                    dated 01.08.2006 passed by the Judicial Magistrate,<\/p>\n
                    Gopalganj in Trial No. 1380 of 2009 arising out of<\/p>\n
                    Complaint Case No. 500 of 2006 by which the process has<\/p>\n
                    been issued against the accused persons after taking<\/p>\n
                    cognizance for offence under Section 323<\/a> and 379<\/a> of the<\/p>\n
                    Indian Penal Code.\n<\/p>\n
                                 2.   The prosecution case as alleged in the
\n                   2<\/span><\/p>\n
complaint petition by the complainant claiming to be the<\/p>\n
reporter of Gopalganj Times now English T.V. Channel<\/p>\n
who published news in English is that one Harihar Prasad<\/p>\n
who is the witness in the case came and alleged that<\/p>\n
Rs.500\/- is being demanded as bribe for granting him a<\/p>\n
cheque of Rs.12,500\/- which has matured under the money<\/p>\n
back policy. It is alleged that the complainant along with<\/p>\n
his secret camera went to the Branch Manager and<\/p>\n
reported that Rs.500\/- is being demanded for the said<\/p>\n
cheque. It is alleged that the accused no. 1 Shashi Shekhar<\/p>\n
Thakur, Ex-Branch Manager, Life Insurance Corporation<\/p>\n
of India, Gopalganj said that a demand is only for Rs.500\/-<\/p>\n
otherwise really Rs.1000\/- is taken for encashment and<\/p>\n
hence advised to pay. It is further alleged that thereafter<\/p>\n
the Branch Manager called accused no. 2 Someshwar Ram<\/p>\n
in his Chamber and asked Harihar Prasad to pay him<\/p>\n
Rs.500\/- and it is alleged that Harihar Prasad paid Rs.500\/-<\/p>\n
to accused no. 2 which was also recorded in the camera. It<\/p>\n
is alleged that accused no. 3 and alleged to be the peon in<\/p>\n
the said office and made a Halla that the complainant is a<\/p>\n
Journalist and he is giving the bribe to make out a news<\/p>\n
and on which the accused no. 1 caught hold of the collar
\n                   3<\/span><\/p>\n
and then a physical altercation took place and it is alleged<\/p>\n
that he threw away the camera kept in the pocket of the<\/p>\n
complainant on the ground by which the camera got<\/p>\n
damaged and during forgery and physical altercation it is<\/p>\n
alleged that Rs.2,500\/- was taken away by the peon from<\/p>\n
the pocket of the informant and the complainant and the<\/p>\n
witness was thrown out and the damaged camera was not<\/p>\n
provided.\n<\/p>\n
            3.    Learned counsel for the petitioners,<\/p>\n
however, contended that the complaint is false, fictitious<\/p>\n
and mala fide and there was no occasion for the Journalist<\/p>\n
to enter into the premises and the allegation about the<\/p>\n
assault and taking out the money by the peon to the tune of<\/p>\n
Rs.2,500\/- is malicious and not believable and is so absurd<\/p>\n
and inherently improbable that no prudent man can ever<\/p>\n
believe it and even description of the camera has not been<\/p>\n
mentioned in the complaint petition. However, the<\/p>\n
petitioner no. 1 is the Branch Manager, petitioner no. 2 is<\/p>\n
the Administrative Officer and petitioner no. 3 is the Peon.<\/p>\n
            4.    Learned counsel for the petitioners,<\/p>\n
however, contended that the allegation regarding the<\/p>\n
assault is omnibus and not specific who assaulted him and
\n                   4<\/span><\/p>\n
the specification of the camera has not been mentioned.<\/p>\n
            5. However, taking into consideration the fact<\/p>\n
there is allegation that a demand of Rs.500\/- made for<\/p>\n
encashing the money back policy to the tune of<\/p>\n
Rs.12,500\/- and in this connection the petitioner<\/p>\n
complainant being the Journalist went along with the<\/p>\n
witness alleged to have taken photograph and it is alleged<\/p>\n
that the camera was damaged and even was not returned<\/p>\n
but the specification of the camera has not been made nor<\/p>\n
any case instituted before the police for the said camera<\/p>\n
and to a court question has stated that he got camera from<\/p>\n
the Company and he has not lodged any case in police<\/p>\n
station regarding the theft of camera.\n<\/p>\n
            6. However, taking into consideration the fact<\/p>\n
and circumstance, the petitioner entered into the premises<\/p>\n
for taking photograph and thereafter the allegation of<\/p>\n
assault is vague and the only allegation that the Branch<\/p>\n
Manager caught hold of collar of complainant and threw<\/p>\n
the camera, there is further allegation of snatching of<\/p>\n
Rs.2500\/- by peon.\n<\/p>\n
            7. However, having regard to the facts and<\/p>\n
circumstances of the case, though the point is raised that
\n                             5<\/span><\/p>\n
         the prosecution is mala fide to spit vengeance but this<\/p>\n
         court while exercising the jurisdiction under Section 482<\/a><\/p>\n
         of the Cr.P.C. has no jurisdiction to examine the<\/p>\n
         correctness or otherwise of the allegation at this stage and<\/p>\n
         fact alleged cannot be tested at the out set or in exercise of<\/p>\n
         jurisdiction under Section 482<\/a> of the Cr.P.C. is to be<\/p>\n
         exercised sparingly and with circumspection. When fact<\/p>\n
         alleged make out an offence then mala fide of informant<\/p>\n
         would be of secondary importance and cannot themselves<\/p>\n
         be the basis for quashing and not to embark the allegations<\/p>\n
         likely to be established or not and hence under the facts<\/p>\n
         and circumstances, I do not find fit to interfere with the<\/p>\n
         impugned order and hence the petition is dismissed.<\/p>\n
