NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t\t O R D E R<br \/>\n     Delay condoned.\n<\/p>\n<p id=\"p_1\">     Leave granted<br \/>\n     We have learned counsel on both sides<br \/>\n     Notifications under  <a href=\"\/doc\/169774\/\" id=\"a_1\">section 4(1)<\/a>\tLand Acquisition Act<br \/>\n(for short,  the &#8216;Act&#8217;)\t was published\ton May\t7, 1986. The<br \/>\nNotice under  <a href=\"\/doc\/85678\/\" id=\"a_1\">Section 5-A<\/a> was issued and the objection filed<br \/>\non   December\t17,   1986   were   over-ruled\t after\t due<br \/>\nconsideration. Declaration  under <a href=\"\/doc\/1792838\/\" id=\"a_2\">Section 6<\/a> was published on<br \/>\nAugust 25, 1987. After conducting of enquiry, the award came<br \/>\nto be made on December 17, 1988. The symbolic possession was<br \/>\ntaken on  the said  date. The  respondents  filed  the\twrit<br \/>\npetition on August 19, 1989. The High Court allowed the writ<br \/>\npetition by  the impugned  judgment dated  August 31,1992 in<br \/>\nW.P. No.  3354\/1988. The  question is  whether the procedure<br \/>\nfollowed by the Land Acquisition officer was vitiated by any<br \/>\nerror  manifest\t  on  the  face\t of  the  record  warranting<br \/>\ninterference by\t the High  Court? Shri\tNaresh Kumar  Shrma,<br \/>\nlearned counsel\t for  the  respondents,\t contends  that\t the<br \/>\nrespondent\/tenant has  not been given any opportunity at the<br \/>\nenquiry under  <a href=\"\/doc\/85678\/\" id=\"a_3\">Section 5-A<\/a>.  The land  is the only source of<br \/>\nlivelihood and\tscheme was  temporary. In  view of  the long<br \/>\nlapse of  time the  purpose of the acquisition under <a href=\"\/doc\/169774\/\" id=\"a_4\">Section<br \/>\n4(1)<\/a> of\t the Act  no longer survived. Therefore, it does not<br \/>\nserve and  purpose. Counter  affidavit filled  in  the\tHigh<br \/>\nCourt by respondents shows that pursuant to the notice under<br \/>\nRule 30\t of the\t Land Acquisition Rules, the respondents had<br \/>\nfiled the objections and it is stated therein as under:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;The concerned  farmers were issued<br \/>\n     notices under <a href=\"\/doc\/85678\/\" id=\"a_5\">Section 5-A<\/a> under the<br \/>\n     <a href=\"\/doc\/7832\/\" id=\"a_6\">Land Acquisition  Act<\/a> and\tRule  30<br \/>\n     giving 30\tdays  time  for\t raising<br \/>\n     objection\ton  2.9.1986,  concerned<br \/>\n     farmer  Shri   Mussa  alias  Swesha<br \/>\n     Nanda Objected  which was\ttaken on<br \/>\n     record.&#8221;<\/p><\/blockquote>\n<p id=\"p_2\">     Obviously, after consideration of all the objection and<br \/>\nrejection  thereof,   declaration  under   <a href=\"\/doc\/1792838\/\" id=\"a_7\">Section   6<\/a>\t was<br \/>\npublished.  As\tstated\tearlier,  the  award  was  made\t and<br \/>\nsymbolic possession  was taken\ton December  17, 1988. Under<br \/>\nthe circumstances,  the land  stood vested in the State free<br \/>\nfrom all  encumbrances. After  the  proceedings\t had  become<br \/>\nfinal, the  writ petition   came to be filed on May 19,1989.<br \/>\nThe mere  fact that due to lapse of time no action was taken<br \/>\nafter the  filing of the writ petition, does not give ground<br \/>\nfor interference.  The further fact that public purpose must<br \/>\nhave been  served  by  constructing  the  quarters  for\t the<br \/>\nofficers elsewhere,  is without any substance. The mere fact<br \/>\nthat on\t account of  the pending litigation, no construction<br \/>\nwas made,  is no  ground  to  say  that\t notification  under<br \/>\n<a href=\"\/doc\/169774\/\" id=\"a_8\">section 4(1)<\/a>  was vitiated  by any  error of  law;  equally,<br \/>\nincrease in the prices of the lands is no ground.\n<\/p>\n<p id=\"p_3\">     The appeal\t is accordingly allowed. The judgment of the<br \/>\nHigh Court  stands set aside. The notification under <a href=\"\/doc\/169774\/\" id=\"a_9\">Section<br \/>\n4(1)<\/a> and  declaration under  <a href=\"\/doc\/1792838\/\" id=\"a_10\">Section  6<\/a>\t of  the  Act  stand<br \/>\nrestored.
