C can be invoked even in favour of the accused who<\/p>\n<p>apprehends arrest in execution of a non bailable warrant issued in<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.No.5036\/07                    2<\/span><\/p>\n<p>a pending proceedings.          But even for that, sufficient and<\/p>\n<p>satisfactory reasons must be shown to exist to justify the<\/p>\n<p>invocation of the extraordinary equitable discretion under <a href=\"\/doc\/1783708\/\" id=\"a_3\">Section<\/p>\n<p>438<\/a> Cr.P.C. I do not find any such reasons in this case.<\/p>\n<p id=\"p_3\">      4.    It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate     and   explain    to   the  learned    Magistrate,  the<\/p>\n<p>circumstances under which he could not earlier appear before the<\/p>\n<p>learned Magistrate. I find absolutely no reason to assume that the<\/p>\n<p>learned Magistrate would not consider the application for bail to<\/p>\n<p>be filed by the petitioner on merits, in accordance with law and<\/p>\n<p>expeditiously.    Every court must do the same.        No special or<\/p>\n<p>specific directions appear to be necessary.         Sufficient general<\/p>\n<p>directions have been issued in Alice George vs. Deputy<\/p>\n<p>Superintendent of Police [2003(1)KLT 339].\n<\/p>\n<p id=\"p_4\">      5.
